{"id":88721,"date":"2026-06-22T10:08:06","date_gmt":"2026-06-22T08:08:06","guid":{"rendered":"https:\/\/www.almega.se\/?p=88721"},"modified":"2026-06-22T10:08:13","modified_gmt":"2026-06-22T08:08:13","slug":"uteblivna-forhandlingar-rackte-inte-for-mbl-skadestand-enligt-ad","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2026\/06\/uteblivna-forhandlingar-rackte-inte-for-mbl-skadestand-enligt-ad\/","title":{"rendered":"Uteblivna f\u00f6rhandlingar r\u00e4ckte inte f\u00f6r MBL\u2011skadest\u00e5nd enligt AD"},"content":{"rendered":"\n<p><strong><a href=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/2026\/2026-06-17-ad-2026-nr-46\/\" type=\"link\" id=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/2026\/2026-06-17-ad-2026-nr-46\/\">AD 2026 nr 46<\/a><\/strong><\/p>\n\n\n\n<p>Huvudsakligen fr\u00e5ga om yrkat skadest\u00e5nd f\u00f6r brott mot f\u00f6rhandlingsskyldighet enligt medbest\u00e4mmandelagen (\u201dMBL\u201d) skulle utd\u00f6mas vid en tredskodomspr\u00f6vning.<\/p>\n\n\n\n<p>Livsmedelsarbetaref\u00f6rbundet (\u201df\u00f6rbundet\u201d) ans\u00f6kte om st\u00e4mning mot ett bolag som var bundet av livsmedelsavtalet genom h\u00e4ngavtal med f\u00f6rbundet, och yrkade bl.a. skadest\u00e5nd f\u00f6r brott mot f\u00f6rhandlingsskyldigheten enligt MBL. F\u00f6rbundet hade d\u00e4rvid dels angett att bolaget, vid ett par tillf\u00e4llen, inte hade inst\u00e4llt sig till \u00f6verenskommet sammantr\u00e4de f\u00f6r f\u00f6rhandling som bolaget hade p\u00e5kallat, dels angett att f\u00f6rbundet hade skickat en framst\u00e4llning till bolaget med beg\u00e4ran om central f\u00f6rhandling viss angiven dag i enlighet med f\u00f6rhandlingsordningen i kollektivavtalet, och att bolaget inte inst\u00e4llde sig till den f\u00f6rhandlingen heller. F\u00f6rbundet yrkade 150&nbsp;000 kr i allm\u00e4nt skadest\u00e5nd f\u00f6r brott mot MBL.<\/p>\n\n\n\n<p>Ut\u00f6ver skadest\u00e5nd f\u00f6r brott mot MBL yrkade f\u00f6rbundet \u00e4ven olika ers\u00e4ttningar till tre medlemmar i f\u00f6rbundet; detta avs\u00e5g l\u00f6n, semesterers\u00e4ttning, arbetstidskonto\/delpension, samt allm\u00e4nna skadest\u00e5nd f\u00f6r brott mot semesterlagen och kollektivavtalet. Vidare yrkade f\u00f6rbundet allm\u00e4nt skadest\u00e5nd f\u00f6r brott mot kollektivavtalet till f\u00f6rbundet sj\u00e4lv.<\/p>\n\n\n\n<p>Bolaget delgavs st\u00e4mningsans\u00f6kan med f\u00f6rel\u00e4ggande att inkomma med skriftligt svarom\u00e5l och informerades om att tredskodom annars kunde meddelas mot bolaget. Bolaget h\u00f6rdes inte av inom f\u00f6relagd tid. F\u00f6rbundet motsatte sig inte att Arbetsdomstolen meddelade tredskodom.<\/p>\n\n\n\n<p>Arbetsdomstolen redovisade f\u00f6ljande r\u00e4ttsliga utg\u00e5ngspunkter f\u00f6r tredskodomspr\u00f6vningen.<\/p>\n\n\n\n<p>\u201d<em>Enligt 44 kap. 8 \u00a7 andra stycket r\u00e4tteg\u00e5ngsbalken ska en tredskodom mot svaranden grundas p\u00e5 k\u00e4randens framst\u00e4llning av omst\u00e4ndigheterna i m\u00e5let, s\u00e5vitt svaranden f\u00e5tt del av framst\u00e4llningen och den inte strider mot f\u00f6rh\u00e5llande, som \u00e4r allm\u00e4nt veterligt. I den m\u00e5n framst\u00e4llningen inte innefattar laga sk\u00e4l f\u00f6r k\u00e4rom\u00e5let eller det annars uppenbart framg\u00e5r, att k\u00e4rom\u00e5let \u00e4r ogrundat, ska det ogillas<\/em>\u201d.<\/p>\n\n\n\n<p>D\u00e4refter \u00f6vergick Arbetsdomstolen till f\u00f6rbundets talan om skadest\u00e5nd f\u00f6r brott mot f\u00f6rhandlingsskyldigheten enligt MBL, och anf\u00f6rde bl.a. f\u00f6ljande r\u00e4ttsliga utg\u00e5ngspunkter:<\/p>\n\n\n\n<p>Det \u00e4r den som har f\u00e5tt en framst\u00e4llning om f\u00f6rhandling fr\u00e5n en f\u00f6rhandlingsber\u00e4ttigad part som enligt MBL \u00e4r skyldig att inst\u00e4lla sig till f\u00f6rhandlingssammantr\u00e4de; MBL inneh\u00e5ller inte n\u00e5gon best\u00e4mmelse som inneb\u00e4r att den part som gjort en framst\u00e4llning om f\u00f6rhandling har en skadest\u00e5ndssanktionerad skyldighet att inst\u00e4lla sig till f\u00f6rhandlingssammantr\u00e4de, det st\u00e5r n\u00e4mligen den parten fritt att \u00e5terkalla framst\u00e4llningen eller annars avst\u00e5 fr\u00e5n den beg\u00e4rde f\u00f6rhandlingen &#8211;&nbsp; t ex. genom att utebli fr\u00e5n ett f\u00f6rhandlingssammantr\u00e4de.<\/p>\n\n\n\n<p>Arbetsdomstolen \u00f6vergick sedan till bed\u00f6mningen i det aktuella fallet avseende f\u00f6rbundets talan om skadest\u00e5nd f\u00f6r brott mot MBL.<\/p>\n\n\n\n<p>Mot bakgrund av det ovan anf\u00f6rda ans\u00e5g Arbetsdomstolen att det f\u00f6rh\u00e5llandet att bolaget l\u00e5tit bli att inst\u00e4lla sig till f\u00f6rhandlingssammantr\u00e4de som bolaget sj\u00e4lv beg\u00e4rt inte kunde medf\u00f6ra skyldighet f\u00f6r bolaget att betala f\u00f6rbundet skadest\u00e5nd enligt MBL. S\u00e5vitt avs\u00e5g de sammantr\u00e4den som bolaget sj\u00e4lv beg\u00e4rt fann Arbetsdomstolen d\u00e4rmed att f\u00f6rbundet inte hade anf\u00f6rt n\u00e5gra omst\u00e4ndigheter som kunde leda till ett bifall till kravet p\u00e5 skadest\u00e5nd. F\u00f6rbundets framst\u00e4llning av omst\u00e4ndigheterna innefattade s\u00e5ledes inte laga sk\u00e4l f\u00f6r kravet i den delen, och avslogs d\u00e4rf\u00f6r av Arbetsdomstolen.<\/p>\n\n\n\n<p>G\u00e4llande f\u00f6rbundets egen framst\u00e4llning om f\u00f6rhandling s\u00e5 anf\u00f6rde domstolen att bolaget m\u00e5ste ha f\u00e5tt del av f\u00f6rbundets framst\u00e4llning om f\u00f6rhandling f\u00f6r att det ska bli skyldigt att f\u00f6rhandla och inst\u00e4lla sig till f\u00f6rhandlingssammantr\u00e4de. Arbetsdomstolen anf\u00f6rde sedan att f\u00f6rbundet inte hade p\u00e5st\u00e5tt att bolaget f\u00e5tt del av f\u00f6rbundets s\u00e4nda framst\u00e4llning om central f\u00f6rhandling, som bolaget inte inst\u00e4llde sig till. \u00c4ven i fr\u00e5ga om den centrala f\u00f6rhandlingen ans\u00e5g Arbetsdomstolen d\u00e4rmed att f\u00f6rbundet inte hade anf\u00f6rt omst\u00e4ndigheter som kunde leda till ett bifall till kravet p\u00e5 skadest\u00e5nd. F\u00f6rbundets krav avslogs d\u00e4rf\u00f6r \u00e4ven i den delen, d\u00e5 f\u00f6rbundets framst\u00e4llning av omst\u00e4ndigheterna inte innefattade laga sk\u00e4l f\u00f6r kravet.<\/p>\n\n\n\n<p>Som anf\u00f6rts ovan hade f\u00f6rbundet \u00e4ven f\u00f6rt talan i vissa andra delar, och i dessa \u00f6vriga delar ans\u00e5g Arbetsdomstolen d\u00e4remot att det fanns f\u00f6ruts\u00e4ttningar att bifalla f\u00f6rbundets talan genom tredskodom. De yrkade ers\u00e4ttningarna\/skadest\u00e5nden till medlemmarna, och till f\u00f6rbundet, bif\u00f6lls d\u00e4rf\u00f6r.<\/p>\n\n\n\n<p>Med h\u00e4nsyn till utg\u00e5ngen i m\u00e5let \u2013 att f\u00f6rbundet tappat m\u00e5let i den del som avs\u00e5g talan pga. brott mot MBL, men vunnit i \u00f6vriga delar \u2013 ans\u00e5g Arbetsdomstolen att f\u00f6rbundet skulle f\u00e5 ers\u00e4ttning f\u00f6r tre fj\u00e4rdedelar av sina r\u00e4tteg\u00e5ngskostnader; dvs. 43&nbsp;500 kr av yrkat belopp om 58&nbsp;000 kr.<\/p>\n\n\n\n<p>&gt;&nbsp;<a href=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/\" target=\"_blank\" rel=\"noreferrer noopener\">L\u00e4s fler domar p\u00e5 Arbetsdomstolens hemsida<\/a>.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>AD 2026 nr 46 Huvudsakligen fr\u00e5ga om yrkat skadest\u00e5nd f\u00f6r brott mot f\u00f6rhandlingsskyldighet enligt medbest\u00e4mmandelagen (\u201dMBL\u201d) skulle utd\u00f6mas vid en tredskodomspr\u00f6vning.
