Arbetstagaren (\u201dMD\u201d) har en medf\u00f6dd h\u00f6rselneds\u00e4ttning. Hon har d\u00e4rut\u00f6ver fibromyalgi, artros, utmattningssyndrom, s\u00f6mnapn\u00e9 och blandat \u00e5ngest-depressionstillst\u00e5nd. Sjukdomarna medf\u00f6r besv\u00e4r med bl.a. v\u00e4rk, uttr\u00f6ttbarhet och k\u00e4nslighet f\u00f6r kraftiga stimuli. Besv\u00e4ren p\u00e5verkar varaktigt MD:s psykiska och fysiska funktionsf\u00f6rm\u00e5ga. Under \u00e5ren 2011-2013 vikarierade MD i perioder som kansliassistent, pga. sina fysiska besv\u00e4r. Fr\u00e5n 2016 var MD helt eller delvis sjukskriven, och fr\u00e5n juni 2019 var hon helt sjukskriven till och med oktober 2023. Fr\u00e5n den 1 november 2023, till dess att anst\u00e4llningen avslutades var hon sjukskriven till 25 procent och fr\u00e5n den 2 november 2023 i \u00f6vrigt arbetsbefriad med l\u00f6n.<\/p>\n\n\n\n<p>Parterna i m\u00e5let var \u00f6verens om att MD saknade arbetsf\u00f6rm\u00e5ga i befattningen som kriminalv\u00e5rdare och att neds\u00e4ttningen av arbetsf\u00f6rm\u00e5gan i f\u00f6rh\u00e5llande till arbetet som kriminalv\u00e5rdare var stadigvarande. Parterna var vidare \u00f6verens om att MD hade en funktionsneds\u00e4ttning i diskrimineringslagens mening. Parterna var \u00e4ven \u00f6verens om att Kriminalv\u00e5rden fullgjort sin rehabiliteringsskyldighet.<\/p>\n\n\n\n<p>Den huvudsakliga tvistefr\u00e5gan var om det fanns sakliga sk\u00e4l f\u00f6r Kriminalv\u00e5rden att s\u00e4ga upp MD och om upps\u00e4gningen utgjorde otill\u00e5ten diskriminering genom bristande tillg\u00e4nglighet. Parterna hade olika uppfattningar i fr\u00e5gan om Kriminalv\u00e5rden uppfyllt sin omplaceringsskyldighet, och om Kriminalv\u00e5rden diskriminerat MD genom att inte vidta sk\u00e4liga anpassnings\u00e5tg\u00e4rder. Parterna tvistade \u00e4ven om omfattningen av MD:s arbetsf\u00f6rm\u00e5ga, och om hennes arbetsf\u00f6rm\u00e5ga var varaktigt nedsatt \u00e4ven i annat arbete \u00e4n arbete som kriminalv\u00e5rdare.<\/p>\n\n\n\n<p>F\u00f6rbundet som f\u00f6retr\u00e4dde MD yrkade 135&nbsp;000 kr i allm\u00e4nt skadest\u00e5nd f\u00f6r brott mot LAS till MD, diskrimineringsers\u00e4ttning med 120&nbsp;000 kr till MD, samt ekonomiskt skadest\u00e5nd till MD f\u00f6r brott mot LAS alternativt diskrimineringslagen.<\/p>\n\n\n\n<p>Arbetsdomstolen framh\u00f6ll att det inte var fr\u00e5ga om Kriminalv\u00e5rden vidtagit tillr\u00e4ckliga anpassnings- och tillg\u00e4nglighets\u00e5tg\u00e4rder f\u00f6r att m\u00f6jligg\u00f6ra f\u00f6r MD att beh\u00e5lla sin anst\u00e4llning i sin ordinarie befattning; ist\u00e4llet handlade tvistefr\u00e5gorna om vilka skyldigheter Kriminalv\u00e5rden haft f\u00f6r att bereda MD annat arbete hos sig och vilka anpassnings\u00e5tg\u00e4rder som skulle anses sk\u00e4liga i det sammanhanget.<\/p>\n\n\n\n<p>Arbetsdomstolen inledde pr\u00f6vningen med en bed\u00f6mning av MD:s arbetsf\u00f6rm\u00e5ga. Arbetsdomstolen fann d\u00e4rvid att MD:s arbetsf\u00f6rm\u00e5ga var begr\u00e4nsad till 50 procent, \u00e4ven i ett f\u00f6r hennes behov v\u00e4lanpassat arbete. Till grund f\u00f6r bed\u00f6mningen lade Arbetsdomstolen bl.a. tv\u00e5 arbetsf\u00f6rm\u00e5geutredningar som gjorts 2020 och 2023, d\u00e4r samma f\u00f6retagsl\u00e4kare varit delaktig.<\/p>\n\n\n\n<p>D\u00e4refter pr\u00f6vade Arbetsdomstolen om Kriminalv\u00e5rden hade uppfyllt sina skyldigheter att bereda MD annat arbete hos sig, och vilka anpassnings\u00e5tg\u00e4rder som skulle anses sk\u00e4liga i det sammanhanget.<\/p>\n\n\n\n<p>Staten hade bl.a. gjort g\u00e4llande att det, vid en omplacering, inte var sk\u00e4ligt att erbjuda en heltidsanst\u00e4llning till en arbetstagare som endast kan arbete 50 eller 75 procent. Enligt staten saknar en s\u00e5dan arbetstagare tillr\u00e4ckliga kvalifikationer f\u00f6r en heltidsanst\u00e4llning och enligt staten var det inte en sk\u00e4lig anpassning att erbjuda en heltidsanst\u00e4llning till en arbetstagare om det inneb\u00e4r att arbetsgivaren m\u00e5ste utvidga sin verksamhet genom att anst\u00e4lla ytterligare en person. Enligt staten fanns bara lediga administrativa heltidsanst\u00e4llningar.<\/p>\n\n\n\n<p>Enligt Arbetsdomstolen kan en arbetstagare, vars arbetsf\u00f6rm\u00e5ga \u00e4r begr\u00e4nsad till deltid pga. funktionsneds\u00e4ttning, inte automatiskt anses sakna kvalifikationer f\u00f6r en heltidsanst\u00e4llning enbart p\u00e5 den grunden att han eller hon inte kan arbeta deltid.<\/p>\n\n\n\n<p>Det var ostridigt att Kriminalv\u00e5rden vid tidpunkten f\u00f6r upps\u00e4gningen av MD inte hade n\u00e5gra lediga anst\u00e4llningar p\u00e5 deltid. Arbetsdomstolen uttalade att det inte kan anses uteslutet att det kan vara sk\u00e4ligt att kr\u00e4va av en arbetsgivare att en arbetstagare som endast kan arbeta deltid vid omplacering erbjuds en heltidsanst\u00e4llning, och att arbetet sedan anpassas i fr\u00e5ga om arbetstid. F\u00f6r att en s\u00e5dan anpassning ska kunna betraktas som en sk\u00e4lig \u00e5tg\u00e4rd f\u00e5r det dock normalt f\u00f6ruts\u00e4ttas att hindret f\u00f6r arbetsf\u00f6rm\u00e5gan kan antas vara \u00f6verg\u00e5ende, \u00e5tminstone p\u00e5 lite l\u00e4ngre sikt. Enligt Arbetsdomstolen m\u00e5ste en helhetsbed\u00f6mning av sk\u00e4ligheten d\u00e4rvid g\u00f6ras i det enskilda fallet.<\/p>\n\n\n\n<p>Arbetsdomstolen fann dels att MD, med h\u00e4nsyn till hennes arbetsf\u00f6rm\u00e5ga, inte kunde f\u00f6rv\u00e4ntas klara av arbetsuppgifterna i de anst\u00e4llningar som fanns lediga inom Kriminalv\u00e5rden i tiden d\u00e5 omplacering \u00f6verv\u00e4gdes, dels att det i MD:s fall inte hade varit en sk\u00e4lig anpassning att erbjuda henne en heltidsanst\u00e4llning, eftersom det skulle ha inneburit att Kriminalv\u00e5rden d\u00e5 hade beh\u00f6vt utvidga sin verksamhet genom att anst\u00e4lla ytterligare en person; verksamhetens behov hade d\u00e4rvid inte t\u00e4ckts av MD:s arbetsf\u00f6rm\u00e5ga p\u00e5 50 procent.<\/p>\n\n\n\n<p>Arbetsdomstolen fann allts\u00e5 att det, i det aktuella fallet, inte var sk\u00e4ligt att kr\u00e4va att Kriminalv\u00e5rden skulle erbjuda MD en heltidsanst\u00e4llning och d\u00e4refter anpassa den. Arbetsdomstolens slutsats innebar att det inte hade varit sk\u00e4ligt att kr\u00e4va att Kriminalv\u00e5rden beredde MD annat arbete hos sig. Utredningen hade d\u00e4rmed visat att MD varaktigt inte kunde utf\u00f6ra arbete av n\u00e5gon betydelse f\u00f6r Kriminalv\u00e5rden.<\/p>\n\n\n\n<p>St\u00e4llningstagandena innebar att Arbetsdomstolen ans\u00e5g att upps\u00e4gningen av MD hade grundat sig p\u00e5 sakliga sk\u00e4l. Arbetsdomstolens bed\u00f6mning innebar vidare att MD inte hade utsatts f\u00f6r diskriminering i form av bristande tillg\u00e4nglighet. F\u00f6rbundets talan avslogs d\u00e4rmed och staten tillerk\u00e4ndes r\u00e4tteg\u00e5ngskostnader med drygt 326&nbsp;000 kr.<\/p>\n\n\n\n<p>&gt; <a
