Dessutom fr\u00e5ga om bolaget br\u00f6t mot f\u00f6rhandlingsskyldigheten enligt 16 \u00a7 MBL genom att inte justera ett f\u00f6rhandlingsprotokoll.<\/p>\n\n<p><strong><a href=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/2026\/2026-05-22-ad-2026-nr-38\/\" type=\"link\" id=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/2026\/2026-05-22-ad-2026-nr-38\/\"><strong>AD 2026 n<\/strong>r 38<\/a><\/strong><\/p>\n\n\n\n<p>Bakgrunden till tvisten var f\u00f6ljande.<\/p>\n\n\n\n<p>TM Sweden AB (\u201dbolaget\u201d) \u00e4r ett dotterbolag till Tesla International BV, som bedriver Teslas svenska verksamhet i form av f\u00f6rs\u00e4ljning av bilar, service och reparationer. Bolaget \u00e4r inte bundet av kollektivavtal. Sedan oktober 2023 p\u00e5g\u00e5r en arbetsmarknadskonflikt mellan Industrifacket Metall (\u201df\u00f6rbundet\u201d) och bolaget. F\u00f6rbundet har medlemmar som arbetar i verkstaden vid en av bolagets anl\u00e4ggningar i Uppsala, och som omfattas av strids\u00e5tg\u00e4rderna.<\/p>\n\n\n\n<p>Den 20 februari 2024 gjorde f\u00f6rbundet en f\u00f6rhandlingsframst\u00e4llan enligt 10 \u00a7 MBL avseende den aktuella verkstaden. F\u00f6rhandlingsframst\u00e4llningen avs\u00e5g informationsskyldigheten enligt 19 a \u00a7 MBL. En f\u00f6rhandling mellan parterna h\u00f6lls sedan den 6 mars 2024. Parterna i m\u00e5let var bl.a. oense om huruvida den f\u00f6rhandlingen avs\u00e5g en intressetvist eller r\u00e4ttstvist.<\/p>\n\n\n\n<p>F\u00f6rbundet gjorde en ny f\u00f6rhandlingsframst\u00e4llning den 28 mars 2024 avseende brott mot informations- och f\u00f6rhandlingsskyldigheten i 15, 16 och 19 a \u00a7\u00a7 MBL. Tvistef\u00f6rhandling skulle ha h\u00e5llits den 17 april 2024, men ajournerades till den 19 april 2024. Samma dag avslutades f\u00f6rhandlingen i oenighet.<\/p>\n\n\n\n<p>Parterna i m\u00e5let tvistade om bolaget, fram till den 19 april 2024, br\u00f6t mot informationsskyldigheten samt om bolaget br\u00f6t mot f\u00f6rhandlingsskyldigheten genom att dels v\u00e4gra l\u00e4mna ut information om verksamheten vid f\u00f6rhandlingen den 6 mars 2024, dels v\u00e4gra justera f\u00f6rhandlingsprotokollet fr\u00e5n samma tillf\u00e4lle. Parterna tvistade \u00e4ven om f\u00f6rbundets talan avseende brott mot informationsskyldigheten i tiden f\u00f6re den 6 mars 2024 var preskriberad. F\u00f6rbundet yrkade allm\u00e4nt skadest\u00e5nd med 50&nbsp;000 kr f\u00f6r brott mot 19 a \u00a7 MBL, samt 50&nbsp;000 kr i allm\u00e4nt skadest\u00e5nd f\u00f6r brott mot 15 och 16 \u00a7\u00a7 MBL.<\/p>\n\n\n\n<p>Den f\u00f6rsta fr\u00e5gan som Arbetsdomstolen tog st\u00e4llning till var om f\u00f6rbundets talan avseende brott mot informationsskyldigheten i tiden f\u00f6re den 6 mars 2024 var preskriberad. Bolaget hade d\u00e4rvid gjort g\u00e4llande att f\u00f6rhandlingen den 6 mars 2024 var en tvistef\u00f6rhandling, och att f\u00f6rbundet inte v\u00e4ckt talan inom tre m\u00e5nader fr\u00e5n att den avslutades (senast den 6 juni 2024). F\u00f6rbundet inv\u00e4nde att f\u00f6rhandlingen den 6 mars 2024 inte avs\u00e5g en r\u00e4ttstvist, och att det d\u00e4rmed inte l\u00f6pte n\u00e5gon preskriptionsfrist med anledning av denna. Om f\u00f6rhandlingen skulle anses ha varit en tvistef\u00f6rhandling, gjorde f\u00f6rbundet g\u00e4llande att f\u00f6rhandlingen avslutades f\u00f6rst efter f\u00f6rhandlingstillf\u00e4llet den 19 april 2024.<\/p>\n\n\n\n<p>Efter att ha g\u00e5tt igenom bevisningen, omst\u00e4ndigheterna och underlag i m\u00e5let (d\u00e4ribland f\u00f6rhandlingsframst\u00e4llan, protokollsutkast och fr\u00e5gelista) kom Arbetsdomstolen fram till att f\u00f6rbundet, vid f\u00f6rhandlingen den 6 mars 2024, hade framst\u00e4llt ett r\u00e4ttsligt grundat anspr\u00e5k, vilket medf\u00f6rde att f\u00f6rhandlingen \u00e5tminstone delvis ans\u00e5gs ha avsett en r\u00e4ttstvist. Att f\u00f6rbundet inte framst\u00e4llde n\u00e5got skadest\u00e5ndskrav d\u00e5 \u00e4ndrade inte Arbetsdomstolens bed\u00f6mning. Arbetsdomstolen fann vidare att f\u00f6rhandlingen den 6 mars 2024, och f\u00f6rhandlingen den 19 april 2024, utgjorde tv\u00e5 separata tvistef\u00f6rhandlingar. Det innebar att f\u00f6rbundets talan om skadest\u00e5nd f\u00f6r brott mot informationsskyldigheten i tiden f\u00f6re den 6 mars 2024 ans\u00e5gs vara preskriberad, eftersom f\u00f6rbundet inte hade v\u00e4ckt talan inom tre m\u00e5nader (senast den 6 juni 2024). F\u00f6rbundets talan i denna del avslogs d\u00e4rf\u00f6r pga. preskription.<\/p>\n\n\n\n<p>Arbetsdomstolen pr\u00f6vade sedan om bolaget hade brutit mot informationsskyldigheten enligt 19 a \u00a7 MBL. Arbetsdomstolen h\u00e4nvisade d\u00e4rvid till sin tidigare praxis, av vilken bl.a. f\u00f6ljer att informationen inte m\u00e5ste l\u00e4mnas vid fast best\u00e4mda tidpunkter, utan s\u00e5 snart det kan ske; vidare \u00e4r arbetsgivaren inte skyldig att l\u00e4mna information till arbetstagarorganisationen f\u00f6r tidsperiod d\u00e5 det inte intr\u00e4ffat n\u00e5gon s\u00e4rskild h\u00e4ndelse i arbetsgivarens verksamhet och arbetsgivaren inte heller avsett att fatta n\u00e5got beslut som kan p\u00e5verka arbetstagarorganisationens medlemmar (se AD 2026 nr 25).<\/p>\n\n\n\n<p>Inledningsvis framh\u00f6ll Arbetsdomstolen att informationsskyldigheten enligt 19 a \u00a7 MBL generellt sett inte inneb\u00e4r att en arbetsgivare \u00e4r skyldig att svara p\u00e5 specifika fr\u00e5gor som en arbetstagarorganisation st\u00e4ller till arbetsgivaren. Att bolaget inte svarade p\u00e5 f\u00f6rbundets fr\u00e5gelista kunde d\u00e4rmed i sig inte inneb\u00e4ra att bolaget hade brutit mot informationsskyldigheten. Arbetsdomstolen framh\u00f6ll vidare att parterna i m\u00e5let var \u00f6verens om att bolaget l\u00e4mnat viss skriftlig information till f\u00f6rbundet den 11 april 2024; av denna framgick bl.a. att det inte planerades f\u00f6r n\u00e5gra f\u00f6r\u00e4ndringar i produktionsteknik eller verksamhetsf\u00f6r\u00e4ndringar samt att det saknades en lokal budget. Vidare framgick n\u00e5gra allm\u00e4nna riktlinjer f\u00f6r personalpolitiken.<\/p>\n\n\n\n<p>Arbetsdomstolen konstaterade sedermera att f\u00f6rbundet varken hade p\u00e5st\u00e5tt eller bevisat att det h\u00e4nde n\u00e5got s\u00e4rskilt i bolagets verksamhet under den aktuella perioden som f\u00f6rbundet borde ha informerats om. F\u00f6rbundet hade inte heller p\u00e5st\u00e5tt att bolaget under den perioden avs\u00e5g att fatta n\u00e5got beslut som kunde p\u00e5verka f\u00f6rbundets medlemmar. D\u00e4rmed ans\u00e5g Arbetsdomstolen att bolaget inte kunde anses ha underl\u00e5tit att fortl\u00f6pande h\u00e5lla f\u00f6rbundet underr\u00e4ttat om hur verksamheten utvecklades produktionsm\u00e4ssigt och ekonomiskt samt om riktlinjerna f\u00f6r personalpolitiken. F\u00f6rbundets talan avslogs d\u00e4rf\u00f6r \u00e4ven n\u00e4r det g\u00e4llde om bolaget hade brutit mot informationsskyldigheten enligt 19 a \u00a7 MBL.<\/p>\n\n\n\n<p>Arbetsdomstolen \u00f6vergick sedan till att pr\u00f6va om bolaget hade brutit mot f\u00f6rhandlingsskyldigheten enligt 15 eller 16 \u00a7\u00a7 MBL. Arbetsdomstolen ans\u00e5g d\u00e4rvid att bolaget inte hade brutit mot f\u00f6rhandlingsskyldigheten enligt 15 \u00a7 MBL genom att inte besvara f\u00f6rbundets fr\u00e5gelista. Det f\u00f6rh\u00e5llandet att bolaget inte besvarade fr\u00e5gelistan var enligt Arbetsdomstolen inte samma sak som att bolaget inte deltog i sakliga f\u00f6rhandlingar enligt 15 \u00a7 MBL.<\/p>\n\n\n\n<p>D\u00e4refter tog Arbetsdomstolen st\u00e4llning till om bolaget br\u00f6t mot f\u00f6rhandlingsskyldigheten genom att det inte justerat protokollet fr\u00e5n f\u00f6rhandlingen den 6 mas 2024. Det var i och f\u00f6r sig inte tvistigt att bolaget inte hade undertecknat protokollet, d\u00e4remot hade bolaget gjort g\u00e4llande dels att det inte var skyldigt att justera protokollet utan att dess protokollsanm\u00e4rkningar tagits in i protokollet, dels att det justerade protokollet per mejl. Arbetsdomstolen ans\u00e5g att bolaget hade medverkat till arbetet med protokollet genom att p\u00e5tala f\u00f6r f\u00f6rbundet att det \u00f6nskade g\u00f6ra vissa \u00e4ndringar i det, och genom f\u00f6rh\u00f6r i m\u00e5let stod det enligt Arbetsdomstolen klart att f\u00f6rbundet uppfattade att bolaget ville g\u00f6ra protokollsanm\u00e4rkningar. Mot bakgrund av att f\u00f6rbundet hade gett bolaget besked om att det inte t\u00e4nkte f\u00f6ra in n\u00e5gra \u00e4ndringar i protokollet ans\u00e5g Arbetsdomstolen att b\u00e5da parter hade bidragit till att n\u00e5got slutjusterat protokoll aldrig kom till st\u00e5nd. Vid dessa f\u00f6rh\u00e5llanden kunde bolaget inte anses ha brutit mot f\u00f6rhandlingsskyldigheten genom att inte justera protokollet. \u00c4ven i den delen avslogs f\u00f6rbundets talan.<\/p>\n\n\n\n<p>Eftersom f\u00f6rbundet f\u00f6rlorade m\u00e5let \u00e5lades f\u00f6rbundet att ers\u00e4tta bolagets r\u00e4tteg\u00e5ngskostnader i den utstr\u00e4ckning den varit sk\u00e4lig f\u00f6r att tillvarata bolagets r\u00e4tt. Bolaget hade yrkat ers\u00e4ttning f\u00f6r ombudsarvode med 749&nbsp;878 kr och 27&nbsp;500 kr f\u00f6r utl\u00e4gg f\u00f6r ett r\u00e4ttsutl\u00e5tande. G\u00e4llande ombudsarvode ans\u00e5g Arbetsdomstolen att 500&nbsp;000 kr var sk\u00e4lig ers\u00e4ttning.
