{"id":86825,"date":"2026-03-27T16:55:20","date_gmt":"2026-03-27T15:55:20","guid":{"rendered":"https:\/\/www.almega.se\/?p=86825"},"modified":"2026-03-27T17:04:54","modified_gmt":"2026-03-27T16:04:54","slug":"behandling-av-belastningsregisterutdrag-i-strid-med-gdpr-tvist-i-arbetsdomstolen","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2026\/03\/behandling-av-belastningsregisterutdrag-i-strid-med-gdpr-tvist-i-arbetsdomstolen\/","title":{"rendered":"Behandling av belastningsregisterutdrag i strid med GDPR, tvist i Arbetsdomstolen"},"content":{"rendered":"<p class=\"intro\">Fr\u00e5ga om en arbetsgivare, som inte var bunden av n\u00e5got kollektivavtal, brutit mot 19 a \u00a7 MBL och d\u00e4rmed var skadest\u00e5ndsskyldigt i f\u00f6rh\u00e5llande till en arbetstagarorganisation.<\/p>\n\n<p><strong><strong><a href=\"https:\/\/www.almega.se\/app\/uploads\/2026\/03\/ad-2026-nr-27.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">AD 2026 nr 27<\/a><\/strong><\/strong><\/p>\n\n\n\n<p>Efter det att en arbetstagare (\u201dJW\u201d) p\u00e5b\u00f6rjat sin anst\u00e4llning hos ett bolag beg\u00e4rde bolaget att han skulle l\u00e4mna ett utdrag fr\u00e5n belastningsregistret. P\u00e5 arbetsgivarens beg\u00e4ran \u00f6verl\u00e4mnade JW ett belastningsregisterutdrag i ett f\u00f6rslutet kuvert till arbetsgivaren, som denne tog emot och l\u00e4ste. Av utdraget framgick att JW d\u00f6mts f\u00f6r brott.<\/p>\n\n\n\n<p>Fr\u00e5ga i m\u00e5let om arbetsgivarens agerande omfattats av, och varit i strid med, dataskyddsf\u00f6rordningen (\u201dGDPR\u201d).<\/p>\n\n\n\n<p>F\u00f6rbundet som f\u00f6retr\u00e4dde JW yrkade skadest\u00e5nd om 60\u00a0000 kr till JW.<\/p>\n\n\n\n<p>Arbetsdomstolen redogjorde bl.a. f\u00f6r f\u00f6ljande r\u00e4ttsliga utg\u00e5ngspunkter i m\u00e5let.<\/p>\n\n\n\n<p>Av artikel 2.1 i GDPR framg\u00e5r att GDPR ska till\u00e4mpas p\u00e5 s\u00e5dan behandling av personuppgifter, som helt eller delvis f\u00f6retas p\u00e5 automatisk v\u00e4g, samt p\u00e5 annan behandling \u00e4n automatisk av personuppgifter som ing\u00e5r i eller kommer att ing\u00e5 i ett register.<\/p>\n\n\n\n<p>Enligt GDPR definieras \u201dpersonuppgifter\u201d som varje upplysning som avser en identifierad eller identifierbar fysisk person.<\/p>\n\n\n\n<p>Med \u201dbehandling\u201d avses enligt GDPR en \u00e5tg\u00e4rd eller en kombination av \u00e5tg\u00e4rder betr\u00e4ffande personuppgifter eller upps\u00e4ttningar av personuppgifter, oberoende av om de utf\u00f6rs automatiserat eller ej, s\u00e5som insamling, registrering, organisering, strukturering, lagring, bearbetning eller \u00e4ndring, framtagning, l\u00e4sning, anv\u00e4ndning, utl\u00e4mning genom \u00f6verf\u00f6ring, spridning eller tillhandah\u00e5llande p\u00e5 annat s\u00e4tt, justering eller sammanf\u00f6rande, begr\u00e4nsning, radering eller f\u00f6rst\u00f6ring.<\/p>\n\n\n\n<p>I det aktuella m\u00e5let gjorde Arbetsdomstolen sedan f\u00f6ljande bed\u00f6mning.<\/p>\n\n\n\n<p>Det som f\u00f6rbundet hade lagt bolaget till last var att JW:s chef tog emot ett utdrag fr\u00e5n belastningsregistret fr\u00e5n honom som l\u00e5g i ett f\u00f6rslutet kuvert och l\u00e4ste registerutdraget. Arbetsdomstolen anf\u00f6rde att det s\u00e5ledes hade varit fr\u00e5ga om en s\u00e5dan manuell (icke-automatisk) behandling av personuppgifter som endast omfattas av GDPR:s till\u00e4mpningsomr\u00e5de, om uppgifterna ing\u00e5r i eller kommer att ing\u00e5 i ett register. Eftersom f\u00f6rbundet inte ens hade gjort g\u00e4llande att bolaget hade f\u00f6r avsikt att l\u00e5ta personuppgifterna i belastningsregistret ing\u00e5 i ett register, fann Arbetsdomstolen att bolagets hantering av belastningsregisterutdraget \u2013 och de personuppgifter som detta inneh\u00f6ll \u2013 d\u00e4rmed inte utgjort en s\u00e5dan icke-automatiserad behandling i register som avses i artikel 2.1 i GDPR.<\/p>\n\n\n\n<p>Detta g\u00e4llde trots att personuppgifterna ursprungligen hade h\u00e4mtats fr\u00e5n ett register, vilket Polismyndigheten var personuppgiftsansvarig f\u00f6r. Det ans\u00e5gs inte heller vara fr\u00e5ga om en s\u00e5dan delvis automatiserad behandling av personuppgifter som bolaget var personuppgiftsansvarigt f\u00f6r. Arbetsdomstolen framh\u00f6ll att \u00e4ndam\u00e5len och medlen f\u00f6r behandlingen av personuppgifterna i belastningsregistret och utl\u00e4mnandet av dem d\u00e4rifr\u00e5n hade fastst\u00e4llts i f\u00f6rfattning och inte av bolaget. Vidare framh\u00f6ll Arbetsdomstolen att det inte hade gjorts g\u00e4llande att bolaget behandlat personuppgifterna f\u00f6r Polismyndighetens r\u00e4kning och d\u00e4rmed varit personuppgiftsbitr\u00e4de.<\/p>\n\n\n\n<p>Att uppgifterna, som l\u00e5g i kuvertet som JW l\u00e4mnade \u00f6ver till bolaget, var inh\u00e4mtade av honom fr\u00e5n belastningsregistret f\u00f6r\u00e4ndrade inte Arbetsdomstolens bed\u00f6mning, eftersom det inte hade betydelse f\u00f6r bolagets hantering.<\/p>\n\n\n\n<p>Arbetsdomstolens slutsats var d\u00e4rmed att bolagets hantering av personuppgifterna i belastningsregisterutdraget inte omfattades av GDPR:s till\u00e4mpningsomr\u00e5de; bolaget hade s\u00e5ledes inte heller behandlat personuppgifter i strid med GDPR.<\/p>\n\n\n\n<p>F\u00f6r det fall att Arbetsdomstolen skulle \u00f6verv\u00e4ga att avsl\u00e5 f\u00f6rbundets talan med h\u00e4nvisning till att arbetsgivarens agerande i m\u00e5let inte utg\u00f6r en behandling av personuppgifter i GDPR:s mening hade f\u00f6rbundet yrkat att Arbetsdomstolen skulle inh\u00e4mta ett f\u00f6rhandsavg\u00f6rande fr\u00e5n EU-domstolen g\u00e4llande denna fr\u00e5ga.<\/p>\n\n\n\n<p>Enligt Arbetsdomstolen var det uppenbart att bolagets hantering av personuppgifterna var en behandling enligt GDPR:s definition, eftersom redan l\u00e4sning \u00e4r en behandling. Arbetsdomstolen avslog dock inte f\u00f6rbundets talan med h\u00e4nvisning till att arbetsgivarens agerande inte utgjorde en behandling av personuppgifter i GDPR:s mening; enligt Arbetsdomstolen var f\u00f6rbundets yrkande om f\u00f6rhandsavg\u00f6rande d\u00e4rmed inte aktuellt \u2013 utan skulle avsl\u00e5s. Enligt Arbetsdomstolens mening fanns det inte heller n\u00e5gon s\u00e5dan EU-r\u00e4ttslig oklarhet som innebar att ett f\u00f6rhandsavg\u00f6rande av EU-domstolen var n\u00f6dv\u00e4ndigt f\u00f6r att d\u00f6ma i saken.<\/p>\n\n\n\n<p>Som f\u00f6rlorande part \u00e5lades f\u00f6rbundet att betala arbetsgivarparternas r\u00e4tteg\u00e5ngskostnader med 200\u00a0000 kr.<\/p>\n\n\n\n<p>En av Arbetsdomstolens ledam\u00f6ter var skiljaktig i fr\u00e5gan om inh\u00e4mtande av f\u00f6rhandsavg\u00f6rande fr\u00e5n EU-domstolen.
