Bakgrunden till tvisten var f\u00f6ljande.<\/p>\n\n\n\n<p>Enligt 19 a \u00a7 MBL ska en arbetsgivare, som inte \u00e4r bunden av n\u00e5got kollektivavtal, fortl\u00f6pande h\u00e5lla arbetstagarorganisationer som har medlemmar som \u00e4r arbetstagare hos arbetsgivaren underr\u00e4ttade om hur verksamheten utvecklas produktionsm\u00e4ssigt och ekonomiskt liksom om riktlinjerna f\u00f6r personalpolitiken. Under sju m\u00e5nader l\u00e4mnade bolaget inte n\u00e5gon information till f\u00f6rbundet; det var ostridigt att bolaget inte l\u00e4mnade n\u00e5gon information enligt 19 a \u00a7 MBL till f\u00f6rbundet under tiden 18 mars-18 oktober 2024 och att n\u00e5gon \u00f6verenskommelse om hur ofta bolaget skulle l\u00e4mna information om verksamheten inte hade tr\u00e4ffats. Parterna tvistade d\u00e4rvid om bolaget brutit mot 19 a \u00a7 MBL.<\/p>\n\n\n\n<p>Parterna gjorde bl.a. g\u00e4llande f\u00f6ljande.<\/p>\n\n\n\n<p>Bolaget: Bolaget informerade fortl\u00f6pande f\u00f6rbundet om verksamheten i s\u00e5dan omfattning och med s\u00e5dan regelbundenhet som kr\u00e4vs enligt 19 a \u00a7 MBL Under tiden 18 mars\u201318 oktober 2024 skedde inte n\u00e5gra v\u00e4sentliga h\u00e4ndelser vid servicecentret i Malm\u00f6 som p\u00e5verkade f\u00f6rh\u00e5llandet mellan bolaget och nuvarande eller f\u00f6rutvarande arbetstagare som \u00e4r medlem i f\u00f6rbundet. Det fanns d\u00e4rf\u00f6r under perioden inte n\u00e5got nytt att informera f\u00f6rbundet om i f\u00f6rh\u00e5llande till den information som bolaget l\u00e4mnade den 18 mars 2024. Bolaget br\u00f6t d\u00e4rmed inte mot 19 a \u00a7 MBL.<\/p>\n\n\n\n<p>F\u00f6rbundet: Bolaget l\u00e4mnade inte fortl\u00f6pande information till f\u00f6rbundet. \u00c4ven om n\u00e5gon s\u00e4rskild h\u00e4ndelse inte intr\u00e4ffade under den aktuella tiden hade bolaget skyldighet att l\u00e4mna information om hur verksamheten utvecklades. Genom att inte l\u00e4mna n\u00e5gon information alls under tiden 18 mars\u201318 oktober 2024 br\u00f6t bolaget mot 19 a \u00a7 MBL.<\/p>\n\n\n\n<p>Arbetsdomstolen gjorde bl.a. f\u00f6ljande uttalanden och bed\u00f6mning.<\/p>\n\n\n\n<p>B\u00e5de best\u00e4mmelsens f\u00f6rarbeten och f\u00f6rarbetena till 19 \u00a7 samma lag anger att information ska l\u00e4mnas fortl\u00f6pande och att det inneb\u00e4r att informationen ska l\u00e4mnas s\u00e5 snart det kan ske. N\u00e5got tidsintervall f\u00f6r informationsgivningen anges inte. Att information ska l\u00e4mnas s\u00e5 snart det kan ske f\u00e5r, enligt Arbetsdomstolens mening, anses betyda att information inte ska l\u00e4mnas vid fast best\u00e4mda tidpunkter, utan just s\u00e5 snart det kan ske. Detta m\u00f6jligg\u00f6r f\u00f6r en arbetstagarorganisation att p\u00e5kalla f\u00f6rhandling enligt 10 \u00a7 MBL i s\u00e5dan tid att arbetsgivaren ges m\u00f6jlighet att f\u00e5 ta del av arbetstagarorganisationens synpunkter innan beslut fattas.<\/p>\n\n\n\n<p>Med h\u00e4nvisning till att det i m\u00e5let inte visats att n\u00e5gon s\u00e4rskild h\u00e4ndelse hade intr\u00e4ffat i bolagets verksamhet i Malm\u00f6 under perioden, och att det inte heller p\u00e5st\u00e5tts att bolaget avs\u00e5g att fatta n\u00e5got beslut som kunde p\u00e5verka f\u00f6rbundets medlemmar under perioden, fann Arbetsdomstolen att det inte funnits skyldighet f\u00f6r bolaget att l\u00e4mna n\u00e5gon information till f\u00f6rbundet under den aktuella tidsperioden. Arbetsdomstolen avslog d\u00e4rf\u00f6r f\u00f6rbundets talan och \u00e5lade f\u00f6rbundet att ers\u00e4tta bolagets r\u00e4tteg\u00e5ngskostnader med drygt 300&nbsp;000 kr.<\/p>\n\n\n\n<p>Tv\u00e5 av Arbetsdomstolens ledam\u00f6ter var skiljaktiga, och ans\u00e5g att bolaget inte hade l\u00e4mnat information till f\u00f6rbundet fortl\u00f6pande i enlighet med 19 a \u00a7 MBL.<\/p>\n\n\n\n<p><a href=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/\" target=\"_blank\" rel=\"noreferrer noopener\">L\u00e4s fler domar p\u00e5 Arbetsdomstolens hemsida<\/a>.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>AD 2026 nr 25 Parter i m\u00e5let var IF Metall (\u201df\u00f6rbundet\u201d) och TM Sweden AB (\u201dbolaget\u201d), som bedriver verksamhet med Tesla-bilar p\u00e5 flera orter i landet bl.a. i Malm\u00f6.
