{"id":86570,"date":"2026-03-20T09:58:21","date_gmt":"2026-03-20T08:58:21","guid":{"rendered":"https:\/\/www.almega.se\/?p=86570"},"modified":"2026-03-20T10:01:34","modified_gmt":"2026-03-20T09:01:34","slug":"otillatna-slagningar-och-privatekonomi-rackte-inte-for-avskedande-ad-ogiltigforklarar-beslutet-2","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2026\/03\/otillatna-slagningar-och-privatekonomi-rackte-inte-for-avskedande-ad-ogiltigforklarar-beslutet-2\/","title":{"rendered":"Tillf\u00f6rlitlighet i drogtester pr\u00f6vad \u2013 Arbetsdomstolen ger arbetsgivaren r\u00e4tt"},"content":{"rendered":"<p class=\"intro\">Fr\u00e5ga om det funnits laga sk\u00e4l f\u00f6r avskedande av en lagermedarbetare (\u201dRW\u201d) som k\u00f6rde truck f\u00f6re och efter att han p\u00e5 arbetsplatsen l\u00e4mnat ett slumpm\u00e4ssigt drogtest i saliv som sedan visade positivt f\u00f6r amfetamin.<\/p>\n\n<p><strong><a href=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/2026\/2026-03-18-ad-2026-nr-21\/\">AD 2026 nr 21<\/a><\/strong><\/p>\n\n\n\n<p>Parter i m\u00e5let var \u00e5 ena sidan Unionen, och \u00e5 andra sidan F\u00f6reningen Svensk Handel samt ett av f\u00f6reningens medlemsf\u00f6retag (\u201dBolaget\u201d), d\u00e4r RW var anst\u00e4lld.<\/p>\n\n\n\n<p>Bolaget avskedade allts\u00e5 lagermedarbetaren RW f\u00f6r att han, i Bolagets lagerverksamhet, k\u00f6rt truck med narkotika (en l\u00e5g koncentration av amfetamin) i kroppen, vilket ett drogtest visat.<\/p>\n\n\n\n<p>Efter att det positiva drogtestet analyserats och granskats hade den granskande l\u00e4karen kontaktat RW, uppgett att RW:s drogtest hade visat positivt f\u00f6r amfetamin, samt fr\u00e5gat RW om han tog n\u00e5gra receptbelagda mediciner eller om det fanns n\u00e5gon annan f\u00f6rklaring \u00e4n intag av amfetamin till att provsvaret var positivt. RW hade d\u00e5 uppgett att han inte visste varf\u00f6r provsvaret var positivt, att han inte hade tagit n\u00e5gra droger och att han inte tog n\u00e5gra mediciner f\u00f6rutom n\u00e4sspray, men att de kosttillskott han tog, t.ex. kreatin, kanske kunde vara orsak till det positiva provsvaret.<\/p>\n\n\n\n<p>Unionen gjorde g\u00e4llande att RW inte hade amfetamin i kroppen i arbetet. Unionen h\u00e4vdade bl.a. att resultatet av drogtestningen var felaktigt. Unionen anf\u00f6rde n\u00e4mligen ett stort antal anledningar till att drogtestningen inte var tillf\u00f6rlitlig; d\u00e4ribland att testmetoden inte var tillr\u00e4ckligt bepr\u00f6vad, att provtagningsf\u00f6retaget inte var ackrediterat och anv\u00e4nde en underleverant\u00f6r f\u00f6r provtagningen, att riktlinjerna om sp\u00e5rbarhet (chain of custody) inte f\u00f6ljdes, att en undersk\u00f6terska inte anv\u00e4ndes som provtagare, med flera. Enligt Unionen kunde provresultatet d\u00e4rf\u00f6r inte ensamt bevisa att RW hade amfetamin i saliven eller i kroppen i \u00f6vrigt. Enligt Unionen kr\u00e4vdes ytterligare bevisning, t ex ett positivt blodprov.<\/p>\n\n\n\n<p>Unionen gjorde vidare g\u00e4llande att RW i vart fall inte var p\u00e5verkad av amfetamin i arbetet. Om Arbetsdomstolen skulle anse att det positiva drogtestet var tillf\u00f6rlitligt och bevisade att RW hade amfetamin i kroppen gjorde Unionen g\u00e4llande att Bolaget \u00e4nd\u00e5 inte hade tillr\u00e4ckliga sk\u00e4l f\u00f6r avskedande, eftersom den p\u00e5visade koncentrationen av amfetamin var s\u00e5 pass l\u00e5g att den inte p\u00e5verkade RW i n\u00e5got avseende.<\/p>\n\n\n\n<p>Arbetsdomstolen b\u00f6rjade med att ta st\u00e4llning till den huvudsakliga fr\u00e5gan, om det fanns tillr\u00e4ckliga sk\u00e4l f\u00f6r avskedandet. Domstolen konstaterade inledningsvis att det var utrett att det i dagsl\u00e4get inte finns n\u00e5got test som, p\u00e5 ett tillf\u00f6rlitligt s\u00e4tt, kan visa att, eller hur mycket, n\u00e5gon \u00e4r p\u00e5verkad av en viss koncentration av narkotika i kroppen. Vidare anf\u00f6rde Arbetsdomstolen att det, enligt narkotikastrafflagen, \u00e4r straffbart redan att olovligen bruka narkotika samt att det \u00e4ven \u00e4r straffbart att f\u00f6ra ett motordrivet fordon \u2013 t ex en truck p\u00e5 ett lager \u2013 efter att ha intagit narkotika i s\u00e5 stor m\u00e4ngd att det under eller efter f\u00e4rden finns n\u00e5got narkotiskt \u00e4mne kvar i blodet; det st\u00e4lls inte upp n\u00e5gra gr\u00e4nsv\u00e4rden vid s.k. drograttfylleri eller f\u00f6r straffbart brukande av narkotika, angav Arbetsdomstolen.<\/p>\n\n\n\n<p>Arbetsdomstolen uttalade vidare att det normalt finns sk\u00e4l f\u00f6r avskedande n\u00e4r en arbetstagare, som har arbetsuppgifter som \u00e4r p\u00e5tagligt farliga eller olagliga att utf\u00f6ra under p\u00e5verkan av narkotika, har narkotika i kroppen p\u00e5 arbetet. Eftersom det i dagsl\u00e4get inte finns n\u00e5got test, som p\u00e5 ett tillf\u00f6rlitligt s\u00e4tt kan visa att, eller hur mycket, n\u00e5gon \u00e4r p\u00e5verkad av narkotikan i kroppen ans\u00e5g Arbetsdomstolen att det enligt anst\u00e4llningsavtalet f\u00e5r anses \u00e5ligga en arbetstagare med s\u00e5dana arbetsuppgifter att avst\u00e5 fr\u00e5n att bruka narkotika p\u00e5 ett s\u00e5dant s\u00e4tt att det finns n\u00e5got narkotiskt \u00e4mne kvar i kroppen n\u00e4r han eller hon arbetar, eller skulle b\u00f6rjat arbeta, med s\u00e5dana arbetsuppgifter. Detta tar sikte p\u00e5 fall d\u00e4r det inte finns grundad anledning att anta att narkotikaf\u00f6rekomsten beror p\u00e5 konsumtion av f\u00f6rskrivna l\u00e4kemedel eller p\u00e5 att arbetstagaren inte medvetet (med upps\u00e5t) intagit narkotikan.<\/p>\n\n\n\n<p>Arbetsdomstolen tog sedan st\u00e4llning till om det positiva provresultatet g\u00e4llande RW var tillf\u00f6rlitligt. Arbetsdomstolen framh\u00f6ll att Unionen hade f\u00f6rt fram en rad inv\u00e4ndningar mot drogtestets tillf\u00f6rlitlighet; Arbetsdomstolen betonade d\u00e4rvid att det som var av betydelse i m\u00e5let var emellertid om <em>det positiva provresultatet <\/em>var tillf\u00f6rlitligt. Arbetsdomstolen ans\u00e5g d\u00e4rvid att en stor del av Unionens inv\u00e4ndningar inte i sig p\u00e5verkade provresultatets tillf\u00f6rlitlighet; enligt Arbetsdomstolens mening hade resultatet blivit detsamma \u00e4ven om det var som Unionen inv\u00e4nt.<\/p>\n\n\n\n<p>Sammantaget ans\u00e5g Arbetsdomstolen att det var utrett att den anv\u00e4nda testmetoden var tillr\u00e4ckligt bepr\u00f6vad f\u00f6r att ensam kunna tillf\u00f6rlitligt visa intag av amfetamin. Vidare var Arbetsdomstolens slutsats att det var st\u00e4llt utom rimligt tvivel att RW under arbetstid hade den uppm\u00e4tta koncentrationen amfetamin i saliven.<\/p>\n\n\n\n<p>Arbetsdomstolen ans\u00e5g vidare att det var st\u00e4llt utom rimligt tvivel att RW medvetet, med upps\u00e5t, hade intagit amfetaminet som fanns i hans saliv. Arbetsdomstolen ans\u00e5g d\u00e4rvid att ett tillf\u00f6rlitligt provresultat som visade narkotika i kroppen var ett mycket starkt bevis till upps\u00e5tligt intag, och RW ans\u00e5gs inte ha l\u00e4mnat n\u00e5gon rimlig eller godtagbar f\u00f6rklaring; den granskande l\u00e4karen hade bl.a. bed\u00f6mt att n\u00e4sspray eller kosttillskotten inte kunde ge utslag f\u00f6r amfetamin.<\/p>\n\n\n\n<p>Eftersom den truckk\u00f6rning som RW utf\u00f6rde med amfetamin i kroppen var s\u00e5v\u00e4l p\u00e5tagligt farlig som olaglig, ans\u00e5g Arbetsdomstolen att det fanns laga sk\u00e4l f\u00f6r avskedandet av honom. Enligt Arbetsdomstolen g\u00e4llde detta trots att koncentrationen av amfetamin i saliven var l\u00e5g, eftersom det i dagsl\u00e4get inte finns n\u00e5gon testmetod som kan m\u00e4ta graden av p\u00e5verkan av amfetamin.<\/p>\n\n\n\n<p>Unionen \u00e5lades att ers\u00e4tta arbetsgivarsidans r\u00e4tteg\u00e5ngskostnader med totalt drygt 876&nbsp;000 kr.<\/p>\n\n\n\n<p>Tv\u00e5 av Arbetsdomstolens ledam\u00f6ter var skiljaktiga och ans\u00e5g att det inte fanns laga sk\u00e4l f\u00f6r avskedande; de ans\u00e5g bl.a. att det prov som arbetsgivaren lagt till grund f\u00f6r avskedandet inte kunde anses tillf\u00f6rlitligt, och sammantaget var deras bed\u00f6mning att det inte kunde anses st\u00e4llt utom rimligt tvivel att RW brukat narkotika och som en f\u00f6ljd av detta varit p\u00e5verkad p\u00e5 arbetsplatsen.<\/p>\n\n\n\n<p><a href=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/\" target=\"_blank\" rel=\"noreferrer noopener\">L\u00e4s fler domar p\u00e5 Arbetsdomstolens hemsida<\/a>.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>AD 2026 nr 21 Parter i m\u00e5let var \u00e5 ena sidan Unionen, och \u00e5 andra sidan F\u00f6reningen Svensk Handel samt ett av f\u00f6reningens medlemsf\u00f6retag (\u201dBolaget\u201d), d\u00e4r RW var anst\u00e4lld.
