{"id":86276,"date":"2026-03-13T16:09:55","date_gmt":"2026-03-13T15:09:55","guid":{"rendered":"https:\/\/www.almega.se\/?p=86276"},"modified":"2026-03-13T16:10:06","modified_gmt":"2026-03-13T15:10:06","slug":"otillatna-slagningar-och-privatekonomi-rackte-inte-for-avskedande-ad-ogiltigforklarar-beslutet","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2026\/03\/otillatna-slagningar-och-privatekonomi-rackte-inte-for-avskedande-ad-ogiltigforklarar-beslutet\/","title":{"rendered":"Otill\u00e5tna slagningar och privatekonomi r\u00e4ckte inte f\u00f6r avskedande \u2013 AD ogiltigf\u00f6rklarar beslutet"},"content":{"rendered":"<p class=\"intro\">Fr\u00e5ga om en anst\u00e4lld hos ett f\u00f6rs\u00e4kringsbolag har gjort otill\u00e5tna slagningar i bolagets kundhanteringssystem och om bolaget hade laglig grund att avskeda den anst\u00e4llda p\u00e5 grund av dem, alternativt sakliga sk\u00e4l f\u00f6r upps\u00e4gning. \u00c4ven fr\u00e5ga om den anst\u00e4lldas privatekonomiska situation utgjort sakliga sk\u00e4l f\u00f6r upps\u00e4gning.<\/p>\n\n<p><strong><a href=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/2026\/2025-03-11-ad-2026-nr-19\/\">AD 2026 nr 19<\/a><\/strong><\/p>\n\n\n\n<p>Bakgrunden till tvisten var f\u00f6ljande.<\/p>\n\n\n\n<p>Arbetstagaren KM arbetade som utredare hos ett f\u00f6rs\u00e4kringsbolag (\u201dbolaget\u201d). Som utredare arbetade KM med att utreda bedr\u00e4gerier och oegentligheter mot och inom bolaget. Under h\u00f6sten 2024 fick bolaget k\u00e4nnedom om att KM hade utm\u00e4tningsskulder hos Kronofogdemyndigheten. Av den anledningen vidtog bolaget en utredning varvid det uppt\u00e4cktes att KM, i januari 2024, hade gjort slagningar p\u00e5 sin f\u00f6re detta partner och dennes nya partner i bolagets kundhanteringssystem. Bolaget avskedade sedan KM i december 2024. Bolaget gjorde d\u00e4rvid g\u00e4llande att KM olovligen berett sig tillg\u00e5ng till uppgifter i bolagets kundsystem och att agerandet utgjort brott mot ett uttryckligt sekretess\u00e5tagande i anst\u00e4llningsavtalet samt brott mot anst\u00e4llningsavtalets lojalitetsplikt. Bolaget gjorde vidare g\u00e4llande att agerandet \u00e4ven inneburit att KM har gjort sig skyldig till dataintr\u00e5ng i brottsbalkens mening.<\/p>\n\n\n\n<p>I m\u00e5let tvistade parterna om huruvida KM:s slagningar varit otill\u00e5tna eller urs\u00e4ktliga och om bolaget haft laga grund f\u00f6r avskedandet eller i vart fall sakliga sk\u00e4l f\u00f6r upps\u00e4gning av KM. Som sakliga sk\u00e4l f\u00f6r upps\u00e4gning \u00e5beropade bolaget, ut\u00f6ver de otill\u00e5tna slagningarna, \u00e4ven omst\u00e4ndigheter h\u00e4nf\u00f6rliga till KM:s privatekonomi. Bolaget gjorde d\u00e4rvid g\u00e4llande att KM:s privatekonomiska situation och utm\u00e4tningsskulder, i kombination med att hon underl\u00e5tit att informera bolaget om skulderna och inte haft f\u00f6rm\u00e5ga att klarl\u00e4gga dem, hade p\u00e5verkat bolagets f\u00f6rtroende f\u00f6r henne.<\/p>\n\n\n\n<p>Arbetsdomstolen fann att slagningarna i och f\u00f6r sig var otill\u00e5tna. Arbetsdomstolen ans\u00e5g \u00e4ven att KM:s agerande utgjorde ett dataintr\u00e5ng enligt 4 kap. 9 c \u00a7 brottsbalken, och enligt domstolen gav den omst\u00e4ndigheten anledning att se s\u00e4rskilt allvarligt p\u00e5 hennes agerande. Vidare ans\u00e5g domstolen att omst\u00e4ndigheten att KM som utredare haft i uppdrag bl.a. att identifiera och utreda brott mot lagar och regelverk var f\u00f6rsv\u00e5rande f\u00f6r KM vid bed\u00f6mningen av avtalsbrottets allvar. Arbetsdomstolen fann vidare att KM hade gjort slagningarna trots att hon ins\u00e5g att de inte var till\u00e5tna. Arbetsdomstolen ans\u00e5g att det skulle riktas allvarlig kritik mot KM f\u00f6r hennes agerande.<\/p>\n\n\n\n<p>Med h\u00e4nsyn till bl.a. syftet med agerandet, och att det var en eng\u00e5ngsf\u00f6reteelse, fann Arbetsdomstolen dock att det inte fanns tillr\u00e4ckliga sk\u00e4l f\u00f6r avskedande. Arbetsdomstolen framh\u00f6ll och beaktade d\u00e4rvid bl.a. f\u00f6ljande: Annat har inte kommit fram av utredningen \u00e4n att syftet med KM:s otill\u00e5tna slagningar var att s\u00f6ka kontaktuppgifter till sin f\u00f6re detta partner, s\u00e5 att deras gemensamma son skulle kunna komma i kontakt med sin pappa. B\u00e5de KM sj\u00e4lv och pappan hade ber\u00e4ttat att sonen var orolig f\u00f6r sin pappa och att sonen blev l\u00e4ttad n\u00e4r de slutligen kom i kontakt med varandra. KM gjorde inte slagningarna av nyfikenhet. Det hade inte heller gjorts g\u00e4llande att KM gjorde slagningarna f\u00f6r att p\u00e5verka handl\u00e4ggningen i n\u00e5got \u00e4rende eller p\u00e5 annat s\u00e4tt p\u00e5verka bolagets verksamhet. Det var s\u00e5vitt framkommit av utredningen fr\u00e5ga om en eng\u00e5ngsh\u00e4ndelse som d\u00e4refter inte upprepats, och som \u00e4gde rum relativt l\u00e5ng tid innan avskedandet. Vid dessa f\u00f6rh\u00e5llanden ans\u00e5g Arbetsdomstolen att KM:s agerande var klanderv\u00e4rt, men ett skiljande fr\u00e5n anst\u00e4llningen till f\u00f6ljd av denna enstaka h\u00e4ndelse framstod enligt Arbetsdomstolen som alltf\u00f6r ingripande. Arbetsdomstolens slutsats innebar d\u00e4rf\u00f6r att de otill\u00e5tna slagningarna, sedda f\u00f6r sig, inte heller hade utgjort sakliga sk\u00e4l f\u00f6r upps\u00e4gning av KM.<\/p>\n\n\n\n<p>Vidare fann Arbetsdomstolen att KM:s privatekonomiska situation inte heller utgjort sakliga sk\u00e4l f\u00f6r bolaget att s\u00e4ga upp hennes anst\u00e4llning; varken sett f\u00f6r sig eller i kombination med det som framkommit om de otill\u00e5tna slagningarna. Arbetsdomstolen ogiltigf\u00f6rklarade d\u00e4rf\u00f6r avskedandet. KM hade d\u00e4rmed r\u00e4tt till l\u00f6n f\u00f6r tiden mellan avskedandet och ogiltigf\u00f6rklaringen; beloppet var inte tvistigt.<\/p>\n\n\n\n<p>Eftersom Arbetsdomstolen ans\u00e5g att det fanns sk\u00e4l att rikta allvarlig kritik mot KM f\u00f6r de otill\u00e5tna slagningarna best\u00e4mde Arbetsdomstolen det allm\u00e4nna skadest\u00e5ndet f\u00f6r det ogrundade avskedandet till ett betydligt l\u00e4gre belopp \u00e4n normalt. Arbetsdomstolen ans\u00e5g d\u00e4rvid att det skulle beaktas att KM genom sitt handlande sj\u00e4lv i h\u00f6g grad medverkade till den situation som ledde till avskedandet.
