Lag\u00e4ndringarna tr\u00e4der i kraft den 1 mars 2026.<\/p>\n\n<p><strong>Lag\u00e4ndringens syfte<\/strong><\/p>\n\n\n\n<p>Syftet med arbetspr\u00f6vning \u00e4r att underl\u00e4tta och s\u00e4nka tr\u00f6sklarna f\u00f6r \u00e5terg\u00e5ng i arbete. Utg\u00e5ngspunkten \u00e4r att arbetspr\u00f6vning ska vara ett allra f\u00f6rsta steg mot \u00e5terg\u00e5ng i arbete f\u00f6r en anst\u00e4lld med helt nedsatt arbetsf\u00f6rm\u00e5ga p\u00e5 grund av sjukdom. Genom arbetspr\u00f6vning ska den anst\u00e4llde tidigt kunna pr\u00f6va sin arbetsf\u00f6rm\u00e5ga en kortare tid under p\u00e5g\u00e5ende sjukskrivning utan att riskera sin ers\u00e4ttning. Arbetspr\u00f6vningen ger den anst\u00e4llde och arbetsgivaren m\u00f6jlighet att under enkla former pr\u00f6va arbetsuppgifter och unders\u00f6ka om det \u00e4r m\u00f6jligt att p\u00e5b\u00f6rja \u00e5terg\u00e5ng i arbetet. Arbetspr\u00f6vning kan \u00e4ven ge b\u00e5de arbetsgivaren och den anst\u00e4llde en tydligare bild av vilka anpassnings\u00e5tg\u00e4rder som kan beh\u00f6va vidtas, samtidigt som m\u00f6jligheterna till \u00e5terg\u00e5ng i arbete hos arbetsgivaren i ett senare skede kan tydligg\u00f6ras.<\/p>\n\n\n\n<p><strong>\u00c4ndringens n\u00e4rmare inneb\u00f6rd<\/strong><\/p>\n\n\n\n<p>Arbetspr\u00f6vning med bibeh\u00e5llen sjukpenning inf\u00f6rs den 1 mars 2026 och kommer att omfatta anst\u00e4llda som har r\u00e4tt till hel sjukpenning. Arbetspr\u00f6vning kr\u00e4ver en \u00f6verenskommelse mellan den anst\u00e4llde och arbetsgivaren vilket inneb\u00e4r att varken arbetsgivaren eller den anst\u00e4llde kan kr\u00e4va att arbetspr\u00f6vningen ska genomf\u00f6ras.<\/p>\n\n\n\n<p>M\u00f6jligheten att arbetspr\u00f6va hos arbetsgivaren med bibeh\u00e5llen sjukpenning g\u00e4ller under en period om h\u00f6gst 14 sammanh\u00e4ngande dagar och h\u00f6gst tv\u00e5 g\u00e5nger per \u00e5r. Det kr\u00e4vs minst 30 dagar mellan de tv\u00e5 separata tv\u00e5veckorsperioderna med arbetspr\u00f6vning. Hur arbetspr\u00f6vningen ska f\u00f6rl\u00e4ggas under perioden om 14 dagar best\u00e4ms i samr\u00e5d mellan arbetsgivaren och den anst\u00e4llde.<\/p>\n\n\n\n<p>Arbetsgivaren och den anst\u00e4llde m\u00e5ste vara \u00f6verens om arbetspr\u00f6vningen och arbetspr\u00f6vning f\u00e5r inte vara en \u00e5tg\u00e4rd som \u00e4r f\u00f6renad med krav p\u00e5 prestation fr\u00e5n den anst\u00e4llde. S\u00e5v\u00e4l den anst\u00e4llde som arbetsgivaren kan avbryta en arbetspr\u00f6vning. Det finns inga s\u00e4rskilda begr\u00e4nsningar f\u00f6r n\u00e4r i ett sjukfall en arbetspr\u00f6vning f\u00e5r genomf\u00f6ras, eftersom ett s\u00e5dant krav skulle kunna f\u00f6rdr\u00f6ja arbetspr\u00f6vningen och d\u00e4rmed f\u00f6rl\u00e4nga sjukfallet.<\/p>\n\n\n\n<p><strong>Den praktiska hanteringen<\/strong><\/p>\n\n\n\n<p>Arbetspr\u00f6vningen ska anm\u00e4las till F\u00f6rs\u00e4kringskassan av den anst\u00e4llde. Anm\u00e4lan ska g\u00f6ras senast tv\u00e5 veckor f\u00f6re arbetspr\u00f6vningens f\u00f6rsta dag. Anm\u00e4lan ska vara undertecknad av b\u00e5de den anst\u00e4llde och arbetsgivaren.<\/p>\n\n\n\n<p>Det kr\u00e4vs inget beslut eller formellt godk\u00e4nnande av F\u00f6rs\u00e4kringskassan f\u00f6r att p\u00e5b\u00f6rja arbetspr\u00f6vningen. Om villkoren f\u00f6r arbetspr\u00f6vning inte \u00e4r uppfyllda kan myndigheten dock f\u00f6rv\u00e4ntas informera den anst\u00e4llde om detta.<\/p>\n\n\n\n<p>F\u00f6rs\u00e4kringskassan har \u00e4nnu inte tagit fram n\u00e5got f\u00f6rslag p\u00e5 utformningen av anm\u00e4lan om arbetspr\u00f6vning. I avvaktan p\u00e5 ett eventuellt f\u00f6rslag till blankett fr\u00e5n myndigheten, b\u00f6r uppm\u00e4rksammas p\u00e5 att anm\u00e4lan inneh\u00e5ller n\u00f6dv\u00e4ndig information om datum f\u00f6r den planerade arbetspr\u00f6vningen, den anst\u00e4lldes personnummer, samt underskrifter fr\u00e5n b\u00e5de den anst\u00e4llde och arbetsgivaren. Arbetsgivaren b\u00f6r spara en kopia av anm\u00e4lan f\u00f6r att i efterhand vid behov kunna visa att man varit \u00f6verens om en arbetspr\u00f6vning.<\/p>\n\n\n\n<p><strong>F\u00f6rs\u00e4kringsskydd under arbetspr\u00f6vning<\/strong><\/p>\n\n\n\n<p>F\u00f6rordnings\u00e4ndringar avseende f\u00f6rs\u00e4kringsskydd har beslutats och tr\u00e4der i kraft den 1 mars 2026. F\u00f6rordnings\u00e4ndringarna inneb\u00e4r att den som arbetspr\u00f6var omfattas av arbetsskadef\u00f6rs\u00e4kringen enligt f\u00f6rordningen (1977:284) om arbetsskadef\u00f6rs\u00e4kring och statligt personskadeskydd.<\/p>\n\n\n\n<p>F\u00f6rordnings\u00e4ndringarna inneb\u00e4r ocks\u00e5 att om den som arbetspr\u00f6var orsakar skada ers\u00e4tts arbetsgivaren enligt f\u00f6rordningen (1980:631) om ers\u00e4ttning av allm\u00e4nna medel f\u00f6r skada orsakad av deltagare i ett arbetsmarknadspolitiskt program eller arbetslivsinriktad rehabilitering m.m.<\/p>\n\n\n\n<p>&nbsp;En anst\u00e4lld som arbetspr\u00f6var med bibeh\u00e5llen sjukpenning omfattas av TFA p\u00e5 motsvarande s\u00e4tt som dem som arbetstr\u00e4nar med rehabiliteringspenning p\u00e5 den egna arbetsplatsen.<\/p>\n\n\n\n<p>Vid fr\u00e5gor r\u00f6rande f\u00f6rs\u00e4kringsskydd under arbetspr\u00f6vning g\u00e5r det bra att kontakta Avtalat p\u00e5 0770-16 10 00.
