{"id":85935,"date":"2026-02-19T10:12:27","date_gmt":"2026-02-19T09:12:27","guid":{"rendered":"https:\/\/www.almega.se\/?p=85935"},"modified":"2026-02-19T10:15:34","modified_gmt":"2026-02-19T09:15:34","slug":"tvist-om-avtalsenlig-lon-under-uppsagningstid-i-bemanningsforetag","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2026\/02\/tvist-om-avtalsenlig-lon-under-uppsagningstid-i-bemanningsforetag\/","title":{"rendered":"Tvist om avtalsenlig l\u00f6n under upps\u00e4gningstid i bemannings&shy;f\u00f6retag"},"content":{"rendered":"<p class=\"intro\">Tvisten g\u00e4llde huruvida ett bemanningsf\u00f6retag i byggbranschen gjort sig skyldig till brott mot kollektivavtalet, byggavtalet.<\/p>\n\n<p><strong><a href=\"https:\/\/www.almega.se\/app\/uploads\/protected\/2026\/02\/ad-2026-nr-8.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">AD 2026 nr 8<\/a><\/strong><\/p>\n\n\n\n<p>Av byggavtalet framg\u00e5r att en uppsagd arbetstagare har r\u00e4tt att under upps\u00e4gningstid beh\u00e5lla l\u00f6n och andra anst\u00e4llningsf\u00f6rm\u00e5ner \u00e4ven om arbetstagaren inte f\u00e5r n\u00e5gra arbetsuppgifter alls eller f\u00e5r andra arbetsuppgifter \u00e4n tidigare. Byggavtalet g\u00e4ller \u00e4ven f\u00f6r arbetstagare som \u00e4r anst\u00e4llda hos bemanningsf\u00f6retag, om inte n\u00e5got undantag framg\u00e5r av en bilaga till byggavtalet \u2013 vilket det inte gjorde f\u00f6r den aktuella best\u00e4mmelsen. \u00c4ven en bemanningsanst\u00e4lld arbetstagare har s\u00e5ledes r\u00e4tt att under upps\u00e4gningstid beh\u00e5lla sin l\u00f6n och andra anst\u00e4llningsf\u00f6rm\u00e5ner.<\/p>\n\n\n\n<p>Av byggavtalet framg\u00e5r vidare att arbetstagarens l\u00f6n \u00e4r olika beroende p\u00e5 om arbetstagaren \u00e4r uthyrd eller inte \u00e4r uthyrd. Under tid d\u00e5 arbetstagaren inte \u00e4r uthyrd betalas ers\u00e4ttning med l\u00e4gst grundl\u00f6n enligt byggavtalet.<\/p>\n\n\n\n<p>Under upps\u00e4gningstiden betalade bemanningsf\u00f6retaget ifr\u00e5ga grundl\u00f6n f\u00f6r de perioder den uppsagde arbetstagaren inte var uthyrd till andra f\u00f6retag. Tvisten avs\u00e5g om best\u00e4mmelsen i byggavtalet innebar att arbetstagaren, under tid d\u00e5 denne inte var uthyrd under upps\u00e4gningstiden, ist\u00e4llet f\u00f6r grundl\u00f6n hade r\u00e4tt att f\u00e5 samma ers\u00e4ttning som under det n\u00e4rmast f\u00f6reg\u00e5ende utbokade arbetet, och om bemanningsf\u00f6retaget d\u00e4rf\u00f6r br\u00f6t mot byggavtalets best\u00e4mmelse om r\u00e4tt till bibeh\u00e5llen l\u00f6n under upps\u00e4gningstiden genom att endast betala grundl\u00f6n.<\/p>\n\n\n\n<p>F\u00f6rbundet hade yrkat att bemanningsf\u00f6retaget skulle betala dels l\u00f6n och semesterers\u00e4ttning med drygt 15&nbsp;000 kr till arbetstagaren (\u201dRC\u201d), dels allm\u00e4nt skadest\u00e5nd f\u00f6r kollektivavtalsbrott med 20&nbsp;000 kr till RC och med 50&nbsp;000 kr till f\u00f6rbundet.<\/p>\n\n\n\n<p>Arbetsdomstolen framh\u00f6ll att \u00e4ven 12 \u00a7 anst\u00e4llningsskyddslagen (\u201dLAS\u201d) anger att en arbetstagare som har blivit uppsagd har r\u00e4tt att under upps\u00e4gningstiden beh\u00e5lla sin l\u00f6n och andra anst\u00e4llningsf\u00f6rm\u00e5ner \u00e4ven om arbetstagaren inte f\u00e5r n\u00e5gra arbetsuppgifter alls eller f\u00e5r andra arbetsuppgifter \u00e4n tidigare. Best\u00e4mmelserna i byggavtalet och LAS hade identisk lydelse. F\u00f6rbundet hade gjort g\u00e4llande att best\u00e4mmelserna hade samma inneb\u00f6rd och arbetsgivarparterna hade inte inv\u00e4nt mot det. Enligt Arbetsdomstolen borde ledning f\u00f6r hur kollektivavtalets best\u00e4mmelse ska f\u00f6rst\u00e5s d\u00e4rf\u00f6r kunna h\u00e4mtas fr\u00e5n lagbest\u00e4mmelsens f\u00f6rarbeten och till\u00e4mpning. Utifr\u00e5n f\u00f6rarbetena och Arbetsdomstolens praxis redovisade Arbetsdomstolen sedan f\u00f6ljande uppfattning:<\/p>\n\n\n\n<p>\u201d<em>Enligt Arbetsdomstolens uppfattning tyder det ovan anf\u00f6rda p\u00e5 att en arbetstagare enligt anst\u00e4llningsskyddslagens best\u00e4mmelse ska ha minst samma anst\u00e4llningsf\u00f6rm\u00e5ner under upps\u00e4gningstiden som dessf\u00f6rinnan. Det finns inget som tyder p\u00e5 att en arbetstagare under upps\u00e4gningstid kan g\u00f6ra anspr\u00e5k p\u00e5 andra f\u00f6rm\u00e5ner \u00e4n som skulle ha l\u00e4mnats om han eller hon inte blivit uppsagd. Best\u00e4mmelsen ger inte n\u00e5gon garanti mot inkomsts\u00e4nkningar som \u00e4r normala hos arbetsgivaren. N\u00e5gon r\u00e4tt till h\u00f6gre l\u00f6n eller b\u00e4ttre anst\u00e4llningsf\u00f6rh\u00e5llanden under upps\u00e4gningstiden kan enligt Arbetsdomstolen inte utl\u00e4sas. Att en arbetstagare hos ett bemanningsf\u00f6retag, s\u00e5som \u00f6vriga bemanningsanst\u00e4llda hos f\u00f6retaget, tidvis inte \u00e4r uthyrd och d\u00e5 avtalsenligt f\u00e5r viss l\u00f6n kan inte j\u00e4mst\u00e4llas med att arbetstagaren inte f\u00e5r n\u00e5gra arbetsuppgifter alls i den mening som avses i best\u00e4mmelsen i anst\u00e4llningsskyddslagen. Det finns inte anledning att anta att parterna avsett att ge byggavtalets motsvarande best\u00e4mmelse n\u00e5gon annan inneb\u00f6rd \u00e4n anst\u00e4llningsskyddslagens<\/em>\u201d.<\/p>\n\n\n\n<p>Arbetsdomstolen anf\u00f6rde sedan att RC, efter upps\u00e4gningen, hade fortsatt att arbeta p\u00e5 samma s\u00e4tt som tidigare; under vissa perioder hade han varit uthyrd till andra f\u00f6retag och under andra perioder hade han st\u00e5tt till f\u00f6rfogande f\u00f6r arbete men inte varit uthyrd. Enligt Arbetsdomstolen hade RC d\u00e4rmed under sin upps\u00e4gningstid f\u00e5tt arbetsuppgifter p\u00e5 samma s\u00e4tt som tidigare. Enligt Arbetsdomstolen fanns det inget som tydde p\u00e5 att bemanningsf\u00f6retaget hade behandlat honom annorlunda under upps\u00e4gningstiden \u00e4n under best\u00e5ende anst\u00e4llning; han hade d\u00e4rf\u00f6r inte under upps\u00e4gningstiden f\u00e5tt andra arbetsuppgifter \u00e4n tidigare eller fr\u00e5ntagits arbetsuppgifter. Under upps\u00e4gningstiden fick RC l\u00f6n och helgl\u00f6n p\u00e5 samma s\u00e4tt som f\u00f6re upps\u00e4gningen, dvs. han fick l\u00f6n n\u00e4r han var uthyrd baserat p\u00e5 den l\u00f6neniv\u00e5 som g\u00e4llde p\u00e5 den arbetsplats som han vid varje tidpunkt var uthyrd till och han fick grundl\u00f6n under tid n\u00e4r han inte var uthyrd.<\/p>\n\n\n\n<p>Arbetsdomstolen ans\u00e5g att RC s\u00e5ledes hade f\u00e5tt beh\u00e5lla sin l\u00f6n och andra anst\u00e4llningsf\u00f6rm\u00e5ner under upps\u00e4gningstiden. D\u00e4rmed ans\u00e5gs bolaget ha betalat avtalsenlig l\u00f6n till RC under upps\u00e4gningstiden. Arbetsdomstolens bed\u00f6mning innebar att bolaget inte hade brutit mot byggavtalet och \u00e5dragit sig skadest\u00e5ndsskyldighet mot RC eller f\u00f6rbundet. F\u00f6rbundets talan avslogs d\u00e4rf\u00f6r och f\u00f6rbundet \u00e5lades att ers\u00e4tta arbetsgivarparternas r\u00e4tteg\u00e5ngskostnader med 90&nbsp;000 kr.<\/p>\n\n\n\n<p><a
