Fr\u00e5ga huruvida det eventuella avskedandet skulle ogiltigf\u00f6rklaras.<\/p>\n\n<p><strong><a href=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/2026\/2026-01-28-ad-2026-nr-3\/\">AD 2026 nr 3<\/a><\/strong><\/p>\n\n\n\n<p>Enligt f\u00f6rbundet som f\u00f6retr\u00e4dde arbetstagaren hade Bolaget avskedat arbetstagaren den 30 november 2023. Bolaget gjorde f\u00f6r egen del g\u00e4llande att arbetstagaren hade sagt upp sig sj\u00e4lv den 24 augusti 2023 med sista anst\u00e4llningsdag den 30 november 2023. Arbetsgivarparterna gjorde g\u00e4llande att arbetstagaren hade undertecknat en upps\u00e4gningshandling, medan f\u00f6rbundet gjorde g\u00e4llande att den n\u00e4mnda handlingen inte var \u00e4kta.<\/p>\n\n\n\n<p>Arbetsdomstolen angav f\u00f6ljande om r\u00e4ttsliga utg\u00e5ngspunkter i m\u00e5let:<\/p>\n\n\n\n<p>\u201d<em>N\u00e4r en arbetsgivare p\u00e5st\u00e5r att en arbetstagare har sagt upp sig sj\u00e4lv genom en egenh\u00e4ndigt undertecknad skriftlig upps\u00e4gningshandling, som kan uppvisas i original, och det inv\u00e4nds att handlingen \u00e4r f\u00f6rfalskad, har arbetsgivaren bevisb\u00f6rdan f\u00f6r att handlingen \u00e4r \u00e4kta. Arbetsgivaren har d\u00e4rvid att g\u00f6ra det \u00f6verv\u00e4gande sannolikt att handlingen \u00e4r \u00e4kta. Denna l\u00e4ttnad i beviskravet beror p\u00e5 den bevisverkan som redan sj\u00e4lva uppvisandet av originalhandlingen har. Arbetsgivaren har ocks\u00e5 bevisb\u00f6rdan f\u00f6r att arbetstagaren har \u00f6verl\u00e4mnat handlingen till arbetsgivaren. Arbetsgivaren ska p\u00e5 sedvanligt s\u00e4tt styrka att s\u00e5 \u00e4r fallet (se <a href=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/arkiverade-domar\/2023\/2023-03-22-ad-2023-nr-18\/\">AD 2023 nr 18 <\/a>och <a href=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/arkiverade-domar\/2025\/2025-07-02-ad-2025-nr-50\/\">AD 2025 nr 50<\/a>)\u201d<\/em>.<\/p>\n\n\n\n<p>Vid en samlad bed\u00f6mning fann Arbetsdomstolen att arbetsgivarparterna inte gjort det \u00f6verv\u00e4gande sannolikt att upps\u00e4gningshandlingen var \u00e4kta. Det ans\u00e5gs f\u00f6ljaktligen inte utrett att arbetstagaren hade sagt upp sig sj\u00e4lv den 24 augusti 2023 med sista anst\u00e4llningsdag den 30 november 2023. Enligt Arbetsdomstolen skulle situationen d\u00e4rmed bed\u00f6mas som att arbetstagaren blev avskedad av Bolaget den 30 november 2023.<\/p>\n\n\n\n<p>Arbetsgivarparterna hade inte gjort g\u00e4llande att det f\u00f6relegat laga sk\u00e4l f\u00f6r avskedande, men d\u00e4remot att det f\u00f6relegat sakliga sk\u00e4l f\u00f6r upps\u00e4gning av arbetstagaren. Bolaget hade d\u00e4rvid p\u00e5st\u00e5tt att arbetstagaren utf\u00f6rt sina arbetsuppgifter som arbetsledare p\u00e5 ett bristf\u00e4lligt s\u00e4tt, att han haft m\u00e5nga privata telefonsamtal under arbetstid, samt att han tackat nej till ett sk\u00e4ligt omplaceringserbjudande fr\u00e5n Bolaget som innebar att han enbart skulle arbeta som m\u00e5lare.<\/p>\n\n\n\n<p>Vid en samlad bed\u00f6mning fann Arbetsdomstolen att arbetsgivarparterna inte lyckats visa att arbetstagaren brustit i utf\u00f6randet av sina arbetsuppgifter p\u00e5 ett s\u00e5dant s\u00e4tt att det fanns sakliga sk\u00e4l f\u00f6r upps\u00e4gning av honom. Arbetsdomstolens st\u00e4llningstagande innebar att avskedandet skulle ogiltigf\u00f6rklaras och att Bolaget var skyldigt att betala allm\u00e4nt skadest\u00e5nd till arbetstagaren f\u00f6r den kr\u00e4nkning som det felaktiga avskedandet innebar. Arbetsdomstolen best\u00e4mde det allm\u00e4nna skadest\u00e5ndet till 190&nbsp;000 kr f\u00f6r det felaktiga avskedandet, och d\u00f6mde \u00e4ven ut 30&nbsp;000 kr i allm\u00e4nt skadest\u00e5nd f\u00f6r bristande underr\u00e4ttelse enligt 30 \u00a7 LAS. Bolaget \u00e5lades \u00e4ven att betala allm\u00e4nt skadest\u00e5nd till f\u00f6rbundet f\u00f6r uteblivet varsel enligt 30 \u00a7 LAS, med yrkat belopp om 25&nbsp;000 kr som i sig var vitsordat av arbetsgivarparterna.<\/p>\n\n\n\n<p>Bolaget \u00e5lades \u00e4ven att ers\u00e4tta den l\u00f6nefordran som arbetstagaren hade p\u00e5 Bolaget fr\u00e5n dagen f\u00f6r avskedandet; beloppen i sig var vitsordade.<\/p>\n\n\n\n<p>D\u00e4rut\u00f6ver f\u00f6rpliktade Arbetsdomstolen \u00e4ven Bolaget att betala visst ekonomiskt skadest\u00e5nd till arbetstagaren f\u00f6r f\u00f6rlorad sjukpenning, till f\u00f6ljd av att Bolaget gjorde en anm\u00e4lan till F\u00f6rs\u00e4kringskassan avseende perioden 1 december 2023-28 januari 2024. Till f\u00f6ljd av Bolagets meddelande till F\u00f6rs\u00e4kringskassan beslutade kassan att s\u00e4nka arbetstagarens sjukpenning fr\u00e5n den 1 december 2023 och beslutade om \u00e5terkrav av sjukpenning som betalats f\u00f6r perioden 1-20 december 2023. Enligt Arbetsdomstolen hade arbetstagaren orsakats ekonomisk skada f\u00f6r f\u00f6rlorad sjukpenning genom Bolagets felaktiga avskedande.<\/p>\n\n\n\n<p>Slutligen \u00e5lades arbetsgivarparterna, som f\u00f6rlorat m\u00e5let, att ers\u00e4tta f\u00f6rbundets r\u00e4tteg\u00e5ngskostnader med 292&nbsp;233 kr.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/\" target=\"_blank\" rel=\"noreferrer noopener\">L\u00e4s fler domar p\u00e5 Arbetsdomstolens hemsida<\/a><\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>AD 2026 nr 3 Enligt f\u00f6rbundet som f\u00f6retr\u00e4dde arbetstagaren hade Bolaget avskedat arbetstagaren den 30 november 2023.
