{"id":85375,"date":"2026-01-23T11:23:32","date_gmt":"2026-01-23T10:23:32","guid":{"rendered":"https:\/\/www.almega.se\/?p=85375"},"modified":"2026-01-23T11:23:40","modified_gmt":"2026-01-23T10:23:40","slug":"laglig-grund-for-avsked-felaktig-tidrapportering-avgorande-enligt-ad","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2026\/01\/laglig-grund-for-avsked-felaktig-tidrapportering-avgorande-enligt-ad\/","title":{"rendered":"Laglig grund f\u00f6r avsked \u2013 felaktig tid&shy;rapportering avg\u00f6rande enligt AD"},"content":{"rendered":"\n<p><strong><a href=\"https:\/\/arbetsdomstolen.se\/sv\/meddelade-domar\/2026\/2026-01-21-ad-2026-nr-2\/\">AD 2026 nr 2<\/a><\/strong><\/p>\n\n\n\n<p>Fr\u00e5ga huruvida F\u00f6rs\u00e4kringskassan hade laglig grund att avskeda en anst\u00e4lld som var tj\u00e4nstledig p\u00e5 heltid f\u00f6r att utf\u00f6ra uppdrag som fackligt f\u00f6rtroendevald.<\/p>\n\n\n\n<p>Under tj\u00e4nstledigheten fortsatte F\u00f6rs\u00e4kringskassan att betala den anst\u00e4lldes l\u00f6n.<\/p>\n\n\n\n<p>Staten p\u00e5stod att den anst\u00e4llde felaktigt redovisade sin fr\u00e5nvaro och arbetstid till F\u00f6rs\u00e4kringskassan, missbrukade F\u00f6rs\u00e4kringskassans flextidssystem och d\u00e4rigenom \u00e5sidosatte sina \u00e5ligganden mot F\u00f6rs\u00e4kringskassan p\u00e5 ett s\u00e4tt som allvarligt skadade F\u00f6rs\u00e4kringskassans f\u00f6rtroende f\u00f6r den anst\u00e4llde.<\/p>\n\n\n\n<p>Arbetsdomstolen slutsats innebar sammantaget att den anst\u00e4llde, vid upprepade tillf\u00e4llen under en f\u00f6rh\u00e5llandevis kort tid, felaktigt redovisat sin arbetstid och fr\u00e5nvaro p\u00e5 ett s\u00e4tt som p\u00e5verkade hennes r\u00e4tt till l\u00f6n fr\u00e5n F\u00f6rs\u00e4kringskassan och F\u00f6rs\u00e4kringskassans m\u00f6jlighet att kontrollera hennes redovisade arbetstider. Detta agerande hade bl.a. innefattat f\u00f6ljande<\/p>\n\n\n\n<p>&#8211; felaktigt underl\u00e5tit att anm\u00e4la semester till F\u00f6rs\u00e4kringskassan den 10 och 11 augusti 2023,<\/p>\n\n\n\n<p>&#8211; felaktigt f\u00e5tt ers\u00e4ttning med 3&nbsp;000 kr f\u00f6r en flyttad semesterdag,<\/p>\n\n\n\n<p>&#8211; redovisat arbetad tid schablonm\u00e4ssigt ist\u00e4llet f\u00f6r att dagligen \u2013 eller i vart fall i s\u00e5 n\u00e4ra anslutning till arbetsdagen att redovisningen blev korrekt \u2013 redovisa faktiskt arbetad tid; d\u00e4rmed hade hon redovisat sin arbetstid felaktigt och i strid med F\u00f6rs\u00e4kringskassans flextidsavtal och vad som \u00e5l\u00e5g henne i anst\u00e4llningen,<\/p>\n\n\n\n<p>&#8211; underl\u00e5tit att anm\u00e4la sjukfr\u00e5nvaro den 22 maj 2023 trots att hon borde ha gjort det; den arbetstid hon registrerade den dagen motsvarade d\u00e4rmed inte n\u00e5gon faktiskt arbetad tid och var d\u00e4rf\u00f6r felaktigt registrerad och i strid med F\u00f6rs\u00e4kringskassans flextidsavtal,<\/p>\n\n\n\n<p>&#8211; felaktigt och i strid med F\u00f6rs\u00e4kringskassans flextidsavtal b\u00e5de den 8 och 10 februari 2023 registrerat ungef\u00e4r dubbelt s\u00e5 mycket arbetstid som hon faktiskt arbetade,<\/p>\n\n\n\n<p>&#8211; vid flera tillf\u00e4llen tagit flexledigt utan F\u00f6rs\u00e4kringskassans godk\u00e4nnande i strid med best\u00e4mmelserna i flextidsavtalet.<\/p>\n\n\n\n<p>Arbetsdomstolen uttalade bl.a. f\u00f6ljande om agerandet:<\/p>\n\n\n\n<p>Att en anst\u00e4lld hos F\u00f6rs\u00e4kringskassan agerar p\u00e5 ett s\u00e5dant s\u00e4tt underminerar inte bara F\u00f6rs\u00e4kringskassans f\u00f6rtroende f\u00f6r den anst\u00e4llde. \u00c4ven allm\u00e4nhetens f\u00f6rtroende f\u00f6r F\u00f6rs\u00e4kringskassans verksamhet riskeras vid s\u00e5dana f\u00f6rh\u00e5llanden. Enligt Arbetsdomstolen mening har den anst\u00e4lldes agerande orsakat en s\u00e5 allvarlig f\u00f6rtroendeskada att hon genom sitt agerande grovt \u00e5sidosatte sina \u00e5ligganden mot F\u00f6rs\u00e4kringskassan. F\u00f6rs\u00e4kringskassan hade d\u00e4rmed laglig grund att avskeda henne fr\u00e5n anst\u00e4llningen. Talan avslogs d\u00e4rmed och facket \u00e5lades att ers\u00e4tta statens r\u00e4tteg\u00e5ngskostnader med drygt 343&nbsp;000 kr.<\/p>\n\n\n\n<p>Tv\u00e5 av Arbetsdomstolens ledam\u00f6ter var skiljaktiga i det avseendet att de ans\u00e5g att det inte var visat i m\u00e5let att den anst\u00e4llde var skyldig att till\u00e4mpa daglig redovisning av arbetstiden. Enligt deras mening hade den anst\u00e4llde d\u00e4rf\u00f6r inte brutit mot flextidsavtalet genom att schablonm\u00e4ssigt redovisa sin arbetstid.
