Tingsr\u00e4tten, som till\u00e4mpade LAS i dess lydelse f\u00f6re den 30 juni 2022, ans\u00e5g d\u00e4remot att AK blivit utsatt f\u00f6r en otill\u00e5ten repressalie och att anst\u00e4llningen d\u00e4rmed sagts upp utan att det funnits saklig grund f\u00f6r upps\u00e4gning. Tingsr\u00e4tten tillerk\u00e4nde d\u00e4rf\u00f6r AK diskrimineringsers\u00e4ttning och allm\u00e4nt skadest\u00e5nd samt visst ekonomiskt skadest\u00e5nd motsvarande l\u00f6n under del av upps\u00e4gningstiden.<\/p>\n\n\n\n<p><strong>Parternas st\u00e5ndpunkter<\/strong><\/p>\n\n\n\n<p><em>AK (Arbetstagaren)<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Upps\u00e4gningen var en repressalie efter hennes anm\u00e4lan om sexuella trakasserier.<\/li>\n\n\n\n<li>Det fanns ingen verklig arbetsbrist.<\/li>\n\n\n\n<li>Hon borde ha omplacerats till butikssupport eller ekonomiassistent.<\/li>\n\n\n\n<li>Hon var arbetsbefriad med l\u00f6n under upps\u00e4gningstiden.<\/li>\n<\/ul>\n\n\n\n<p><em>Arbetsgivaren<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Upps\u00e4gningen skedde p\u00e5 grund av verklig arbetsbrist.<\/li>\n\n\n\n<li>AK hade inte tillr\u00e4ckliga kvalifikationer f\u00f6r andra tj\u00e4nster.<\/li>\n\n\n\n<li>AK var inte arbetsbefriad under hela upps\u00e4gningstiden; AK var olovligen fr\u00e5nvarande.<\/li>\n\n\n\n<li>Bolaget hade vidtagit tillr\u00e4ckliga \u00e5tg\u00e4rder efter anm\u00e4lan om trakasserier.<\/li>\n<\/ul>\n\n\n\n<p><strong>Arbetsdomstolens bed\u00f6mningar<\/strong><\/p>\n\n\n\n<p>Saklig grund f\u00f6r upps\u00e4gning \u2013 fanns det arbetsbrist i bolaget?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Det fanns verklig arbetsbrist.<\/li>\n\n\n\n<li>Ingen ledig befattning fanns att omplacera AK till. Befattningen som butikssupport hade tillsatts av bolaget redan innan beslutet om den nedsk\u00e4rning som orsakade arbetsbristen. Den befattningen var s\u00e5ledes inte ledig n\u00e4r AK sades upp.<\/li>\n<\/ul>\n\n\n\n<p>Utsattes AK f\u00f6r en repressalie? Uppfyllde bolaget sin \u00e5tg\u00e4rds- och utredningsskyldighet enligt diskrimineringslagen?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Arbetsdomstolen ans\u00e5g att det inte hade framkommit n\u00e5got i utredningen som tydde p\u00e5 att bolagsledningen var missn\u00f6jd med att AK gjort en anm\u00e4lan om sexuella trakasserier. Det hade inte heller p\u00e5st\u00e5tts av AK.<\/li>\n\n\n\n<li>Arbetsdomstolen inst\u00e4mde i tingsr\u00e4ttens bed\u00f6mning att bolaget uppfyllt sin utrednings- och \u00e5tg\u00e4rdsskyldighet och vidtagit de \u00e5tg\u00e4rder som sk\u00e4ligen kunde kr\u00e4vas med anledning av AK:s anm\u00e4lan.<\/li>\n\n\n\n<li>Det f\u00f6rh\u00e5llandet att AK:s anm\u00e4lan hade gjorts ca 5 m\u00e5nader innan hon blev uppsagd ans\u00e5gs inte utg\u00f6ra ett s\u00e5dant n\u00e4ra tidssamband som i sig gjorde att det fanns anledning att anta att upps\u00e4gningen berodde p\u00e5 hennes anm\u00e4lan.<\/li>\n\n\n\n<li>Sammanfattningsvis ans\u00e5g Arbetsdomstolen att det inte fanns anledning att anta att AK hade utsatts f\u00f6r en otill\u00e5ten repressalie enligt diskrimineringslagen.<\/li>\n<\/ul>\n\n\n\n<p>Turordning och f\u00f6retr\u00e4desr\u00e4tt<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>JT, som anst\u00e4lldes som butikssupport, hade l\u00e4ngre anst\u00e4llningstid \u00e4n AK. JT anst\u00e4lldes \u00e4ven innan AK sades upp. Den anst\u00e4llningen utgjorde s\u00e5ledes inte ett brott mot turordningsreglerna eller f\u00f6retr\u00e4desr\u00e4tten till \u00e5teranst\u00e4llning.<\/li>\n\n\n\n<li>AK hade inte tillr\u00e4ckliga kvalifikationer f\u00f6r befattningen som ekonomiassistent. Det inneb\u00e4r att bolaget inte hade brutit mot best\u00e4mmelserna om f\u00f6retr\u00e4desr\u00e4tt till \u00e5teranst\u00e4llning genom att inte erbjuda AK den aktuella befattningen,<\/li>\n\n\n\n<li>Bolaget br\u00f6t inte mot turordningsreglerna eller f\u00f6retr\u00e4desr\u00e4tten till \u00e5teranst\u00e4llning.<\/li>\n<\/ul>\n\n\n\n<p>Ytterligare l\u00f6n under upps\u00e4gningstiden<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>AK var inte arbetsbefriad under hela perioden. Sms och e-post visade att arbetsgivaren inte avs\u00e5g att arbetsbefria henne tills vidare.<\/li>\n\n\n\n<li>AK hade inte bevisat att hon var arbetsbefriad under en l\u00e4ngre tid \u00e4n vad bolaget medgett.<\/li>\n\n\n\n<li>Eftersom AK varit fr\u00e5nvarande fr\u00e5n arbetet utan att bolaget hade arbetsbefriat henne hade hon varit olovligen fr\u00e5nvarande och hade inte r\u00e4tt till l\u00f6n f\u00f6r denna period.<\/li>\n<\/ul>\n\n\n\n<p>Slutsats <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Arbetsdomstolen ogillade AK:s talan i sin helhet, \u00e4ndrade tingsr\u00e4ttens dom och f\u00f6rpliktade AK att betala bolagets r\u00e4tteg\u00e5ngskostnader i tingsr\u00e4tten och Arbetsdomstolen.<\/li>\n<\/ul>\n\n\n\n<p><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/\" target=\"_blank\" rel=\"noreferrer noopener\">L\u00e4s fler domar p\u00e5 Arbetsdomstolens hemsida<\/a><\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>AD 2025 nr 85 Tvistefr\u00e5gor i m\u00e5let Tingsr\u00e4ttens bed\u00f6mning I den \u00f6verklagade domen fann tingsr\u00e4tten att bolaget uppfyllt utrednings- och \u00e5tg\u00e4rdsskyldigheten enligt diskrimineringslagen.
