Arbetsgivaren bestred yrkandet. Tingsr\u00e4tten fann att kocken inte hade styrkt att arbetsgivaren var skyldig att betala ytterligare l\u00f6n till kocken. Kocken \u00f6verklagade till Arbetsdomstolen.<\/p>\n\n\n\n<p>Kocken \u00e5beropade bl.a. f\u00f6ljande till st\u00f6d f\u00f6r sin talan. Med en bruttol\u00f6n om 22 000 kr per m\u00e5nad skulle han enligt anst\u00e4llningsavtalet ha f\u00e5tt 242 000 kr i bruttol\u00f6n och 190 630 kr i nettol\u00f6n f\u00f6r elva m\u00e5naders arbete. Han fick endast 70 000 kr i nettol\u00f6n under anst\u00e4llningstiden. Han fick 40 000 kr kontant vid ett tillf\u00e4lle, mindre belopp kontant vid flera tillf\u00e4llen om totalt 20 000 kr och 10 000 kr betalades in p\u00e5 hans konto i september 2022. Utest\u00e5ende l\u00f6n uppg\u00e5r d\u00e4rmed till 120 630 kr. Till det ska l\u00e4ggas semesterers\u00e4ttning och kostnader som uppst\u00e5tt f\u00f6r att kr\u00e4va in den utest\u00e5ende l\u00f6nen. Sammanlagt uppg\u00e5r det yrkade beloppet till 140 828 kr. Han fick l\u00f6nen i kontanter, eftersom han inte hade n\u00e5got bankkonto f\u00f6rr\u00e4n i februari 2022.<\/p>\n\n\n\n<p>Arbetsgivaren inv\u00e4nde att full l\u00f6n hade betalats till kocken i enlighet med anst\u00e4llningsavtalet, och anf\u00f6rde bl.a. f\u00f6ljande. I b\u00f6rjan av anst\u00e4llningen hade kocken inget bankkonto. L\u00f6nen betalades d\u00e4rf\u00f6r kontant i mindre summor. Han \u00f6verf\u00f6rde d\u00e4rtill vid ett tillf\u00e4lle 10 000 kr till kockens bror i Jordanien och kocken fick anv\u00e4nda hans VISA-kort vid en resa i Jordanien. Han gav \u00e4ven kocken 3 000 kr i kontanter inf\u00f6r resan. Hans revisor bokf\u00f6rde kockens l\u00f6n och s\u00e5g till att arbetsgivaravgifter och f\u00f6rs\u00e4kring betalades.<\/p>\n\n\n\n<p>Arbetsdomstolen gjorde f\u00f6ljande \u00f6verv\u00e4ganden och bed\u00f6mningar.<\/p>\n\n\n\n<p>Bevisb\u00f6rdan f\u00f6r att en arbetstagare har f\u00e5tt full l\u00f6n ligger normalt p\u00e5 arbetsgivaren. En arbetsgivare \u00e4r skyldig att f\u00f6ra bokf\u00f6ring och dokumentation \u00f6ver l\u00f6neutbetalningar. En arbetsgivare b\u00f6r d\u00e4rf\u00f6r kunna styrka att l\u00f6n har betalats ut korrekt. Att f\u00f6ra bevisning om motsatsen, dvs. att betalning inte har skett, \u00e4r d\u00e4remot typiskt sett f\u00f6renat med praktiska sv\u00e5righeter, se t.ex. AD 2017 nr 4.<\/p>\n\n\n\n<p>Sammantaget ans\u00e5g Arbetsdomstolen att utredningen i m\u00e5let talade f\u00f6r att de uppgifter som framgick av kockens inkomstdeklaration inte var korrekta. Enligt Arbetsdomstolens uppfattning styrkte inkomstdeklarationen d\u00e4rf\u00f6r inte att arbetsgivaren betalat ut l\u00f6n till kocken med det i inkomstdeklarationen angivna beloppet. D\u00e4rut\u00f6ver hade arbetsgivaren bl.a. anf\u00f6rt att han betalat l\u00f6n till kocken i enlighet med en kundkopia av en \u00f6verf\u00f6ring till kocken och fakturor avseende ink\u00f6p gjorda p\u00e5 arbetsgivarens kreditkort. Enligt Arbetsdomstolen styrkte de \u00e5beropade handlingarna inte att \u00f6verf\u00f6ringen respektive ink\u00f6pen p\u00e5 kreditkortet avs\u00e5g l\u00f6n till kocken.<\/p>\n\n\n\n<p>Arbetsdomstolen kom d\u00e4rmed till slutsatsen att arbetsgivaren inte hade styrkt att han hade betalat ut mer l\u00f6n till kocken \u00e4n vad kocken hade medgivit.<\/p>\n\n\n\n<p>Arbetsdomstolen hade d\u00e4rmed att ta st\u00e4llning till vilket l\u00f6nebelopp kocken hade r\u00e4tt till.<\/p>\n\n\n\n<p>Arbetsdomstolen framh\u00f6ll att det ankom p\u00e5 kocken att visa att han hade arbetat de dagar han p\u00e5stod. Arbetsdomstolen ans\u00e5g att kocken inte hade visat n\u00e5gra omst\u00e4ndigheter till st\u00f6d f\u00f6r att han hade b\u00f6rjat arbeta tidigare \u00e4n det datum d\u00e5 anst\u00e4llningen p\u00e5b\u00f6rjades enligt anst\u00e4llningsavtalet. Kocken hade inte heller visat att sista anst\u00e4llningsdag var den 11 juli 2022. Ist\u00e4llet utgick Arbetsdomstolen fr\u00e5n att kocken hade arbetat t.o.m. den 6 juni 2022, vilket var vad arbetsgivaren gjorde g\u00e4llande. Givet detta fann Arbetsdomstolen att kocken hade r\u00e4tt till l\u00f6n under nio m\u00e5nader och 28 dagar.<\/p>\n\n\n\n<p>Arbetsdomstolens bed\u00f6mning blev att kocken hade r\u00e4tt till ytterligare l\u00f6n med 126&nbsp;394 kr efter skatt, vilket arbetsgivaren \u00e5lades att betala.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/\" target=\"_blank\" rel=\"noreferrer noopener\">L\u00e4s fler domar p\u00e5 Arbetsdomstolens hemsida<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>AD 2025 nr 82 Fr\u00e5ga om en arbetstagare, en kock, hade r\u00e4tt till ytterligare l\u00f6n.
