{"id":83068,"date":"2025-10-10T16:23:36","date_gmt":"2025-10-10T14:23:36","guid":{"rendered":"https:\/\/www.almega.se\/?p=83068"},"modified":"2025-10-10T16:23:43","modified_gmt":"2025-10-10T14:23:43","slug":"arbetsdomstolen-godkande-uppsagning-arbetsbrist-ansags-styrkt","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2025\/10\/arbetsdomstolen-godkande-uppsagning-arbetsbrist-ansags-styrkt\/","title":{"rendered":"Arbetsdomstolen godk\u00e4nde upps\u00e4gning \u2013 arbets&shy;brist ans\u00e5gs styrkt"},"content":{"rendered":"\n<p><strong><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/2025\/2025-10-01-ad-2025-nr-70\/\">AD 2025 nr 70<\/a><\/strong><\/p>\n\n\n\n<p><strong>Tvisten g\u00e4llde huruvida en upps\u00e4gning pga. arbetsbrist var sakligt grundad.<\/strong><\/p>\n\n\n\n<p>Arbetstagaren MB \u2013 som fr\u00e4mst arbetat som navigat\u00f6r vid s\u00e5gprojekt \u2013 hade bl.a. gjort g\u00e4llande att den egentliga grunden f\u00f6r upps\u00e4gningen inte var arbetsbrist utan att det var fr\u00e5gan om fingerad arbetsbrist.<\/p>\n\n\n\n<p>M\u00e5let var \u00f6verklagat till Arbetsdomstolen fr\u00e5n V\u00e4stmanlands tingsr\u00e4tt, som hade funnit att upps\u00e4gningen av MB var i strid med 7 \u00a7 LAS. Tingsr\u00e4tten ans\u00e5g bl.a. att utredningen inte var tillr\u00e4cklig f\u00f6r att sl\u00e5 fast att bolaget hade gjort en s\u00e5dan noggrann och seri\u00f6s bed\u00f6mning av det f\u00f6retagsekonomiska l\u00e4get som kr\u00e4vdes f\u00f6r att arbetsgivaren skulle kunna anses ha styrkt att det f\u00f6relegat arbetsbrist vid tidpunkten f\u00f6r upps\u00e4gningen av MB.<\/p>\n\n\n\n<p>Arbetsdomstolen gjorde bl.a. f\u00f6ljande uttalanden om r\u00e4ttsliga utg\u00e5ngspunkter i m\u00e5let.<\/p>\n\n\n\n<p>Vad g\u00e4ller situationer d\u00e4r arbetstagaren g\u00f6r g\u00e4llande s.k. fingerad arbetsbrist (och det inte p\u00e5st\u00e5s diskriminering) har Arbetsdomstolen, som tingsr\u00e4tten angett, slagit fast att det finns m\u00f6jlighet att g\u00e5 direkt p\u00e5 den avg\u00f6rande fr\u00e5gan om det faktiskt funnits arbetsbrist, dvs. g\u00f6ra bevispr\u00f6vningen i bara ett steg utan att g\u00e5 in p\u00e5 de personliga sk\u00e4l som arbetstagarsidan h\u00e4vdar f\u00f6ranlett upps\u00e4gningen (AD 2017 nr 58).<\/p>\n\n\n\n<p>Arbetsdomstolen har vidare uttalat att arbetsgivarsidan i vissa fall angett att verksamhetsf\u00f6r\u00e4ndringen som enligt den sidan lett till eller inneburit arbetsbrist varit f\u00f6ranledd av externa faktorer och i andra fall att det helt enkelt varit fr\u00e5ga om ett beslut fr\u00e5n arbetsgivarens sida om att vidta en f\u00f6r\u00e4ndring. I de f\u00f6rstn\u00e4mnda fallen har Arbetsdomstolen pr\u00f6vat om de uppgivna faktorerna funnits, om de haft betydelse f\u00f6r beslutet om verksamhetsf\u00f6r\u00e4ndringen och om verksamhetsf\u00f6r\u00e4ndringen faktiskt genomf\u00f6rts. Det kr\u00e4vs i dessa fall att arbetsgivaren g\u00f6r en noggrann och seri\u00f6s bed\u00f6mning av faktorernas inverkan p\u00e5 syssels\u00e4ttningsl\u00e4get vid en t\u00e4nkt upps\u00e4gningstids utg\u00e5ng. Brister det i den bed\u00f6mningen, kan det anses att upps\u00e4gningarna skett \u201df\u00f6r s\u00e4kerhets skull\u201d och d\u00e4rmed inte har varit sakligt grundade p\u00e5 arbetsbrist, ens med arbetsgivarens egna utg\u00e5ngspunkter.<\/p>\n\n\n\n<p>Om arbetsgivarens beslut i st\u00e4llet bara handlat om ett st\u00e4llningstagande (t.ex. att verksamheten ska upph\u00f6ra eller ett en viss befattning ska tas bort), har Arbetsdomstolen pr\u00f6vat om arbetsbristen \u00e4r verklig i den meningen att arbetsgivaren faktiskt genomf\u00f6rt det beslut arbetsgivaren s\u00e4ger sig ha fattat. Om Arbetsdomstolen d\u00e5 funnit att arbetsgivaren faktiskt genomf\u00f6rt det beslut den s\u00e4ger sig ha fattat, har det godtagits att det funnits arbetsbrist n\u00e4r arbetsgivaren uppgivit n\u00e5got verksamhetsrelaterat sk\u00e4l f\u00f6r sitt beslut som framst\u00e5tt som rimligt, t.ex. en \u00f6nskan om h\u00f6gre l\u00f6nsamhet. I pr\u00f6vningen om det \u00e4r fr\u00e5ga om en arbetsbristsituation ska domstolen allts\u00e5 inte bed\u00f6ma om \u00e5tg\u00e4rden varit l\u00e4mplig, ber\u00e4ttigad eller haft fog f\u00f6r sig (se AD 2017 nr 58 och d\u00e4ri gjorda h\u00e4nvisningar).<\/p>\n\n\n\n<p>Arbetsdomstolen \u00f6vergick sedan till bed\u00f6mningen i det aktuella fallet.<\/p>\n\n\n\n<p>Till skillnad fr\u00e5n tingsr\u00e4tten ans\u00e5g Arbetsdomstolen att f\u00f6rh\u00f6rspersonernas ber\u00e4ttelser var tillr\u00e4ckligt detaljerade f\u00f6r att det skulle vara styrkt att bolaget beslutade att ers\u00e4tta navigat\u00f6rens arbetsuppgifter med en applikation f\u00f6r att effektivisera verksamheten och att det beslutet verkst\u00e4lldes samt att bolaget d\u00e5 inte l\u00e4ngre beh\u00f6vde n\u00e5gon navigat\u00f6r. Enligt Arbetsdomstolen hade det inte framkommit annat \u00e4n att bolaget faktiskt avskaffade befattningen navigat\u00f6r och lade ut MB:s \u00f6vriga arbetsuppgifter p\u00e5 kvarvarande arbetstagare. Arbetsdomstolen fann d\u00e4rmed att det fanns arbetsbrist n\u00e4r MB sades upp.<\/p>\n\n\n\n<p>Fr\u00e5gan var d\u00e5 om bolaget uppfyllt sin omplaceringsskyldighet. MB hade framf\u00f6rt att bolaget inte genomf\u00f6rt n\u00e5gon omplaceringsutredning och att bolaget borde ha erbjudit henne omplacering. Bolaget hade inv\u00e4nt att det inte fanns n\u00e5got ledigt arbete. MB hade inte gjort g\u00e4llande att n\u00e5gon anst\u00e4llts efter henne och hon hade inte heller h\u00e4nvisat till n\u00e5gon viss befattning hos bolaget som skulle varit ledig. Arbetsdomstolen ans\u00e5g att det av utredningen inte hade framkommit att det skulle ha funnits n\u00e5got ledigt arbete som MB borde ha erbjudits omplacering till eller att bolaget gjort en bristf\u00e4llig utredning av vilka lediga befattningar som kunde ha funnits. Arbetsdomstolen ans\u00e5g d\u00e4rmed att bolaget gjort den omplaceringsutredning som kr\u00e4vts.<\/p>\n\n\n\n<p>Arbetsdomstolens bed\u00f6mningar innebar att MB:s talan avslogs och att tingsr\u00e4ttens dom \u00e4ndrades i enlighet med detta.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/\" target=\"_blank\" rel=\"noreferrer noopener\">L\u00e4s fler domar p\u00e5 Arbetsdomstolens hemsida<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>AD 2025 nr 70 Tvisten g\u00e4llde huruvida en upps\u00e4gning pga. arbetsbrist var sakligt grundad.
