{"id":82665,"date":"2025-09-25T13:23:22","date_gmt":"2025-09-25T11:23:22","guid":{"rendered":"https:\/\/www.almega.se\/?p=82665"},"modified":"2025-09-25T13:23:28","modified_gmt":"2025-09-25T11:23:28","slug":"tvist-om-royalty-for-snobollen-var-inte-en-arbetstvist-enligt-arbetsdomstolen","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2025\/09\/tvist-om-royalty-for-snobollen-var-inte-en-arbetstvist-enligt-arbetsdomstolen\/","title":{"rendered":"Tvist om royalty f\u00f6r Sn\u00f6bollen var inte en arbetstvist, enligt Arbetsdomstolen"},"content":{"rendered":"\n<p><strong><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/2025\/2025-08-06-ad-2025-nr-55\/\">AD <\/a><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/2025\/2025-09-24-ad-2025-nr-68\/\">2025<\/a><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/2025\/2025-08-06-ad-2025-nr-55\/\"> nr 68<\/a><\/strong><\/p>\n\n\n\n<p>Fr\u00e5ga om en tvist om ers\u00e4ttning i form av royalty till formgivaren av ljuslyktan Sn\u00f6bollen var en arbetstvist.<\/p>\n\n\n\n<p>G\u00e4llande r\u00e4ttsliga utg\u00e5ngspunkter f\u00f6r tvisten angav Arbetsdomstolen bl.a. f\u00f6ljande.<\/p>\n\n\n\n<p>En grundl\u00e4ggande f\u00f6ruts\u00e4ttning f\u00f6r att en tvist ska vara en arbetstvist \u00e4r att det finns ett p\u00e5g\u00e5ende eller avslutat anst\u00e4llningsf\u00f6rh\u00e5llande eller att tvisten avser just detta. Vidare kr\u00e4vs att tvisten grundar sig p\u00e5 anst\u00e4llningsf\u00f6rh\u00e5llandet eller har en klar och f\u00f6r tvistens bed\u00f6mning r\u00e4ttslig relevant anknytning till anst\u00e4llningsf\u00f6rh\u00e5llandet (se bl.a. AD 2012 nr 85 och NJA 2022 s. 179). Det ska allts\u00e5 normalt i arbetstvister om krav p\u00e5 ers\u00e4ttning finnas eller ha funnits ett anst\u00e4llningsf\u00f6rh\u00e5llande mellan borgen\u00e4ren och g\u00e4lden\u00e4ren.<\/p>\n\n\n\n<p>Enligt g\u00e4llande r\u00e4tt \u00f6verg\u00e5r som huvudregel de r\u00e4ttigheter och skyldigheter p\u00e5 grund av de anst\u00e4llningsavtal och anst\u00e4llningsf\u00f6rh\u00e5llanden som g\u00e4ller vid tidpunkten f\u00f6r en verksamhets\u00f6verg\u00e5ng p\u00e5 den nya arbetsgivaren (6 b \u00a7 anst\u00e4llningsskyddslagen). Best\u00e4mmelsen om automatisk \u00f6verg\u00e5ng av anst\u00e4llningsavtal, dvs. automatiskt partsbyte, inf\u00f6rdes mot bakgrund av Sveriges intr\u00e4de i den Europeiska Unionen i mitten av 1990-talet. Innan dess fanns det ingen generell reglering av vilken inverkan som en f\u00f6retags\u00f6verl\u00e5telse hade p\u00e5 anst\u00e4llningsf\u00f6rh\u00e5llanden. I st\u00e4llet till\u00e4mpades allm\u00e4nna avtalsr\u00e4ttsliga regler om partsbyte. Det innebar att arbetsgivaren, inte utan arbetstagarens samtycke, kunde \u00f6verl\u00e5ta f\u00f6rpliktelserna enligt anst\u00e4llningsavtalet. Arbetsgivaren kunde allts\u00e5 inte ensidigt flytta \u00f6ver sin partsst\u00e4llning med dess r\u00e4ttigheter och skyldigheter. En f\u00f6retags\u00f6verl\u00e5telse medf\u00f6rde p\u00e5 den tiden att det uppstod arbetsbrist i verksamheten, vilket var saklig grund f\u00f6r upps\u00e4gning. En uppsagd arbetstagare kunde d\u00e4remot enligt d\u00e5varande best\u00e4mmelser ha viss f\u00f6retr\u00e4desr\u00e4tt till \u00e5teranst\u00e4llning i den gamla verksamheten hos den nya arbetsgivaren. Det r\u00f6rde sig d\u00e5 om en ny anst\u00e4llning och den nya arbetsgivaren var d\u00e4rf\u00f6r i princip enbart ansvarig f\u00f6r f\u00f6rpliktelser enligt det nya anst\u00e4llningsavtalet fr\u00e5n \u00f6verg\u00e5ngen (se prop. 1994\/95:102 s. 23 och s. 39 f.).<\/p>\n\n\n\n<p>I det aktuella fallet gjorde Arbetsdomstolen f\u00f6ljande bed\u00f6mning.<\/p>\n\n\n\n<p>Arbetsdomstolen fann att formgivaren var anst\u00e4lld hos ett glasbruk \u2013 \u00c5forsgruppen \u2013 p\u00e5 1970-talet n\u00e4r hon formgav Sn\u00f6bollen. Det var ostridigt att \u00c5forsgruppens verksamhet, i vilken Sn\u00f6bollen formgavs, genom flera f\u00f6retags\u00f6verl\u00e5telser fram till \u00e5r 1990 \u00f6verl\u00e5tits till Orrefors Kosta Boda AB (\u201dBolaget\u201d). Detta inneb\u00e4r dock inte n\u00f6dv\u00e4ndigtvis att Bolaget skulle ses som tidigare arbetsgivare eller att tvisten var en arbetstvist, anf\u00f6rde Arbetsdomstolen.<\/p>\n\n\n\n<p>Arbetsdomstolen framh\u00f6ll att det varken hade p\u00e5st\u00e5tts eller visats att parterna skulle ha avtalat om att f\u00f6rpliktelserna enligt formgivarens anst\u00e4llningsavtal \u00f6verg\u00e5tt till Bolaget; inte heller hade formgivaren p\u00e5st\u00e5tt att hon var eller hade varit arbetstagare hos Bolaget. Arbetsdomstolens slutsats var d\u00e4rmed att tvisten mellan formgivaren och Bolaget inte var en arbetstvist, trots att hon skapade Sn\u00f6bollen inom ramen f\u00f6r ett anst\u00e4llningsf\u00f6rh\u00e5llande med ett annat bolag.<\/p>\n\n\n\n<p>Arbetsdomstolen fann allts\u00e5 att tvisten inte var en arbetstvist. D\u00e4rmed var varken Arbetsdomstolen eller tingsr\u00e4tten beh\u00f6rig domstol. D\u00e5 k\u00e4randen inte hade yrkat att m\u00e5let skulle \u00f6verl\u00e4mnas till Patent- och marknadsdomstolen ans\u00e5g Arbetsdomstolen inte att best\u00e4mmelsen i 2 kap. 7 \u00a7 andra stycket arbetstvistlagen \u2013 om \u00f6verl\u00e4mnande till hovr\u00e4tt \u2013 var till\u00e4mplig. \u00d6verklagandet till Arbetsdomstolen avvisades d\u00e4rf\u00f6r, vilket innebar att tingsr\u00e4ttens avvisningsbeslut stod fast.<\/p>\n\n\n\n<p>Som f\u00f6rlorande part \u00e5lades formgivaren att betala Bolagets r\u00e4tteg\u00e5ngskostnader.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/\" target=\"_blank\" rel=\"noreferrer noopener\">L\u00e4s fler domar p\u00e5 Arbetsdomstolens hemsida<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>AD 2025 nr 68 Fr\u00e5ga om en tvist om ers\u00e4ttning i form av royalty till formgivaren av ljuslyktan Sn\u00f6bollen var en arbetstvist.
