Under arbetsf\u00f6rbudet fick l\u00e4rarna \u2013 i enlighet med g\u00e4llande regler \u2013 inte l\u00f6n fr\u00e5n kommunerna utan ans\u00f6kte om och beviljades graviditetspenning fr\u00e5n F\u00f6rs\u00e4kringskassan, vilket innebar en l\u00e4gre ers\u00e4ttning. Enligt EU:s s.k. m\u00f6draskyddsdirektiv ska gravida arbetstagare som f\u00f6rbjuds att arbeta pga. risk f\u00f6r hennes eller barnets s\u00e4kerhet eller h\u00e4lsa tillf\u00f6rs\u00e4kras bibeh\u00e5llna r\u00e4ttigheter. L\u00e4rarnas fackf\u00f6rbund, Sveriges L\u00e4rare, v\u00e4ckte talan och yrkade att kommunerna, l\u00e4rarnas arbetsgivare, skulle betala dels l\u00f6n motsvarande mellanskillnaden mellan graviditetspenningen och deras l\u00f6ner, dels diskrimineringsers\u00e4ttning enligt diskrimineringslagen.<\/p>\n\n\n\n<p>Parterna i m\u00e5let tvistade d\u00e4rvid om en best\u00e4mmelse i m\u00f6draskyddsdirektivet gav l\u00e4rarna r\u00e4tt till l\u00f6n p\u00e5 en viss niv\u00e5 samt om best\u00e4mmelsen har s.k. direkt effekt och d\u00e4rf\u00f6r skulle till\u00e4mpas av kommunerna.<\/p>\n\n\n\n<p>Till bakgrunden h\u00f6r att H\u00f6gsta f\u00f6rvaltningsdomstolen nyligen tagit st\u00e4llning i fr\u00e5gan om F\u00f6rs\u00e4kringskassans skyldighet att tillgodose kraven enligt m\u00f6draskyddsdirektivet, och kommit fram till att direktivets best\u00e4mmelser inte ska till\u00e4mpas med direkt effekt av F\u00f6rs\u00e4kringskassan (HFD 2025 ref. 18).<\/p>\n\n\n\n<p>I det nu aktuella m\u00e5let hade Arbetsdomstolen att ta st\u00e4llning till bl.a. f\u00f6ljande fr\u00e5gor:<\/p>\n\n\n\n<p><strong>1.<\/strong> Har artikel 11.1 i m\u00f6draskyddsdirektivet direkt effekt i svensk r\u00e4tt och \u00e4r kommunerna skyldiga att till\u00e4mpa artikeln?<\/p>\n\n\n\n<p><strong>2.<\/strong> Vilken ers\u00e4ttning har de tv\u00e5 l\u00e4rarna r\u00e4tt till?<\/p>\n\n\n\n<p><strong>3.<\/strong> Har kommunerna diskriminerat arbetstagarna p\u00e5 grund av k\u00f6n (graviditet)?<\/p>\n\n\n\n<p><strong>4.<\/strong> Ska diskrimineringsers\u00e4ttning utg\u00e5, och i s\u00e5 fall med vilket belopp?<\/p>\n\n\n\n<p>Arbetsdomstolen gjorde d\u00e4rvid f\u00f6ljande bed\u00f6mning i dessa fr\u00e5gor:<\/p>\n\n\n\n<p><strong><u>Fr\u00e5ga 1<\/u><\/strong><\/p>\n\n\n\n<p>Arbetsdomstolen fann att r\u00e4tten till bibeh\u00e5llen inkomst enligt artikel 11.1 i m\u00f6draskyddsdirektivet har direkt effekt. Arbetsdomstolen fann vidare att kommunerna, i egenskap av offentliga arbetsgivare, var skyldiga att till\u00e4mpa direktivet direkt n\u00e4r nationell r\u00e4tt inte uppfyller dess krav.<\/p>\n\n\n\n<p>Enligt Arbetsdomstolen kunde det ligga n\u00e4ra till hands att g\u00f6ra g\u00e4llande r\u00e4tten till h\u00f6gre ers\u00e4ttning hos F\u00f6rs\u00e4kringskassan, men genom HFD:s dom (HFD 2025 ref. 18) har HFD emellertid slagit fast att m\u00f6draskyddsdirektivets best\u00e4mmelser inte ska till\u00e4mpas med direkt effekt av F\u00f6rs\u00e4kringskassan. HFD:s avg\u00f6rande inneb\u00e4r d\u00e4rmed att l\u00e4rarna, som alternativ till bibeh\u00e5llen l\u00f6n fr\u00e5n arbetsgivaren, inte har m\u00f6jlighet att f\u00e5 ytterligare ers\u00e4ttning fr\u00e5n F\u00f6rs\u00e4kringskassan med st\u00f6d av m\u00f6draskyddsdirektivet. En m\u00f6jlig l\u00f6sning \u00e4r d\u00e5 att l\u00e4rarna beg\u00e4r skadest\u00e5nd fr\u00e5n staten pga. felaktigt inf\u00f6rlivande av direktivet, men den m\u00f6jligheten b\u00f6r inte \u2013 enligt Arbetsdomstolen \u2013 utesluta att l\u00e4rarna kan beg\u00e4ra ers\u00e4ttningen direkt fr\u00e5n den offentliga arbetsgivaren, deras kommuner, som har ett eget ansvar f\u00f6r att EU-r\u00e4ttsliga regler iakttas.<\/p>\n\n\n\n<p><strong><u>Fr\u00e5ga 2<\/u><\/strong><\/p>\n\n\n\n<p>EU-domstolen har, i domen Gassmayr, slagit fast att artikel 11.1 i m\u00f6draskyddsdirektivet har den inneb\u00f6rden att en gravid arbetstagare som f\u00f6rbjuds att arbeta i enlighet med artikel 5.3 har r\u00e4tt till en inkomst som motsvarar hennes grundl\u00f6n samt de delar av l\u00f6nen eller de till\u00e4gg som h\u00e4nf\u00f6r sig till hennes tj\u00e4nstest\u00e4llning. Mot den bakgrunden ans\u00e5g Arbetsdomstolen att de tv\u00e5 l\u00e4rarna \u2013 under de perioder som kommunernas beslut om arbetsf\u00f6rbud har avsett \u2013 haft r\u00e4tt till bibeh\u00e5llen inkomst motsvarande deras grundl\u00f6n och, i den ena l\u00e4rarens fall, \u00e4ven tj\u00e4nstetill\u00e4gg.<\/p>\n\n\n\n<p>Graviditetspenningen fr\u00e5n F\u00f6rs\u00e4kringskassan ans\u00e5gs inte tillr\u00e4cklig. Kommunerna var d\u00e4rf\u00f6r skyldiga att betala mellanskillnaden som l\u00f6n.<\/p>\n\n\n\n<p><strong><u>Fr\u00e5ga 3<\/u><\/strong><\/p>\n\n\n\n<p>Att l\u00e4rarna haft en v\u00e4sentligt l\u00e4gre inkomst \u00e4n vad de skulle ha haft om de arbetat i ordinarie omfattning ans\u00e5gs ha inneburit en s\u00e5dan nackdel som \u00e4r att anse som ett missgynnande i diskrimineringslagen mening. Arbetsdomstolen ans\u00e5g vidare att missgynnandet haft ett rakt orsakssamband med l\u00e4rarnas k\u00f6n; sambandet stod klart genom omst\u00e4ndigheten att missgynnandet (inkomstminskningen) f\u00f6ljde av hur regelverket f\u00f6r ers\u00e4ttningen var uppbyggt, vilket innebar att det var systematiskt och uteslutande drabbade gravida kvinnor. De ans\u00e5gs d\u00e4rmed ha utsatts f\u00f6r direkt diskriminering.<\/p>\n\n\n\n<p>Arbetsdomstolen fann vidare att kommunerna skulle h\u00e5llas ansvariga f\u00f6r diskrimineringen, genom att inte ha tillgodosett deras anspr\u00e5k p\u00e5 bibeh\u00e5llen l\u00f6n. Detta g\u00e4llde \u00e4ven om kommunerna inte haft n\u00e5gon diskriminerande avsikt med sitt agerande. Enligt principen om EU-r\u00e4ttens f\u00f6retr\u00e4de hade kommunerna varit skyldiga att \u00e5sidos\u00e4tta nationell r\u00e4tt som stod i strid med EU-r\u00e4tten, och de skulle ha till\u00e4mpat artikel 11.1 i m\u00f6draskyddsdirektivet.<\/p>\n\n\n\n<p><strong><u>Fr\u00e5ga 4<\/u><\/strong><\/p>\n\n\n\n<p>Vid en samlad bed\u00f6mning ans\u00e5g Arbetsdomstolen att sk\u00e4lig diskrimineringsers\u00e4ttning till l\u00e4rarna uppgick till 60&nbsp;000 kr vardera. Arbetsdomstolen ans\u00e5g emellertid \u00e4ven att det fanns omst\u00e4ndigheter som talade f\u00f6r en j\u00e4mkning av beloppet. Domstolen framh\u00f6ll d\u00e4rvid att kommunerna hade agerat i enlighet med det svenska regelverket, och fr\u00e5n deras perspektiv m\u00e5ste skyldigheten att \u00e5sidos\u00e4tta dessa regler ha tett sig fr\u00e4mmande. Arbetsdomstolen ans\u00e5g att kommunerna i viss mening kunde s\u00e4gas ha agerat i god tro.
