Bolaget Braathens Crew AB (Braathens Crew) tr\u00e4ffade skriftliga anst\u00e4llningsavtal med piloter, och hyrde enligt skriftligt avtal om bemanningstj\u00e4nster ut dem till ett annat bolag, Braathens Support AB (Braathens Support), som sedan enligt ett skriftligt avtal om entreprenad av bes\u00e4ttningstj\u00e4nster s\u00e4nde dem att arbeta hos flygbolaget Braathens International Airways AB (Braathens International Airways).<\/p>\n\n\n\n<p>Tv\u00e5 piloter, som hade skrivit p\u00e5 anst\u00e4llningsavtal med Braathens Crew, b\u00f6rjade arbetade i Braathens International Airways verksamhet 2023. Det var Braathens Crew som betalade piloternas l\u00f6n, semesterers\u00e4ttning, sociala avgifter och pensionsavs\u00e4ttningar samt hade tecknat f\u00f6rs\u00e4kringar f\u00f6r dem.<\/p>\n\n\n\n<p>Piloternas fackf\u00f6rening beg\u00e4rde f\u00f6rhandling r\u00f6rande piloterna hos flygbolaget Braathens International Airways, d\u00e4r fackf\u00f6reningen p\u00e5stod att piloterna var arbetstagare. Fr\u00e5gan som facket beg\u00e4rde f\u00f6rhandling om avs\u00e5g om piloterna var anst\u00e4llda hos Braathens International Airways. Braathens International Airways f\u00f6rhandlade inte och f\u00f6rklarade att det ans\u00e5g att det inte var f\u00f6rhandlingsskyldigt, eftersom bolaget menade att det inte hade n\u00e5gra arbetstagare som var medlemmar i f\u00f6reningen. &nbsp;<\/p>\n\n\n\n<p>M\u00e5let g\u00e4llde huruvida Braathens International Airways var skyldigt att betala skadest\u00e5nd till facket f\u00f6r brott mot f\u00f6rhandlingsskyldigheten enligt 10 \u00a7 MBL, som f\u00f6reskriver att en arbetstagarorganisation har r\u00e4tt till f\u00f6rhandling med arbetsgivare i fr\u00e5ga r\u00f6rande f\u00f6rh\u00e5llande mellan arbetsgivaren och s\u00e5dan medlem i organisationen, som \u00e4r eller har varit arbetstagare hos arbetsgivaren.<\/p>\n\n\n\n<p>Fackf\u00f6reningen gjorde ocks\u00e5 g\u00e4llande att arrangemanget med de tre systerbolagen syftade till att kringg\u00e5 lagstiftning till skydd f\u00f6r arbetstagare och lagstiftning om arbetstagarinflytande.<\/p>\n\n\n\n<p>I det aktuella m\u00e5let konstaterade Arbetsdomstolen att det var ostridigt att piloterna ingick skriftliga anst\u00e4llningsavtal med Braathens Crew och inte med Braathens International Airways. Det var vidare ostridigt att Braathens Crew, och inte Braathens International Airways, tillhandah\u00f6ll dem l\u00f6n och annan ers\u00e4ttning samt f\u00f6rm\u00e5ner. Enligt Arbetsdomstolen var det ocks\u00e5 utrett att anledningarna till att piloterna arbetade i Braathens International Airways verksamhet var att det bolaget hade ett skriftligt avtal med Braathens Support \u2013 och inte med piloterna \u2013 om det och att Braathens Support, genom sin schemal\u00e4ggning, hade beordrat piloterna att g\u00f6ra det. Enligt Arbetsdomstolen talade dessa f\u00f6rh\u00e5llanden med styrka f\u00f6r att piloterna inte var arbetstagare hos Braathens International Airways, trots att de arbetade i det bolagets verksamhet. Bara om fackf\u00f6reningen kunde styrka omst\u00e4ndigheter som visade att Braathens International Airways, p\u00e5 avtalsm\u00e4ssig grund, ut\u00f6vade kontroll och ledningen \u00f6ver piloterna skulle det, enligt Arbetsdomstolens mening, kunna vara aktuellt att anse att piloterna var arbetstagare d\u00e4r.<\/p>\n\n\n\n<p>Arbetsdomstolen fann sammantaget att fackf\u00f6reningen inte hade visat att Braathens International Airways, ut\u00f6ver vad som f\u00f6ljde av lagstiftning, ut\u00f6vade kontroll och ledning \u00f6ver piloterna n\u00e4r de arbetade i flygbolagets verksamhet. Kontrollerandet var s\u00e5ledes inte uttryck f\u00f6r ett avtalsf\u00f6rh\u00e5llande, eftersom det just f\u00f6ljde av lagstiftning. Att Braathens International Airways \u2013 i enlighet med offentligr\u00e4ttslig lagstiftning \u2013 bl.a. utf\u00e4rdade manualer, checklistor och rutiner med detaljerade generella instruktioner om hur arbetet skulle utf\u00f6ras och om arbetstid, som Braathens Support \u00e5tog sig att f\u00f6lja, innebar att Braathens International Airways hade ett v\u00e4sentligt inflytande \u00f6ver hur och hur mycket piloterna arbetade \u2013 men enligt Arbetsdomstolens mening innebar det inte att Braathens International Airways kunde s\u00e4gas ha ut\u00f6vat l\u00f6pande kontroll och ledning \u00f6ver piloterna p\u00e5 ett s\u00e4tt som var relevant f\u00f6r bed\u00f6mningen av om piloterna p\u00e5 grund av avtal var arbetstagare hos det bolaget.<\/p>\n\n\n\n<p>Enligt Arbetsdomstolen innebar inte heller det f\u00f6rh\u00e5llandet att Braathens International Airways tillhandah\u00f6ll luftfartyg f\u00f6r arbetet och best\u00e4mde n\u00e4r och vart de skulle flygas att Braathens International Airways ut\u00f6vade l\u00f6pande kontroll och ledning \u00f6ver piloterna. Samma slutsats gjorde Arbetsdomstolen kring att det var Braathens International Airways som tillhandah\u00f6ll piloterna uniformer, id-handlingar, it-utrustning och utbildning.<\/p>\n\n\n\n<p>Ist\u00e4llet bed\u00f6mde Arbetsdomstolen att det var Braathens Support, som genom sin schemal\u00e4ggning av piloterna, i den utstr\u00e4ckning offentligr\u00e4ttslig lagstiftning medgav det, ut\u00f6vade l\u00f6pande ledning \u00f6ver piloterna och i praktiken best\u00e4mde n\u00e4r, var och med vad de skulle arbeta i vilken befattning (s\u00e5som bef\u00e4lhavare [kapten] eller styrman). Utifr\u00e5n vittnesuppgifter ans\u00e5g Arbetsdomstolen vidare att det var utrett att Braathens Supports bes\u00e4ttningschef var piloternas n\u00e4rmaste chef och hade personalansvaret f\u00f6r dem. Arbetsdomstolens sammanfattade bed\u00f6mning var s\u00e5ledes att fackf\u00f6reningen inte hade visat att Braathens International Airways ut\u00f6vade kontroll och ledning \u00f6ver piloterna n\u00e4r de arbetade i bolagets verksamhet, ut\u00f6ver vad som f\u00f6ljde av lagstiftning. Det kunde d\u00e4rmed inte komma ifr\u00e5ga att anse att piloterna, trots de skriftliga anst\u00e4llningsavtalen med Braathens Crew och avtalet mellan Braathens International Airways och Braathens support, var arbetstagare hos Braathens International Airways.<\/p>\n\n\n\n<p>Eftersom fackf\u00f6reningen inte visat att den hade n\u00e5gon medlem som var arbetstagare hos Braathens International Airways hade flygbolaget ingen f\u00f6rhandlingsskyldighet gentemot fackf\u00f6reningen. Skadest\u00e5ndstalan avslogs d\u00e4rmed och fackf\u00f6reningen \u00e5lades att betala bolagets r\u00e4tteg\u00e5ngskostnader med en miljon kronor.<\/p>\n\n\n\n<p>Arbetsdomstolen ans\u00e5g inte heller att bolaget hade kringg\u00e5tt 10 \u00a7 MBL genom arrangemanget med de tre systerbolagen.<\/p>\n\n\n\n<p>Tv\u00e5 av Arbetsdomstolens ledam\u00f6ter var skiljaktiga och ans\u00e5g att piloterna fr\u00e4mst stod under Braathens International Airways kontroll och ledning n\u00e4r de utf\u00f6rde arbete i det bolagets verksamhet och att detta medf\u00f6rde att piloterna var arbetstagare hos det bolaget i den mening som avses i 10 \u00a7 MBL. Enligt deras mening skulle Braathens International Airways d\u00e4rf\u00f6r betala allm\u00e4nt skadest\u00e5nd till fackf\u00f6reningen f\u00f6r brott mot 10 \u00a7 MBL f\u00f6r sin underl\u00e5tenhet att f\u00f6rhandla med f\u00f6reningen.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/\" target=\"_blank\" rel=\"noreferrer noopener\">L\u00e4s fler domar p\u00e5 Arbetsdomstolens hemsida<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>AD 2025 nr 55 Fr\u00e5ga om ett bolag var skadest\u00e5ndsskyldigt f\u00f6r brott mot f\u00f6rhandlingsskyldigheten enligt medbest\u00e4mmandelagen (MBL).
