De yrkade i f\u00f6rsta hand p\u00e5 att man skulle anv\u00e4nda en divisor som varierar beroende p\u00e5 antal dagar i m\u00e5naden, och i andra hand p\u00e5 en fast divisor baserad p\u00e5 genomsnittlig arbetstid under en 28-\u00e5rscykel (ca 167,6 timmar).<\/p>\n\n\n\n<p><strong>Kompetensf\u00f6retagen<\/strong> motsatte sig detta. Vi menade att det inte fanns n\u00e5got fastst\u00e4llelseintresse, att avtalet inte till\u00e4t att divisorn fastst\u00e4lls och att Transports alternativa divisorer i vart fall var felaktiga eftersom de skulle leda till att ers\u00e4ttning f\u00f6r helgdagar (helgl\u00f6n) skulle betalas ut dubbelt. En mer avtalsenlig divisor skulle vara 174.<\/p>\n\n\n\n<p><strong>AD<\/strong> ans\u00e5g att fr\u00e5gan kunde pr\u00f6vas och att bemanningsavtalet till\u00e4t att man fastst\u00e4ller en divisor. Men Transports utredning gav inte n\u00e5got st\u00f6d f\u00f6r deras alternativa divisorer. Helgl\u00f6n hade reglerats s\u00e4rskilt i bemanningsavtalet och detta talade f\u00f6r att helgl\u00f6nen inte ocks\u00e5 skulle beaktas vid omr\u00e4kning fr\u00e5n m\u00e5nadsl\u00f6n hos kund till timl\u00f6n f\u00f6r bemanningsanst\u00e4llda.
