{"id":79618,"date":"2025-05-16T15:03:51","date_gmt":"2025-05-16T13:03:51","guid":{"rendered":"https:\/\/www.almega.se\/?p=79618"},"modified":"2025-05-16T15:04:00","modified_gmt":"2025-05-16T13:04:00","slug":"anstallda-hos-arbetsgivaren-eller-ett-bemanningsforetag-vid-utforande-av-visst-arbete","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2025\/05\/anstallda-hos-arbetsgivaren-eller-ett-bemanningsforetag-vid-utforande-av-visst-arbete\/","title":{"rendered":"Anst\u00e4llda hos arbetsgivaren eller ett bemannings&shy;f\u00f6retag vid utf\u00f6rande av visst arbete?"},"content":{"rendered":"\n<p><strong><a href=\"https:\/\/www.almega.se\/app\/uploads\/2025\/05\/Dom-29-2025.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">AD 2025 nr 29<\/a><\/strong><\/p>\n\n\n\n<p>Fr\u00e5ga om tv\u00e5 taxichauff\u00f6rer varit anst\u00e4llda hos arbetsgivaren (Bolaget) vid utf\u00f6randet av visst arbete, som gjorts ut\u00f6ver heltidsarbete f\u00f6r arbetsgivaren, eller om de vid utf\u00f6randet av det arbetet varit anst\u00e4llda hos ett bemanningsf\u00f6retag som arbetsgivaren anlitat.<\/p>\n\n\n\n<p>Svenska Transportarbetaref\u00f6rbundet (Transport) f\u00f6retr\u00e4dda de tv\u00e5 arbetstagarna och gjorde g\u00e4llande att Bolaget brutit mot g\u00e4llande kollektivavtal, Taxiavtalet, genom att de tv\u00e5 arbetstagarna arbetat \u00f6vertid hos Bolaget och d\u00e4rmed hade r\u00e4tt till viss \u00f6vertids- och semesterers\u00e4ttning som Bolaget inte hade betalat. Transport yrkade \u00e4ven allm\u00e4nt skadest\u00e5nd f\u00f6r kollektivavtalsbrott, dels till arbetstagarna och dels till Transport.<\/p>\n\n\n\n<p>Arbetsgivarparterna gjorde en preskriptionsinv\u00e4ndning i m\u00e5let. Arbetsdomstolen fann dock att talan inte var preskriberad. Detta eftersom Arbetsdomstolen, bl.a. med h\u00e4nvisning till tidigare praxis, fann att Transport inte \u201dhaft k\u00e4nnedom\u201d om de omst\u00e4ndigheter som yrkandena i m\u00e5let h\u00e4nf\u00f6rde sig till redan vid den tidigare tidpunkt som arbetsgivarparterna p\u00e5stod. Det hade bl.a. f\u00f6rekommit en tidigare f\u00f6rhandling men Arbetsdomstolen fann dels att de tv\u00e5 arbetstagarna inte hade n\u00e4mnts vid den tvistef\u00f6rhandlingen, dels att det vid den tidpunkten inte heller fanns n\u00e5got konkret p\u00e5st\u00e5ende om att n\u00e5gon viss arbetstagare arbetat \u00f6vertid utan att f\u00e5 \u00f6vertidsers\u00e4ttning. Enligt Arbetsdomstolen kunde de generella uppgifterna om att \u00f6vertidsarbete inte f\u00f6rekom s\u00e5ledes inte anses inneb\u00e4ra att Transport hade f\u00e5tt k\u00e4nnedom om de omst\u00e4ndigheter som yrkandena i detta m\u00e5l h\u00e4nf\u00f6rde sig till.<\/p>\n\n\n\n<p>I m\u00e5lets huvudsakliga tvistefr\u00e5ga gjorde Transport g\u00e4llande att de tv\u00e5 arbetstagarna hade arbetat 408 respektive 1 002 timmar ut\u00f6ver ordinarie arbetstid hos Bolaget, vilket utgjorde \u00f6vertid enligt kollektivavtalet, vilket i sin tur innebar att de hade r\u00e4tt till \u00f6vertidsers\u00e4ttning enligt Taxiavtalet. D\u00e5 den ena arbetstagaren avslutat sin anst\u00e4llning hos Bolaget menade Transport \u00e4ven att denne \u00e4ven hade r\u00e4tt till obetald semesterers\u00e4ttning p\u00e5 intj\u00e4nad \u00f6vertidsers\u00e4ttning.<\/p>\n\n\n\n<p>Arbetsgivarparterna gjorde \u00e5 sin sida g\u00e4llande att de tv\u00e5 arbetstagarna inte hade arbetat \u00f6vertid, och bestred d\u00e4rmed att Bolaget \u00e5dragit sig skyldighet att betala \u00f6vertidsers\u00e4ttning, semesterers\u00e4ttning eller skadest\u00e5nd pga. kollektivavtalsbrott. Enligt Bolaget hade de tv\u00e5 arbetstagarna inte utf\u00f6rt det p\u00e5st\u00e5dda arbetet i egenskap av anst\u00e4llda hos Bolaget och f\u00f6r Bolagets r\u00e4kning. Bolaget h\u00e4vdade ist\u00e4llet att arbetstagarna, vid utf\u00f6randet av det p\u00e5st\u00e5dda \u00f6vertidsarbetet, varit anst\u00e4llda hos ett bemanningsf\u00f6retag \u2013 som Bolaget anlitat f\u00f6r bemanning.<\/p>\n\n\n\n<p>Bemanningsf\u00f6retaget var en underleverant\u00f6r\/underentrepren\u00f6r som Bolaget anlitat och Bolaget tillhandah\u00f6ll bl.a. fordon, arbetskl\u00e4der och annan arbetsutrustning. Arbetstagarna hade f\u00e5tt l\u00f6n och l\u00f6nebesked bemanningsf\u00f6retaget, och inte fr\u00e5n Bolaget, avseende det p\u00e5st\u00e5dda \u00f6vertidsarbetet.<\/p>\n\n\n\n<p>Det var ostridigt att de tv\u00e5 arbetstagarna var anst\u00e4llda hos Bolaget, samt att de omtvistade arbetspassen gjordes inom ramen f\u00f6r Bolagets verksamhet. Arbetsdomstolen framh\u00f6ll att det var arbetsgivarparterna som hade bevisb\u00f6rdan f\u00f6r att de tv\u00e5 arbetstagarna gjorde arbetspassen som anst\u00e4llda hos bemanningsf\u00f6retaget och inte hos Bolaget. Arbetsdomstolens slutsats blev att arbetsgivarsidan inte lyckades bevisa detta.<\/p>\n\n\n\n<p>Domstolen beaktade bl.a. att det inte hade presenterats n\u00e5gon utredning till st\u00f6d f\u00f6r att det uttryckligen hade ing\u00e5tts anst\u00e4llningsavtal mellan bemanningsf\u00f6retaget och de tv\u00e5 arbetstagarna (varken skriftligt eller muntligt). Enligt Arbetsdomstolen framkom det inte heller i \u00f6vrigt s\u00e5dana omst\u00e4ndigheter som kunde visa att det \u00e4nd\u00e5 f\u00f6rel\u00e5g anst\u00e4llningsf\u00f6rh\u00e5llanden mellan de tv\u00e5 arbetstagarna och bemanningsf\u00f6retaget.<\/p>\n\n\n\n<p>Att de tv\u00e5 arbetstagarna, under en f\u00f6rh\u00e5llandevis l\u00e5ng period, f\u00e5tt l\u00f6n fr\u00e5n bemanningsf\u00f6retaget kunde, enligt Arbetsdomstolen, tala f\u00f6r att de varit anst\u00e4llda \u00e4ven hos det bolaget. Arbetstagarna hade emellertid f\u00f6rnekat att de skulle ha varit anst\u00e4llda \u00e4ven d\u00e4r och ber\u00e4ttat att de inte haft kontakt med n\u00e5gon f\u00f6retr\u00e4dare f\u00f6r bemanningsf\u00f6retaget. De hade vidare ifr\u00e5gasatt varf\u00f6r de f\u00e5tt l\u00f6n fr\u00e5n bemanningsf\u00f6retaget, och deras n\u00e4rmaste chefer och kollegor hade d\u00e5 sagt att de inte skulle bry sig om det d\u00e5 bemanningsf\u00f6retaget och Bolaget \u201dvar samma bolag eller verksamhet\u201d. Arbetsdomstolen beaktade \u00e4ven att de tv\u00e5 arbetstagarna enbart utf\u00f6rt k\u00f6rningar inom ramen f\u00f6r Bolagets uppdrag f\u00f6r Sk\u00e5ne- och Blekingetrafiken, samt att dessa k\u00f6rningar skett med Bolagets fordon och med Bolagets kl\u00e4der. Arbetsdomstolen noterade vidare att Bolaget och bemanningsf\u00f6retaget hade samma adress och samma \u00e4garf\u00f6rh\u00e5llanden, samt att arbetstagarna hade samma anst\u00e4llningsnummer i Bolaget och i bemanningsf\u00f6retaget (enligt l\u00f6nespecifikationerna). Enligt Arbetsdomstolen framstod det n\u00e4rmast som att de tv\u00e5 bolagens verksamheter varit sammanblandade.<\/p>\n\n\n\n<p>Sammantaget ans\u00e5g Arbetsdomstolen allts\u00e5 att det inte var visat att de tv\u00e5 arbetstagarna varit anst\u00e4llda hos bemanningsf\u00f6retaget. De arbetspass som var aktuella i m\u00e5let fick d\u00e4rmed anses ha gjorts inom ramen f\u00f6r deras anst\u00e4llningar hos Bolaget. Arbetsdomstolen fann vidare att det ans\u00e5gs visat att merparten av arbetet ifr\u00e5ga faktiskt hade utf\u00f6rts, och varit beordrat eller godk\u00e4nt i efterhand av Bolaget. Betr\u00e4ffande den ena arbetstagaren ans\u00e5gs det dock inte bevisat att han arbetat \u00f6vertid i september 2021, varf\u00f6r just detta yrkande avslogs \u2013 d\u00e4remot bif\u00f6lls yrkandet om \u00f6vertidsers\u00e4ttning \u00e4ven f\u00f6r honom avseende resterande m\u00e5nader.<\/p>\n\n\n\n<p>Arbetsdomstolen d\u00f6mde s\u00e5ledes ut \u00f6vertidsers\u00e4ttning till b\u00e4gge, samt semesterers\u00e4ttning p\u00e5 \u00f6vertidsers\u00e4ttningen till den som slutat. Eftersom domstolens slutsats innebar att arbetsgivaren brutit mot Taxiavtalet d\u00f6mdes det \u00e4ven ut allm\u00e4nna skadest\u00e5nd f\u00f6r kollektivavtalsbrott; dels med 50&nbsp;000 kr vardera till arbetstagarna, dels med 150&nbsp;000 kr till f\u00f6rbundet. Arbetsgivarparterna \u00e5lades \u00e4ven att ers\u00e4tta f\u00f6rbundets r\u00e4tteg\u00e5ngskostnader med drygt 491&nbsp;000 kr.<\/p>\n\n\n\n<p><a
