Anledningen som anf\u00f6rdes var att arbetstagaren, vid flera tillf\u00e4llen, l\u00e4mnat arbetsplatsen f\u00f6re arbetstidens slut utan godk\u00e4nnande fr\u00e5n arbetsledare, och d\u00e4rigenom bl.a. brutit mot vad som \u00e5legat honom enligt anst\u00e4llningsavtalet.<\/strong><\/p>\n\n\n\n<p>Tvisten g\u00e4llde huvudsakligen om arbetsgivaren haft sakliga sk\u00e4l f\u00f6r upps\u00e4gningen.<\/p>\n\n\n\n<p>Inledningsvis tog Arbetsdomstolen st\u00e4llning till om, och i vilken utstr\u00e4ckning, arbetsgivaren hade godtagit \u201dtidig hemg\u00e5ng\u201d; dvs. att arbetstagarna l\u00e4mnar arbetsplatsen f\u00f6re arbetstidens slut.<\/p>\n\n\n\n<p>Utifr\u00e5n vad som framkommit i m\u00e5let ans\u00e5g Arbetsdomstolen att tidig hemg\u00e5ng som s\u00e5dan uppenbarligen f\u00f6rekommit l\u00e4nge och varit vanligt f\u00f6rekommande p\u00e5 arbetsplatsen. Enligt Arbetsdomstolen r\u00e5dde det enighet om att tidig hemg\u00e5ng var accepterat, men att det f\u00f6rutsatte att den st\u00e4mts av med arbetsledare. Vid en arbetsplatstr\u00e4ff hade arbetsgivaren t ex f\u00f6rs\u00f6kt komma till r\u00e4tta med brister i avst\u00e4mningen av hemg\u00e5ngen.<\/p>\n\n\n\n<p>Arbetsdomstolen konstaterade att arbetstagaren, vid upprepade tillf\u00e4llen, brutit mot sina skyldigheter enligt anst\u00e4llningsavtalet genom att l\u00e4mna arbetsplatsen i f\u00f6rtid utan tillst\u00e5nd fr\u00e5n arbetsledare. Arbetsdomstolen fann \u00e4ven att det var klarlagt att arbetstagaren hade brutit mot bolagets rutiner efter en incident d\u00e4r en truck orsakat oljel\u00e4ckage. Arbetsdomstolen fann \u00e4ven att arbetstagaren, vid ett datum, medvetet hade l\u00e4mnat felaktiga uppgifter om att han befann sig p\u00e5 arbetsplatsen n\u00e4r han i sj\u00e4lva verket redan begett sig d\u00e4rifr\u00e5n.<\/p>\n\n\n\n<p>Genom detta agerande ans\u00e5g Arbetsdomstolen att arbetstagaren gett intrycket av en allm\u00e4n ovilja att r\u00e4tta sig efter bolagets anvisningar. Enligt Arbetsdomstolen m\u00e5ste arbetstagaren ha f\u00f6rst\u00e5tt att han, upprepade g\u00e5nger, brutit mot vad som \u00e5l\u00e5g honom enligt anst\u00e4llningsavtalet. \u00c4ven om bolaget inte uttryckligen, s\u00e5vitt framkommit, framh\u00e5llit f\u00f6r arbetstagaren att hans anst\u00e4llning var i fara, s\u00e5 visade utredningen \u2013 enligt domstolen \u2013 att bolaget \u00e5terkommande p\u00e5 olika s\u00e4tt p\u00e5talat och f\u00f6rs\u00f6kt komma till r\u00e4tta med just den missk\u00f6tsamhet som arbetstagaren uppvisat. Enligt Arbetsdomstolen hade detta st\u00e5tt klart f\u00f6r arbetstagaren, och enligt domstolen hade arbetstagaren inte haft anledning att anta att bolaget accepterat hans beteende.<\/p>\n\n\n\n<p>Enligt Arbetsdomstolen var m\u00e4ngden, och arten, av brotten mot anst\u00e4llningsavtalet s\u00e5dana att det inte sk\u00e4ligen kunde kr\u00e4vas att arbetsgivaren skulle omplacera arbetstagaren. Arbetsdomstolens slutsats blev d\u00e4rf\u00f6r att det funnits laga sk\u00e4l f\u00f6r bolagets upps\u00e4gning av arbetstagaren.
