{"id":76839,"date":"2024-11-21T14:36:26","date_gmt":"2024-11-21T13:36:26","guid":{"rendered":"https:\/\/www.almega.se\/?p=76839"},"modified":"2024-11-21T14:36:48","modified_gmt":"2024-11-21T13:36:48","slug":"om-ratt-till-ledighet-for-att-bedriva-naringsverksamhet-ledighetslagen","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2024\/11\/om-ratt-till-ledighet-for-att-bedriva-naringsverksamhet-ledighetslagen\/","title":{"rendered":"Om r\u00e4tt till ledighet f\u00f6r att bedriva n\u00e4rings&shy;verksamhet\u00a0 (\u201dledighetslagen\u201d)"},"content":{"rendered":"<p class=\"intro\">Fr\u00e5ga om skadest\u00e5ndsskyldighet f\u00f6r brott mot lagen (1997:1293) om r\u00e4tt till ledighet f\u00f6r att bedriva n\u00e4ringsverksamhet (\u201dledighetslagen\u201d).<\/p>\n\n<p><a href=\"https:\/\/www.almega.se\/app\/uploads\/protected\/2024\/11\/AD-dom-nr-92-24.pdf\">AD 2024 nr 92<\/a><\/p>\n\n\n\n<p>En arbetstagare ans\u00f6kte om hel ledighet fr\u00e5n sin anst\u00e4llning hos arbetsgivaren (\u201dAG 1\u201d) enligt ledighetslagen. Genom ett kollektivavtalsreglerat f\u00f6rfarande hade arbetstagaren, f\u00f6re den ursprungliga ledighetsans\u00f6kan, bl.a. ans\u00f6kt om en befattning p\u00e5 heltid hos ett annat bolag inom koncernen (\u201dAG 2\u201d). Den 17 november 2022 tilldelades arbetstagaren den s\u00f6kta befattningen hos AG 2, men det var inte s\u00e4kert n\u00e4r den befattningen skulle tilltr\u00e4das och n\u00e5gon uppgift om tj\u00e4nstg\u00f6ringsgrad fanns inte heller.<\/p>\n\n\n\n<p>D\u00e4refter justerade arbetstagaren sin ledighetsans\u00f6kan s\u00e5 att ledigheten skulle omfatta perioden 16 april-15 oktober 2023.<\/p>\n\n\n\n<p>Arbetstagaren k\u00e4nde till att AG 1 ans\u00e5g <em>dels<\/em> att en ans\u00f6kan enligt det kollektivavtalsreglerade f\u00f6rfarandet var bindande, <em>dels<\/em> att arbetstagaren var skyldig att tilltr\u00e4da anst\u00e4llningen hos AG 2, <em>dels<\/em> att arbetstagaren \u2013 under anst\u00e4llningen hos AG 2 \u2013 skulle kvarst\u00e5 i anst\u00e4llningen hos AG 1 men vara helt ledig fr\u00e5n den anst\u00e4llningen. Arbetstagaren och dennes fackf\u00f6rbund hade en annan \u00e5sikt om bundenheten vid en ans\u00f6kan enligt det kollektivavtalsreglerade f\u00f6rfarandet.<\/p>\n\n\n\n<p>Den 14 april 2023 meddelade AG 1 arbetstagaren att anst\u00e4llningen hos AG 2 skulle tilltr\u00e4das den 15 maj 2023, och att han d\u00e4rf\u00f6r beviljades hel ledighet enligt ledighetslagen under perioden 16 april-14 maj 2023. AG 1 k\u00e4nde d\u00e5 till att arbetstagaren inte \u00f6nskade tilltr\u00e4da en anst\u00e4llning hos AG 2 den 15 maj 2023.<\/p>\n\n\n\n<p>Under perioden 16 april-14 maj 2023 var arbetstagaren ledig f\u00f6r att bedriva n\u00e4ringsverksamhet och den 15 maj tilltr\u00e4dde arbetstagaren anst\u00e4llningen hos AG 2. Under hela den s\u00f6kta ledighetsperioden utf\u00f6rde arbetstagaren inte n\u00e5got arbete f\u00f6r AG 1.<\/p>\n\n\n\n<p>Parterna i m\u00e5let tvistade om ifall AG 1, genom att meddela arbetstagaren att han beviljades ledighet till bara den 15 maj 2023, br\u00f6t mot ledighetslagen och d\u00e4rf\u00f6r skulle betala allm\u00e4nt skadest\u00e5nd till honom.<\/p>\n\n\n\n<p>AG 1 hade allts\u00e5 meddelat arbetstagaren att han fick ledighet f\u00f6r ungef\u00e4r den f\u00f6rsta m\u00e5naden av den s\u00f6kta ledighetsperioden, till dess han \u2013 enligt AG 1 \u2013 skulle tilltr\u00e4da en annan anst\u00e4llning och d\u00e4rf\u00f6r \u00e4nd\u00e5 skulle vara ledig fr\u00e5n anst\u00e4llningen hos AG 1.<\/p>\n\n\n\n<p>Det var ostridigt att arbetstagaren faktiskt f\u00e5tt vara helt ledig fr\u00e5n anst\u00e4llningen hos AG 1 under hela den s\u00f6kta ledighetsperioden. Fr\u00e5gan var d\u00e5 om AG 1 hade brutit mot ledighetslagen genom att f\u00f6re ledigheten meddela arbetstagaren sitt beslut om ledigheten, som avs\u00e5g ledighet (enligt ledighetslagen) under bara ungef\u00e4r en m\u00e5nad.<\/p>\n\n\n\n<p>Arbetsdomstolen framh\u00f6ll att det stod klart att en arbetsgivare blir skadest\u00e5ndsskyldig enligt ledighetslagen om arbetsgivaren (a) inte alls meddelar arbetstagaren ett beslut om ledigheten, eller (b) meddelar arbetstagaren beslutet senare \u00e4n en m\u00e5nad efter det att ledigheten anm\u00e4ldes (6 \u00a7 ledighetslagen). Detta g\u00e4ller \u00e4ven om arbetsgivaren inte brutit mot arbetstagarens r\u00e4tt till ledighet.<\/p>\n\n\n\n<p>Arbetsdomstolen anf\u00f6rde sedan att det inte helt kan uteslutas att utformningen av ett r\u00e4ttidigt meddelande till arbetstagaren, om arbetsgivarens beslut om ledigheten, n\u00e5gon g\u00e5ng i sig kan vara skadest\u00e5ndsgrundande enligt ledighetslagen.<\/p>\n\n\n\n<p>I det aktuella fallet fann Arbetsdomstolen att AG 1:s meddelande inte kunde anses skadest\u00e5ndsgrundande. Domstolen beaktade d\u00e4rvid bl.a. att det var ostridigt att arbetstagaren k\u00e4nde till att AG 1:s utformning av meddelandet om beslutet om beviljande av ledigheten berodde p\u00e5 att han \u2013 enligt AG 1 \u2013 skulle tilltr\u00e4da en annan anst\u00e4llning och d\u00e4rf\u00f6r vara ledig fr\u00e5n anst\u00e4llningen hos AG 1 resterande del av den s\u00f6kta ledighetsperioden. Av meddelandet framgick inte att AG 1 beslutat att neka arbetstagaren n\u00e5gon ledighet, vilket arbetstagaren hade f\u00f6rst\u00e5tt. Arbetsdomstolen anf\u00f6rde att det f\u00f6rh\u00e5llandet att det kunde varit sv\u00e5rt f\u00f6r arbetstagaren att planera n\u00e4ringsverksamheten inte berodde p\u00e5 utformningen av AG 1:s meddelande i sig, utan p\u00e5 att arbetstagaren s\u00f6kt och tilldelats den andra anst\u00e4llningen hos AG 2.
