{"id":76473,"date":"2024-10-17T16:27:58","date_gmt":"2024-10-17T14:27:58","guid":{"rendered":"https:\/\/www.almega.se\/?p=76473"},"modified":"2024-10-17T16:28:20","modified_gmt":"2024-10-17T14:28:20","slug":"sakliga-skal-for-uppsagning-och-ingen-krankning-av-foreningsratt","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2024\/10\/sakliga-skal-for-uppsagning-och-ingen-krankning-av-foreningsratt\/","title":{"rendered":"Sakliga sk\u00e4l f\u00f6r upps\u00e4gning och ingen kr\u00e4nkning av f\u00f6reningsr\u00e4tt"},"content":{"rendered":"<p class=\"intro\">Fr\u00e5ga om en arbetsgivare haft sakliga sk\u00e4l f\u00f6r upps\u00e4gning pga personliga sk\u00e4l. \u00c4ven fr\u00e5ga om arbetsgivaren, genom upps\u00e4gningen, utsatt arbetstagaren eller dennes arbetstagarorganisation f\u00f6r f\u00f6reningsr\u00e4ttskr\u00e4nkning.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-2024-dom-nr-78\"><a href=\"https:\/\/www.almega.se\/app\/uploads\/2024\/10\/Dom-nr-78-24.pdf\">2024 dom nr 78<\/a><\/h3>\n\n\n\n<p>Arbetstagarorganisationen gjorde g\u00e4llande att dess medlem, TT, blivit uppsagd pga. att han utnyttjat sin f\u00f6reningsr\u00e4tt genom medlemskap i arbetstagarorganisationen och f\u00f6r att han verkat f\u00f6r denna p\u00e5 arbetsplatsen. Enligt arbetstagarorganisationen var arbetsgivarens syfte med upps\u00e4gningen att kr\u00e4nka TT:s f\u00f6reningsr\u00e4tt och att g\u00f6ra intr\u00e5ng i arbetstagarorganisationens verksamhet. Det yrkades dels att upps\u00e4gningen skulle ogiltigf\u00f6rklaras, dels allm\u00e4nt skadest\u00e5nd till TT \u2013 b\u00e5de f\u00f6r brott mot LAS och 8 \u00a7 MBL \u2013 dels allm\u00e4nt skadest\u00e5nd till arbetstagarorganisationen f\u00f6r brott mot 8 \u00a7 MBL.<\/p>\n\n\n\n<p>Arbetsgivaren bestred yrkandena och gjorde g\u00e4llande att det f\u00f6relegat sakliga sk\u00e4l f\u00f6r upps\u00e4gning av TT (personliga sk\u00e4l) pga. olika brister hos honom och pga. det s\u00e4tt p\u00e5 vilket han utf\u00f6rt arbetet. Upps\u00e4gningen hade, enligt arbetsgivaren, inte n\u00e5got samband med TT:s medlemskap i arbetstagarorganisationen eller hans fackliga engagemang.<\/p>\n\n\n\n<p>TT arbetade p\u00e5 ett lager, p\u00e5 avdelningen \u201dplock\u201d, d\u00e4r olika typer av varor ska plockas. Enligt arbetsgivaren hade TT:s missk\u00f6tsamhet bl.a. best\u00e5tt i att han tagit otill\u00e5tna raster, uppvisat en oacceptabel attityd mot chefer, haft m\u00e5nga sena ankomster samt att han uteblivit fr\u00e5n bokade l\u00e4karbes\u00f6k med bl.a. f\u00f6retagsh\u00e4lsov\u00e5rden. Bolaget gjorde \u00e4ven g\u00e4llande att TT:s arbetsprestation under l\u00e5ng tid var alldeles f\u00f6r l\u00e5g och v\u00e4sentligt underskred de m\u00e5l som bolaget satt upp f\u00f6r arbetarna p\u00e5 TT:s avdelning. Enligt bolaget skedde inte f\u00f6rb\u00e4ttring trots uppr\u00e4ttad handlingsplan, flertalet tills\u00e4gelser och skriftliga varningar. \u00c4ven under upps\u00e4gningstiden fortsatte TT att underprestera samt missk\u00f6ta sig p\u00e5 olika s\u00e4tt.<\/p>\n\n\n\n<p>Avseende r\u00e4ttsliga utg\u00e5ngspunkter i m\u00e5let anf\u00f6rde Arbetsdomstolen bl.a. f\u00f6ljande:<\/p>\n\n\n\n<p>\u201d<em>Enligt 7 \u00a7 f\u00f6rsta stycket anst\u00e4llningsskyddslagen ska en upps\u00e4gning fr\u00e5n arbetsgivarens sida grunda sig p\u00e5 sakliga sk\u00e4l. Sakliga sk\u00e4l kan vara arbetsbrist eller f\u00f6rh\u00e5llanden som h\u00e4nf\u00f6r sig till arbetstagaren personligen.<\/em><\/p>\n\n\n\n<p><em>Paragrafen \u00e4ndrades 2022 genom att begreppet saklig grund ersattes av begreppet sakliga sk\u00e4l. Av f\u00f6rarbetena till lag\u00e4ndringen framg\u00e5r f\u00f6ljande. Det \u00f6vergripande syftet med \u00e4ndringen \u00e4r att det f\u00f6r s\u00e5v\u00e4l arbetsgivare som arbetstagare i s\u00e5 h\u00f6g grad som m\u00f6jligt ska g\u00e5 att f\u00f6rutse vad som kr\u00e4vs f\u00f6r att sakliga sk\u00e4l f\u00f6r upps\u00e4gning ska f\u00f6religga. Fr\u00e5gan om det finns sakliga sk\u00e4l ska, liksom tidigare, avg\u00f6ras med utg\u00e5ngspunkt fr\u00e5n om det f\u00f6religger ett tillr\u00e4ckligt allvarligt brott mot f\u00f6rpliktelserna enligt anst\u00e4llningsavtalet eller inte. Det avg\u00f6rande f\u00f6r fr\u00e5gan om sakliga sk\u00e4l f\u00f6religger \u00e4r allts\u00e5 om den anst\u00e4llde p\u00e5 ett allvarligt s\u00e4tt brutit mot anst\u00e4llningsavtalet och om den anst\u00e4llde insett eller bort inse detta. Avg\u00f6randet ska grunda sig p\u00e5 en helhetsbed\u00f6mning av samtliga relevanta omst\u00e4ndigheter. Vid helhetsbed\u00f6mningen ska arbetstagarens personliga f\u00f6rh\u00e5llanden, exempelvis \u00e5lder, sjukdom och funktionsneds\u00e4ttning, v\u00e4gas in liksom hur arbetsgivaren har agerat i det enskilda fallet och i arbetsmilj\u00f6h\u00e4nseende. \u00c4ven bakgrunden och orsaken till de omst\u00e4ndigheter som l\u00e4ggs arbetstagaren till last ska beaktas i bed\u00f6mningen. Det ska dock inte g\u00f6ras n\u00e5gon avv\u00e4gning mot arbetstagarens personliga intresse av att f\u00e5 beh\u00e5lla anst\u00e4llningen vad g\u00e4ller om arbetstagaren har en stor f\u00f6rs\u00f6rjningsb\u00f6rda eller att arbetsmarknaden \u00e4r s\u00e5dan att han eller hon p\u00e5 grund av personliga f\u00f6rh\u00e5llanden kan ha sv\u00e5rt att hitta en ny anst\u00e4llning. Det ska inte heller g\u00f6ras n\u00e5gon prognos om arbetstagaren i framtiden skulle kunna t\u00e4nkas komma att \u00e5sidos\u00e4tta sina skyldigheter i anst\u00e4llningen eller inte. Bortsett fr\u00e5n vad som nu sagts \u00e4r ingen \u00e4ndring av g\u00e4llande r\u00e4tt avsedd i fr\u00e5ga om vad som enligt denna helhetsbed\u00f6mning ska anses utg\u00f6ra ett tillr\u00e4ckligt allvarligt \u00e5sidos\u00e4ttande av arbetstagarens f\u00f6rpliktelser enligt anst\u00e4llningsavtalet f\u00f6r att en upps\u00e4gning av personliga sk\u00e4l ska vara motiverad. Bed\u00f6mningen ska ske utifr\u00e5n lagf\u00f6rarbeten, r\u00e4ttspraxis fr\u00e5n Arbetsdomstolen och andra r\u00e4ttsk\u00e4llor. Inom ramen f\u00f6r helhetsbed\u00f6mningen kvarst\u00e5r det principiella kravet p\u00e5 att vidta mindre ingripande \u00e5tg\u00e4rder som tidigare uppst\u00e4llts. Med mindre ingripande \u00e5tg\u00e4rder avses exempelvis st\u00f6djande \u00e5tg\u00e4rder, tillr\u00e4ttavisningar, varning om att anst\u00e4llningen \u00e4r i fara och omplacering. Det sagda kan antas medf\u00f6ra en \u00f6kad fokusering p\u00e5 fr\u00e5gan om arbetstagaren har gjort sig skyldig till ett tillr\u00e4ckligt allvarligt \u00e5sidos\u00e4ttande av sina skyldigheter enligt anst\u00e4llningsavtalet, och vad han eller hon har insett om detta d\u00e4r fr\u00e5gan om arbetstagarens insikt \u00e4r relevant, se prop. 2021\/22:176 s. 446 f.<\/em>\u201d.<\/p>\n\n\n\n<p>N\u00e4r det g\u00e4ller f\u00f6reningsr\u00e4ttskr\u00e4nkning anf\u00f6rde Arbetsdomstolen bl.a. att det, enligt praxis, inledningsvis ankommer p\u00e5 arbetstagarparten att visa \u201dsannolika sk\u00e4l\u201d f\u00f6r att en kr\u00e4nkning av f\u00f6reningsr\u00e4tten f\u00f6rekommit. Lyckas arbetstagarparten med det \u00e4r det d\u00e4refter arbetsgivarens sak att styrka att denne haft sk\u00e4lig anledning till sin \u00e5tg\u00e4rd oberoende av f\u00f6reningsr\u00e4ttsfr\u00e5gan.<\/p>\n\n\n\n<p>Betr\u00e4ffande TT:s p\u00e5st\u00e5dda missk\u00f6tsamhet och underprestation fann Arbetsdomstolen att TT, under tiden fr\u00e5n oktober 2022 till dess att han l\u00e4mnade arbetsplatsen i juli 2023, haft en anm\u00e4rkningsv\u00e4rt h\u00f6g tid per arbetspass d\u00e5 han inte hade arbetat aktivt. Under cirka sex m\u00e5nader hade denna tid (icke aktiv tid) legat p\u00e5 i snitt fyra och en halv timme av TT:s totala arbetstid, eller drygt halva arbetstiden. Enligt Arbetsdomstolen hade TT inte l\u00e4mnat n\u00e5gon godtagbar f\u00f6rklaring till varf\u00f6r hans icke aktiva tid varit s\u00e5 omfattande. Arbetsdomstolen fann det vidare visat att efter det att TT sades upp s\u00e5 \u00f6kade hans \u201dicke aktiva tid\u201d till f\u00f6rst sex timmar i snitt, f\u00f6r att slutligen bli n\u00e4stan \u00e5tta timmar.<\/p>\n\n\n\n<p>Genom detta agerande ans\u00e5g Arbetsdomstolen att TT, p\u00e5 ett allvarligt s\u00e4tt och vid upprepade tillf\u00e4llen, \u00e5sidosatt sin mest grundl\u00e4ggande och sj\u00e4lvklara skyldighet enligt anst\u00e4llningsavtalet; att arbeta. Arbetsdomstolen ans\u00e5g att arbetsgivaren f\u00f6rs\u00f6kt komma till r\u00e4tta med TT:s l\u00e5ga arbetsprestation genom att uppr\u00e4tta en handlingsplan f\u00f6r att hj\u00e4lpa honom att f\u00f6rb\u00e4ttra sin prestation, samt att Bolaget vid upprepade tillf\u00e4llen varnade TT och f\u00f6rklarade d\u00e4rvid bl.a. att bolaget s\u00e5g allvarligt p\u00e5 detta och att TT riskerade sin anst\u00e4llning om hans beteende fortsatte. D\u00e4rmed hade Bolaget, enligt Arbetsdomstolen, inte gett TT anledning att anta att bolaget accepterade hans beteende och trots detta hade TT inte b\u00e4ttrat sig.<\/p>\n\n\n\n<p>Redan p\u00e5 denna grund fann Arbetsdomstolen d\u00e4rmed att arbetsgivaren haft sakliga sk\u00e4l f\u00f6r att s\u00e4ga upp TT:s anst\u00e4llning av personliga sk\u00e4l. \u00d6vriga p\u00e5st\u00e5enden om TT:s missk\u00f6tsamhet beh\u00f6vde d\u00e4rf\u00f6r inte pr\u00f6vas, ans\u00e5g Arbetsdomstolen.<\/p>\n\n\n\n<p>Vidare fann Arbetsdomstolen att arbetstagarorganisationen inte gjort sannolikt att bolaget haft ett f\u00f6reningsr\u00e4ttskr\u00e4nkande syfte med upps\u00e4gningen. Arbetsdomstolen ans\u00e5g d\u00e4rmed att n\u00e5gon f\u00f6reningsr\u00e4ttskr\u00e4nkning inte hade f\u00f6rekommit.<\/p>\n\n\n\n<p>Arbetsdomstolen avslog samtliga yrkanden och f\u00f6rpliktade arbetstagarorganisationen att ers\u00e4tta arbetsgivarparterna f\u00f6r deras r\u00e4tteg\u00e5ngskostnader.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/\" target=\"_blank\" rel=\"noreferrer noopener\">L\u00e4s fler domar p\u00e5 Arbetsdomstolens hemsida<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>2024 dom nr 78 Arbetstagarorganisationen gjorde g\u00e4llande att dess medlem, TT, blivit uppsagd pga. att han utnyttjat sin f\u00f6reningsr\u00e4tt genom medlemskap i arbetstagarorganisationen och f\u00f6r att han verkat f\u00f6r denna p\u00e5 arbetsplatsen.
