Syftet att vara uthyrd till kund under dennes kontroll och ledning ska f\u00f6religga dels vid anst\u00e4llningens ing\u00e5ende dels vid den aktuella uthyrningen.<\/p>\n\n\n\n<p>Det \u00e4r normalt sett inte fr\u00e5ga om uthyrning enligt uthyrningslagen n\u00e4r det handlar om att visst arbete och visst resultat ska levereras, specialistkompetens utanf\u00f6r kundf\u00f6retagets eget kompetensomr\u00e5de ska levereras som inneb\u00e4r att kunden ej arbetsleder arbetstagaren eller n\u00e4r kundf\u00f6retaget betalar f\u00f6r den samlade kompetensen fr\u00e5n till exempel ett konsultf\u00f6retag f\u00f6r leverans av tj\u00e4nsten\/produkten snarare \u00e4n kompetensen hos en enskild individ. &nbsp;<\/p>\n\n\n\n<p>Att kunden ger vissa dagliga instruktioner till arbetstagaren eller att arbetstagaren arbetar integrerat i kundens verksamhet inneb\u00e4r inte per automatik att arbetstagaren st\u00e5r under kundens kontroll och ledning i uthyrningslagens bem\u00e4rkelse.<\/p>\n\n\n\n<p>F\u00f6r att tydligg\u00f6ra syftet rekommenderar vi att ni skriver i s\u00e5v\u00e4l anst\u00e4llningsavtal som i varje aff\u00e4rsavtal om det \u00e4r fr\u00e5ga om bemanning\/uthyrning eller inte.<\/p>\n\n\n\n<p>En fr\u00e5ga om uthyrningslagens till\u00e4mpningsomr\u00e5de kan bli f\u00f6rem\u00e5l f\u00f6r r\u00e4ttslig pr\u00f6vning. Om kundf\u00f6retaget i st\u00e4llet vill betala ers\u00e4ttning till arbetstagaren ska betalningen g\u00f6ras inom samma tid som erbjudandet skulle ha l\u00e4mnats. Placeringstiden i bemanningsuppdrag p\u00e5 en driftsenhet hos ett kundf\u00f6retag r\u00e4knas fr\u00e5n och med 1 oktober 2022.<\/p>\n\n\n\n<p>Kundf\u00f6retaget v\u00e4ljer om arbetstagaren ska erbjudas en tillsvidareanst\u00e4llning, och hur villkoren i s\u00e5dana fall ska se ut, eller om arbetstagaren ska f\u00e5 ers\u00e4ttning.<\/p>\n\n\n\n<p>Om arbetstagare tackar ja till anst\u00e4llningserbjudande fr\u00e5n ett kundf\u00f6retag kommer aktuell anst\u00e4llning i bemanningsf\u00f6retaget avslutas utan \u00e5tg\u00e4rd n\u00e4r anst\u00e4llningen vid kundf\u00f6retaget tilltr\u00e4ds. Arbetstagaren f\u00e5r inte ta med sig anst\u00e4llningstid och kommer normalt hamna sist i turordningen hos kundf\u00f6retaget. Om uthyrningslagen \u00e4r till\u00e4mplig, s\u00e5 finns det \u00e4ven andra regler i den lagen som beh\u00f6ver iakttas liksom till exempel regler om f\u00f6rhandlingsskyldighet i medbest\u00e4mmandelagen (MBL). Till\u00e4mpas \u00e5 andra sidan uthyrningslagen utan att den \u00e4r till\u00e4mplig kan kundf\u00f6retag bryta mot aff\u00e4rsavtal eller f\u00f6retr\u00e4desr\u00e4tt enligt anst\u00e4llningsskyddslagen (LAS). Arbetstagaren riskerar \u00e5 sin sida att drabbas av skadest\u00e5nd f\u00f6r att till exempel inte ha iakttagit upps\u00e4gningstid eller f\u00f6r att ha brutit mot
