Detta \u00e4r en ny uppdaterad version av v\u00e4gledningen.<\/p>\n\n<p>V\u00e4gledningen riktar sig till f\u00f6retag som \u00e4r medlemmar i ett f\u00f6rbund inom Almega med kollektivavtal f\u00f6r tj\u00e4nstem\u00e4n och syftar till&nbsp;att hj\u00e4lpa f\u00f6retag och fackligt f\u00f6rtroendevalda i processen vid arbetsbristupps\u00e4gningar.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">L\u00e4nkar till Arbetsgivarguiden:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.almega.se\/app\/uploads\/2024\/07\/Vagen_framat_partsgemensam-2024-uppdaterad.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">V\u00e4gen fram\u00e5t<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/medlem.arbetsgivarguiden.se\/a-till-o\/194#section-11038\" target=\"_blank\" rel=\"noreferrer noopener\">Anst\u00e4llnings upph\u00f6rande\/Arbetsbrist<\/a><\/li>\n<\/ul>\n\n\n\n<p>V\u00e4gen fram\u00e5t \u00e4r en praktisk guide med relevanta mallar, som g\u00e5r igenom de n\u00f6dv\u00e4ndiga stegen vid en arbetsbrist. V\u00e4gledningen utg\u00e5r fr\u00e5n Huvudavtalet om trygghet, omst\u00e4llning och anst\u00e4llningsskydd. Enligt Huvudavtalet ska de lokala parterna vid arbetsbrist i f\u00f6rsta hand komma \u00f6verens om vilka arbetstagare som ska s\u00e4gas upp; en s\u00e5 kallad avtalsturlista. Avtalsturlistan ska utg\u00e5 fr\u00e5n f\u00f6retagets framtida bemanningsbehov. I V\u00e4gen fram\u00e5t f\u00f6rtydligas att utg\u00e5ngspunkten i Huvudavtalet \u00e4r att de lokala parterna i arbetsbristsituationer f\u00f6ruts\u00e4tts tr\u00e4ffa avtalsturlistor. Det inneb\u00e4r att ingen part kan neka till att f\u00f6rhandla om en avtalsturlista.<\/p>\n\n\n\n<p>V\u00e4gen fram\u00e5t klarg\u00f6r ocks\u00e5 vad som g\u00e4ller betr\u00e4ffande vanligt f\u00f6rekommande fr\u00e5gor som ofta f\u00f6ranleder diskussion mellan lokala parter, s\u00e5som att;<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\" start=\"1\">\n<li>det inte f\u00f6religger n\u00e5gon separat informationsskyldighet enligt 19 \u00a7 Medbest\u00e4mmandelagen (MBL) om den tillt\u00e4nkta \u00e5tg\u00e4rden innan sj\u00e4lva f\u00f6rhandlingen om organisationsf\u00f6r\u00e4ndringen enligt 11 \u00a7 MBL (s.6),<\/li>\n\n\n\n<li>personnummer \u00e4r en s\u00e4rskilt skyddsv\u00e4rd personuppgift enligt dataskyddslagstiftningen och tillsynsmyndigheten Integritetsskyddsmyndigheten (IMY), d\u00e4rf\u00f6r \u00e4r det normalt tillr\u00e4ckligt att ange f\u00f6delsedata (\u00c5\u00c5MMDD) i turordningslistan (s.8),<\/li>\n\n\n\n<li>det \u00e4r l\u00e4mpligt att arbetsgivaren tidigt i processen, exempelvis i samband med sin information till medarbetarna, meddelar vilka fackliga representanter som f\u00f6retr\u00e4der respektive facklig organisation. P\u00e5 s\u00e5 s\u00e4tt kan de fackliga representanterna inh\u00e4mta information och reda ut fr\u00e5gor innan f\u00f6rhandlingen s\u00e5 att den kan bedrivas p\u00e5 ett effektivt s\u00e4tt (s.9),<\/li>\n\n\n\n<li>det oavsett om parterna av praktiska sk\u00e4l inleder med att g\u00e5 igenom organisationsf\u00f6r\u00e4ndringen och dess konsekvenser eller om parterna v\u00e4ljer att ajournera f\u00f6rhandlingen och ses vid flera tillf\u00e4llen, \u00e4nd\u00e5 \u00e4r fr\u00e5ga om en och samma f\u00f6rhandling. (s.10),<\/li>\n\n\n\n<li>om en tj\u00e4nsteman som ber\u00f6rs av arbetsbristen tackar nej till ett sk\u00e4ligt erbjudande om omplacering till en ledig befattning kan denna tj\u00e4nsteman s\u00e4gas upp p\u00e5 grund av arbetsbrist utan att fr\u00e5gan om turordning aktualiseras (s.12),<\/li>\n\n\n\n<li>det \u00e4r f\u00f6rst n\u00e4r parterna konstaterat att man inte kunde tr\u00e4ffa en avtalsturlista som fr\u00e5gan om undantag aktualiseras. Det finns allts\u00e5 inte n\u00e5gon skyldighet att ange vilka tj\u00e4nstem\u00e4n arbetsgivaren har f\u00f6r avsikt att undanta redan i f\u00f6rhandlingsframst\u00e4llan eller direkt i f\u00f6rhandlingen f\u00f6r att senare kunna utnyttja undantagsm\u00f6jligheterna (s.13).<\/li>\n<\/ol>\n\n\n\n<p>F\u00f6rhoppningen \u00e4r att lokala parter, arbetsgivare och fackliga f\u00f6retr\u00e4dare, anv\u00e4nder V\u00e4gen fram\u00e5t som hj\u00e4lp i f\u00f6rberedelserna inf\u00f6r f\u00f6rhandling, men \u00e4ven vid f\u00f6rhandlingsbordet f\u00f6r att l\u00f6sa upp eventuella knutar och p\u00e5 ett bra s\u00e4tt lyckas genomf\u00f6ra processen vid arbetsbrist.<\/p>\n\n\n\n<p>Har du fr\u00e5gor kontakta Almegas jour 08-762 69 90.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>V\u00e4gledningen riktar sig till f\u00f6retag som \u00e4r medlemmar i ett f\u00f6rbund inom Almega med kollektivavtal f\u00f6r tj\u00e4nstem\u00e4n och syftar till&nbsp;att hj\u00e4lpa f\u00f6retag och fackligt f\u00f6rtroendevalda i processen vid arbetsbristupps\u00e4gningar.
