F\u00f6rsta inrapportering ska ske i mars 2024.<\/p>\n<p class=\"intro\">Observera att denna f\u00f6r\u00e4ndring <strong>enbart ber\u00f6r arbetare<\/strong>. L\u00f6nerapportering f\u00f6r tj\u00e4nstem\u00e4n ska \u00e4ven under 2024 utf\u00f6ras \u00e5rsvis p\u00e5 samma s\u00e4tt som tidigare.<\/p>\n<p class=\"intro\">Den 12 februari 2024 undertecknade centrala huvudorganisationer (Svenskt N\u00e4ringsliv och LO) en tolknings\u00f6verenskommelse om vad som ska g\u00e4lla vid den nya m\u00e5nadsvisa inrapporteringen. Det \u00e4r en f\u00f6r\u00e4ndring av tidigare information fr\u00e5n Fora och vi vill d\u00e4rf\u00f6r g\u00f6ra er extra uppm\u00e4rksammade p\u00e5 detta. M\u00e5nadsvis hantering inneb\u00e4r att arbetsgivarna rapporterar utbetald kontant bruttol\u00f6n till Fora varje m\u00e5nad. Fora ber\u00e4knar \u00e4ven pensionspremier och fakturerar arbetsgivarna m\u00e5nadsvis. Detta inneb\u00e4r i sin tur att pensionspremier kommer att \u00f6verf\u00f6ras till arbetstagarnas valda pensionsf\u00f6rs\u00e4kringar m\u00e5nadsvis.<\/p>\n\n\n\n<p>M\u00e5nadshantering har inf\u00f6rts avseende l\u00f6ner som utbetalas fr\u00e5n och med 2024-01-01.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Villkor om pensionsmedf\u00f6rande l\u00f6n h\u00e4nf\u00f6rlig till annan m\u00e5nad<\/h3>\n\n\n\n<p>I \u00a7 5 Avtalspension SAF-LO med premiebefrielsef\u00f6rs\u00e4kring anges f\u00f6ljande (kursivt).<\/p>\n\n\n\n<p><em>Den pensionsmedf\u00f6rande l\u00f6nen utg\u00f6rs av utbetald kontant bruttol\u00f6n.&nbsp;<\/em><\/p>\n\n\n\n<p><em>Om utbetald kontant bruttol\u00f6n inneh\u00e5ller l\u00f6nedelar som \u00e4r h\u00e4nf\u00f6rliga till andra m\u00e5nader \u00e4n den m\u00e5nad som l\u00f6nen utbetalas ska dessa l\u00f6nedelar ligga till grund f\u00f6r premieber\u00e4kningen f\u00f6r den m\u00e5nad som respektive l\u00f6nedel \u00e4r h\u00e4nf\u00f6rlig till i st\u00e4llet f\u00f6r den m\u00e5nad som l\u00f6nen utbetalas.<\/em><\/p>\n\n\n\n<p>Fora, Svenskt N\u00e4ringsliv och medlemsorganisationerna har f\u00e5tt fr\u00e5gor av arbetsgivare kring hur \u00a7 5 ovan ska tolkas och till\u00e4mpas. Svenskt N\u00e4ringsliv och LO har genom \u00f6verenskommelse 2024-02-12 enats om en tolkning av \u00a7 5 med avseende p\u00e5 vilka l\u00f6nedelar som kan betraktas som h\u00e4nf\u00f6rliga till annan m\u00e5nad \u00e4n utbetalningsm\u00e5naden.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Partsgemensam tolkning av \u00a7 5 Avtalspension SAF-LO med premiebefrielsef\u00f6rs\u00e4kring<\/h3>\n\n\n\n<p>Paragrafens f\u00f6rsta stycke uttrycker att huvudregeln \u00e4r att den pensionsmedf\u00f6rande l\u00f6nen<\/p>\n\n\n\n<p>ska ligga till grund f\u00f6r premieber\u00e4kningen f\u00f6r den m\u00e5nad som l\u00f6nen i fr\u00e5ga utbetalas.&nbsp;<\/p>\n\n\n\n<p>Paragrafens andra stycke uttrycker ett undantag fr\u00e5n huvudregeln i f\u00f6rsta stycket. Undantaget inneb\u00e4r att de delar av den pensionsmedf\u00f6rande l\u00f6nen som \u00e4r att betrakta som h\u00e4nf\u00f6rlig till annan m\u00e5nad \u00e4n utbetalningsm\u00e5naden i st\u00e4llet ska ligga till grund f\u00f6r premieber\u00e4kningen f\u00f6r de m\u00e5nader som l\u00f6nedelarna \u00e4r h\u00e4nf\u00f6rliga till.&nbsp;<\/p>\n\n\n\n<p>De l\u00f6nedelar som \u00e4r att betrakta som h\u00e4nf\u00f6rliga till andra m\u00e5nader \u00e4r f\u00f6ljande.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>R\u00f6rliga l\u00f6nedelar som bygger p\u00e5 arbetstagarens prestation, exempelvis prestationsl\u00f6n, ackordsl\u00f6n, resultatl\u00f6n och liknande.<\/li>\n\n\n\n<li>Bonus, tantiem, gratifikationer och liknande, oavsett om ers\u00e4ttningen \u00e4r kopplad till den anst\u00e4lldes arbetsinsats eller inte.<\/li>\n\n\n\n<li>Kontant utbetalning av tidigare semester\u00e5rs sparade semesterdagar vid anst\u00e4llnings upph\u00f6rande.<\/li>\n<\/ul>\n\n\n\n<p>Vid premieber\u00e4kningen ska ovan n\u00e4mnda l\u00f6nedelar f\u00f6rdelas p\u00e5 intj\u00e4nandeperioden i enlighet med det faktiska intj\u00e4nandet f\u00f6rutom avseende kontant utbetalning av sparade semesterdagar som ska f\u00f6rdelas lika p\u00e5 de 12 m\u00e5nader som f\u00f6reg\u00e5r den anst\u00e4lldes sista anst\u00e4llningsdag.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Information till arbetsgivare om den partsgemensamma tolkningen av \u00a7 5<\/h3>\n\n\n\n<p>\u00d6verenskommelsen om tolkningen avseende l\u00f6n h\u00e4nf\u00f6rlig till annan m\u00e5nad inneb\u00e4r att de ovan uppr\u00e4knade l\u00f6nedelarna ska rapporteras som l\u00f6n h\u00e4nf\u00f6rlig till annan m\u00e5nad i rapporteringen som arbetsgivaren g\u00f6r till Fora. Dessa l\u00f6nedelar ska f\u00f6rdelas p\u00e5 de m\u00e5nader som de \u00e4r h\u00e4nf\u00f6rliga till i enlighet med hur det faktiska intj\u00e4nandet har sett ut. Detta g\u00e4ller dock inte kontant utbetalning av sparade semesterdagar, avseende s\u00e5dan utbetalning ska f\u00f6rdelningen i st\u00e4llet ske schablonm\u00e4ssigt med lika delar under de 12 m\u00e5nader som f\u00f6reg\u00e5r den anst\u00e4lldes sista anst\u00e4llningsdag. Det b\u00f6r h\u00e4r noteras att rapportering av l\u00f6n h\u00e4nf\u00f6rlig till annan m\u00e5nad \u00e4n utbetalningsm\u00e5naden ska ske p\u00e5 s\u00e5 s\u00e4tt som anges ovan, det \u00e4r s\u00e5ledes inte valfritt att till\u00e4mpa reglerna (se dock nedan information om \u00f6verg\u00e5ngsregler).<\/p>\n\n\n\n<p>L\u00f6nedelar som inte omfattas av uppr\u00e4kningen ovan \u00e4r inte att betrakta som l\u00f6n h\u00e4nf\u00f6rlig till annan m\u00e5nad och ska f\u00f6ljaktligen, i enlighet med huvudregeln, ligga till grund f\u00f6r premieber\u00e4kningen f\u00f6r utbetalningsm\u00e5naden.<\/p>\n\n\n\n<p>Information om \u00f6verenskommelsen och tolkningen av \u00a7 5 kommer att l\u00e4ggas ut p\u00e5 Foras hemsida s\u00e5 snart som m\u00f6jligt.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">S\u00e4rskilt om \u00f6verg\u00e5ngsregler avseende l\u00f6nedelar som \u00e4r h\u00e4nf\u00f6rliga till period innan 2024-01-01<\/h3>\n\n\n\n<p>\u00d6verg\u00e5ngen fr\u00e5n \u00e5rsvis till m\u00e5nadsvis hantering sker per 2024-01-01. Svenskt N\u00e4ringsliv och LO \u00e4r ense om att f\u00f6r l\u00f6nedelar som utbetalas efter 2023-12-31 men som \u00e4r h\u00e4nf\u00f6rliga till m\u00e5nader innan \u00f6verg\u00e5ngen till m\u00e5natlig hantering ska den tidigare \u00e5rliga hanteringen till\u00e4mpas f\u00f6r ber\u00e4kning av pensionspremie.<\/p>\n\n\n\n<p>Fora saknar dock IT-st\u00f6d f\u00f6r till\u00e4mpning av ovan \u00f6verg\u00e5ngsregler, vilket inneb\u00e4r att arbetsgivarna kommer att beh\u00f6va hantera l\u00f6n som \u00e4r utbetalad efter 2023-12-31 men som \u00e4r h\u00e4nf\u00f6rlig till period f\u00f6re 2024-01-01 som en r\u00e4ttelse av det aktuella \u00e5rets slutliga l\u00f6nerapportering i Foras system. Eftersom s\u00e5dan l\u00f6nerapportering av Fora hanteras som en r\u00e4ttelse av tidigare \u00e5r kommer det \u00e4ven f\u00f6ranleda Fora att debitera r\u00e4ntekostnader. Dessa r\u00e4ntekostnader ska dock \u00e5terbetalas fr\u00e5n Fora till arbetsgivarna vid ett senare tillf\u00e4lle.<\/p>\n\n\n\n<p>F\u00f6r det fall att arbetsgivare, p\u00e5 grund av att \u00e4ndam\u00e5lsenligt IT-st\u00f6d saknas, inte \u00f6nskar till\u00e4mpa \u00f6verg\u00e5ngsreglerna kan arbetsgivare rapportera dessa l\u00f6nedelar i enlighet<\/p>\n\n\n\n<p>med huvudregeln i st\u00e4llet, d.v.s. som h\u00e4nf\u00f6rliga till utbetalningsm\u00e5naden.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Avtalspension SAF-LO &#8211; Hantering av l\u00f6n h\u00e4nf\u00f6rlig till annan m\u00e5nad \u00d6verg\u00e5ng till m\u00e5nadshantering Svenskt N\u00e4ringsliv och LO \u00e4r \u00f6verens om en \u00f6verg\u00e5ng fr\u00e5n \u00e5rsvis till m\u00e5nadsvis hantering av Avtalspension SAF-LO.
