F\u00f6r\u00e4ndringen inneb\u00e4r att arbetsgivaren ges en m\u00f6jlighet att planera in personer som har en annan huvudsaklig syssels\u00e4ttning p\u00e5 arbetspass tv\u00e5 m\u00e5nader fram\u00e5t.<\/p>\n\n\n\n<p>Annan huvudsaklig syssels\u00e4ttning kan vara annat jobb, skolstudier eller liknande som v\u00e4sentligen syssels\u00e4tter arbetstagaren.<\/p>\n\n\n\n<p>Texten inf\u00f6res efter 4 stycket<\/p>\n\n\n\n<p>Om det uppkommit fr\u00e5gor kring till\u00e4mpningen av anst\u00e4llningsformen har lokal facklig organisation r\u00e4tt att p\u00e5kalla f\u00f6rhandling och inom ramen f\u00f6r f\u00f6rhandlingen ta del av information om antalet arbetade timmar inom ramen f\u00f6r anst\u00e4llningsformen de senaste sex m\u00e5naderna. Arbetsgivaren har att ocks\u00e5 redog\u00f6ra f\u00f6r andelen arbetade timmar p\u00e5 anst\u00e4llningsformen tillf\u00e4lligt behov av arbetskraft i f\u00f6rh\u00e5llande till totalt antal arbetade timmar under perioden samt de \u00f6vergripande f\u00f6ruts\u00e4ttningarna f\u00f6r tills\u00e4ttningen av arbetspass p\u00e5 anst\u00e4llningsformen tillf\u00e4lligt behov av arbetskraft. P\u00e5 beg\u00e4ran av lokal facklig organisation ska arbetsgivaren specificera timmarna per anst\u00e4lld med angivande av anst\u00e4llnings-id.<\/p>\n\n\n\n<p><em>Kommentar<\/em><\/p>\n\n\n\n<p>HRF har m\u00f6jlighet att kontrollera att arbetsgivaren efterf\u00f6ljer de regler som finns. Vi kommer efter sommaren ta fram en anst\u00e4llningmall f\u00f6r att underl\u00e4tta dokumentationen av den h\u00e4r anst\u00e4llningsformen. <em><\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Nytt \u00a7 3 Mom 8 F\u00f6retr\u00e4desr\u00e4tt till kortare anst\u00e4llningar<\/h3>\n\n\n\n<p>Till en tidsbegr\u00e4nsad anst\u00e4llning i enlighet med \u00a7 3 Mom 3 1-4 som bed\u00f6ms f\u00e5 en varaktighet av h\u00f6gst 14 dagar g\u00e4ller inte f\u00f6retr\u00e4desr\u00e4tt till \u00e5teranst\u00e4llning.<\/p>\n\n\n\n<p>Nuvarande moment 8 till 11 konsekvensf\u00f6rflyttas.<\/p>\n\n\n\n<p><em>Kommentar<\/em><\/p>\n\n\n\n<p>Om arbetsgivaren avslutat anst\u00e4llningen p\u00e5 grund av arbetsbrist eller om den anst\u00e4llde haft en allm\u00e4nvisstids anst\u00e4llning, vikariat eller n\u00e5gon annan visstidsanst\u00e4llning som sammanlagt varat l\u00e4ngre \u00e4n 12 m\u00e5nader under en 3 \u00e5rsperiod. Har arbetstagaren f\u00f6retr\u00e4desr\u00e4tt till \u00e5teranst\u00e4llning. En f\u00f6ruts\u00e4ttning \u00e4r att arbetstagaren har anm\u00e4lt att man vill nyttja sin r\u00e4ttighet till arbetsgivaren. Har arbetsgivaren personer som anm\u00e4lt sin f\u00f6retr\u00e4desr\u00e4tt s\u00e5 beh\u00f6ver inte arbetsgivaren erbjuda arbetstagaren en anst\u00e4llning som ber\u00e4knas vara kortare \u00e4n 14 dagar. Omv\u00e4nt om en arbetsgivare har arbetstagare som har anm\u00e4lt sin f\u00f6retr\u00e4desr\u00e4tts som man erbjuder en anst\u00e4llning som \u00e4r kortare \u00e4n 14 dagar blir inte av med sin f\u00f6retr\u00e4desr\u00e4tt om vederb\u00f6rande tackar nej. F\u00f6r personal med m\u00e5nadsl\u00f6n f\u00e5r genomsnittet ber\u00e4knas p\u00e5 h\u00f6gst 12 veckor.<\/p>\n\n\n\n<p><em>Kommentar<\/em><\/p>\n\n\n\n<p>F\u00f6r anst\u00e4llda med m\u00e5nadsl\u00f6n kan arbetsgivaren till\u00e4mpa en begr\u00e4nsningsperiod p\u00e5 12 veckor ist\u00e4llet f\u00f6r 8 veckor. Begr\u00e4nsningsperioden reglerar hur l\u00e5ng schemacykel arbetsgivaren har r\u00e4tt att anv\u00e4nda sig av f\u00f6r att l\u00e4gga ut ordinarie arbetstid i ett schema. Har man 12 veckors ber\u00e4kningsperiod kan marbetsgivaren antingen till\u00e4mpa en 12 veckocykel alternativt ex. tv\u00e5 6 veckocykel. Det betyder att arbetsgivaren kan schemal\u00e4gga olika mycket arbete under 12 veckorsperioden men att det i snitt med blir 40 timmar\/helgfri vecka.<\/p>\n\n\n<a class='Share__link Share__link--url
