{"id":6089,"date":"2015-09-18T09:00:00","date_gmt":"2015-09-18T09:00:00","guid":{"rendered":"http:\/\/almega-bento\/wp\/blog\/2015\/09\/18\/ad-2015-nr-51-om-aldersdiskriminering\/"},"modified":"2015-09-18T09:00:00","modified_gmt":"2015-09-18T09:00:00","slug":"ad-2015-nr-51-om-aldersdiskriminering","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2015\/09\/ad-2015-nr-51-om-aldersdiskriminering\/","title":{"rendered":"AD 2015 nr 51 om \u00e5ldersdiskriminering"},"content":{"rendered":"\n<p>I onsdags kom en dom fr&aring;n Arbetsdomstolen som handlar om &aring;ldersbegr&auml;nsningar i f&ouml;retagspolicys f&ouml;r anst&auml;llda med behovsanst&auml;llningar. &Auml;rendet r&ouml;r bussf&ouml;rare men kan &auml;ven ha ett visst intresse f&ouml;r er.<\/p>\n<p>Tre bussf&ouml;rare hos Keolis AB hade haft tidsbegr&auml;nsade behovsanst&auml;llningar. Tv&aring; av dessa hade k&ouml;rt buss och den tredje hade k&ouml;rt f&auml;rdtj&auml;nst och sjukresor. N&auml;r de fyllde 70 &aring;r fick de veta att de inte skulle f&aring; n&aring;gra fler anst&auml;llningar p&aring; grund av f&ouml;retagets &aring;lderspolicy. Keolis motiverade sin &aring;ldersgr&auml;ns p&aring; 70 &aring;r med trafiks&auml;kerhetssk&auml;l.<\/p>\n<p>Diskrimineringsombudsmannen (DO) st&auml;mde Keolis och kr&auml;vde att de tre skulle f&aring; ers&auml;ttning f&ouml;r att de hade diskriminerats p&aring; grund av sin &aring;lder.<\/p>\n<p>Arbetsdomstolen ans&aring;g att &nbsp;&aring;ldersgr&auml;nsen &nbsp;inte kunde utg&ouml;ra ett verkligt och avg&ouml;rande yrkeskrav enligt 2:2 &sect; diskrimineringslagen, men v&auml;l att fysiska f&ouml;rm&aring;gor kunde g&ouml;ra det. Att fysiska f&ouml;rm&aring;gor generellt avtar med stigande &aring;lder och att kognitiva f&ouml;rm&aring;gor som koncentration och uppm&auml;rksamhet &auml;r avg&ouml;rande egenskaper f&ouml;r buss-, sjuk-, rese-, och f&auml;rdtj&auml;nstf&ouml;rare r&aring;der det, enligt domstolens mening, dock inget tvivel om. D&auml;refter hade domstolen att pr&ouml;va huruvida 70-&aring;rsgr&auml;nsen &auml;r l&auml;mplig och n&ouml;dv&auml;ndig f&ouml;r att uppn&aring; det ber&auml;ttigade syftet. Vid denna bed&ouml;mning &auml;r utg&aring;ngspunkten de krav som internationell och nationell r&auml;tt st&auml;ller p&aring; den som ska f&ouml;ra ett fordon i yrkesm&auml;ssig trafik. D&aring; det inte finns n&aring;gon &ouml;vre &aring;ldersgr&auml;ns f&ouml;r yrkestrafik, varken i svenska eller i internationella regler, finner Arbetsdomstolen att Keolis har missgynnat f&ouml;rarna p&aring; ett olagligt s&auml;tt och menar att den generella &aring;ldersgr&auml;nsen inte &ouml;kar trafiks&auml;kerheten.<\/p>\n<p>Domen visar att undantagen i diskrimineringslagen &auml;r f&aring; och ska anv&auml;ndas restriktivt.<\/p>\n<p>N&auml;r det g&auml;ller den andra undantagsregeln i 2:4 diskrimineringslagen s&aring; konstaterar arbetsdomstolen att kriteriet &rdquo;ber&auml;ttigat syfte&rdquo; &auml;r ett socialpolitiskt m&aring;l och att trafiks&auml;kerhet inte omfattas av detta.<\/p>\n<p>Diskrimineringsers&auml;ttningen fastst&auml;lldes till 40.000 kr per f&ouml;rare.<\/p>\n<\/p>\n","protected":false},"excerpt":{"rendered":"<p>I onsdags kom en dom fr&aring;n Arbetsdomstolen som handlar om &aring;ldersbegr&auml;nsningar i f&ouml;retagspolicys f&ouml;r anst&auml;llda med behovsanst&auml;llningar. &Auml;rendet r&ouml;r bussf&ouml;rare men kan &auml;ven ha ett visst intresse f&ouml;r er.
