Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n\n<h3 class=\"wp-block-heading\"><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/2023\/2023-03-29-ad-2023-nr-20\/\">AD 2023 nr 20<\/a><\/h3>\n\n\n\n<p><strong>Tvisten g\u00e4llde huruvida ett bolag varit skyldigt att f\u00f6rhandla enligt 11 \u00a7 medbest\u00e4mmandelagen (\u201dMBL\u201d) innan bolaget fattade vissa beslut.<\/strong><\/p>\n\n\n\n<p>Parter i m\u00e5let var \u00e5 ena sidan ett f\u00f6rbund p\u00e5 arbetstagarsidan (\u201df\u00f6rbundet\u201d), och \u00e5 andra sidan en arbetsgivare (\u201dbolaget\u201d) samt det arbetsgivarf\u00f6rbund som bolaget var medlem i. Mellan parterna i m\u00e5let g\u00e4llde kollektivavtal.<\/p>\n\n\n\n<p>F\u00f6r att hantera en f\u00f6rv\u00e4ntad \u00f6kad arbetsvolym under en \u00e5ttaveckorsperiod hade bolaget beslutat att visstidsanst\u00e4lla tre arbetstagare under den ber\u00f6rda perioden och schemal\u00e4gga dem p\u00e5 eftermiddagar under vardagar. Parterna i m\u00e5let tvistade om huruvida besluten innebar en s\u00e5dan viktigare f\u00f6r\u00e4ndring av verksamheten, eller arbetsf\u00f6rh\u00e5llandena f\u00f6r fyra andra angivna arbetstagare som var medlemmar i f\u00f6rbundet, att bolaget varit skyldigt att f\u00f6rhandla med f\u00f6rbundet enligt 11 \u00a7 MBL innan bolaget fattade dessa beslut. F\u00f6rbundet h\u00e4vdade allts\u00e5 att bolaget varit f\u00f6rhandlingsskyldigt och yrkade att bolaget skulle f\u00f6rpliktas att betala allm\u00e4nt skadest\u00e5nd med 50&nbsp;000 kr f\u00f6r brott mot 11 \u00a7 MBL.<\/p>\n\n\n\n<p>Genom att h\u00e4nvisa till uttalanden i f\u00f6rarbetena till MBL redogjorde Arbetsdomstolen f\u00f6r vad som avses med en \u201dviktigare f\u00f6r\u00e4ndring av verksamheten\u201d (det s\u00e5 kallade verksamhetsfallet) respektive en \u201dviktigare f\u00f6r\u00e4ndring av arbets- eller anst\u00e4llningsf\u00f6rh\u00e5llandena f\u00f6r arbetstagare\u201d (det s\u00e5 kallade arbetstagarfallet), och som d\u00e4rmed faller inom omr\u00e5det f\u00f6r f\u00f6rhandlingsskyldigheten enligt 11 \u00a7 MBL. Arbetsdomstolen anf\u00f6rde sedan att den gemensamma utg\u00e5ngspunkten f\u00f6r b\u00e5da fallen \u00e4r att det anses vara fr\u00e5ga om en viktigare f\u00f6r\u00e4ndring om ett beslut har den omfattningen och inneb\u00f6rden f\u00f6r arbetstagarna att man typiskt sett b\u00f6r r\u00e4kna med att en facklig organisation vill f\u00e5 tillf\u00e4lle till f\u00f6rhandling. Denna bed\u00f6mning ska ske p\u00e5 objektiva grunder, tillade Arbetsdomstolen, vilket inneb\u00e4r att n\u00e5gon s\u00e4rskild betydelse inte ska tillm\u00e4tas den omst\u00e4ndigheten att organisationen i det enskilda fallet ansett att det f\u00f6relegat ett starkt intresse av att f\u00f6rhandla (AD 1980 nr 72).<\/p>\n\n\n\n<p>Arbetsdomstolen framh\u00f6ll \u00e4ven att det \u00e4r f\u00f6rh\u00e5llandena vid tiden n\u00e4r arbetsgivaren \u00f6verv\u00e4ger att fatta sitt beslut som \u00e4r avg\u00f6rande f\u00f6r bed\u00f6mningen av om det \u00e4r fr\u00e5ga om en viktigare f\u00f6r\u00e4ndring som medf\u00f6r f\u00f6rhandlingsskyldighet enligt 11 \u00a7 MBL. Vid denna bed\u00f6mning \u00e4r det d\u00e4rf\u00f6r av underordnad betydelse vilka faktiska konsekvenser som beslutet i efterhand har visat sig f\u00e5.<\/p>\n\n\n\n<p>Efter att ha bed\u00f6mt vad bolagets beslut innebar f\u00f6r eventuella f\u00f6r\u00e4ndringar i olika avseenden blev Arbetsdomstolens bed\u00f6mning sammanfattningsvis att besluten varken innebar en viktigare f\u00f6r\u00e4ndring av verksamheten, eller av arbetsf\u00f6rh\u00e5llandena f\u00f6r fyra arbetstagare som var medlemmar i f\u00f6rbundet.
