Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n\n<h3 class=\"wp-block-heading\">AD 2023 nr 13<\/h3>\n\n\n\n<p><strong>Parterna i m\u00e5let var ense om att bolaget, genom att beg\u00e4ra f\u00f6rhandling f\u00f6r sent, hade brutit mot 38 \u00a7 medbest\u00e4mmandelagen (\u201dMBL\u201d). Tvisten i m\u00e5let r\u00f6rde storleken p\u00e5 det allm\u00e4nna skadest\u00e5nd som f\u00f6rbundet hade r\u00e4tt till p\u00e5 grund av detta brott mot MBL.<\/strong><\/p>\n\n\n\n<p>F\u00f6rbundet hade yrkat 75&nbsp;000 kr i allm\u00e4nt skadest\u00e5nd. Arbetsgivarparterna hade medgett att betala 10&nbsp;000 kr, och yrkat att skadest\u00e5ndet i vart fall skulle j\u00e4mkas till det medgivna beloppet.<\/p>\n\n\n\n<p>Av 38 \u00a7 f\u00f6rsta stycket MBL f\u00f6ljer att innan en arbetsgivare beslutar att l\u00e5ta n\u00e5gon utf\u00f6ra visst arbete f\u00f6r hans r\u00e4kning eller i hans verksamhet utan att denne d\u00e4rvid ska vara arbetstagare hos honom, ska arbetsgivaren p\u00e5 eget initiativ f\u00f6rhandla med den arbetstagarorganisation i f\u00f6rh\u00e5llande till vilken arbetsgivaren \u00e4r bunden av kollektivavtal f\u00f6r s\u00e5dant arbete.<\/p>\n\n\n\n<p>Arbetsdomstolen redogjorde f\u00f6r r\u00e4ttsl\u00e4get och beskrev d\u00e4rvid inneb\u00f6rden och syftet med 38 \u00a7 MBL, bl.a. genom h\u00e4nvisningar till f\u00f6rarbetsuttalanden. Syftet med best\u00e4mmelsen \u00e4r att ge den fackliga organisationen m\u00f6jlighet att ingripa och utnyttja sitt veto, n\u00e4r det finns f\u00f6ruts\u00e4ttningar f\u00f6r det. Detta \u00e4r ocks\u00e5 bakgrunden till att det, enligt f\u00f6rarbetena, normalt finns anledning att betrakta brott mot f\u00f6rhandlingsskyldigheten som ett allvarligt brott mot MBL. Om det dessutom \u00e4r s\u00e5 att det kan antas att ett veto skulle ha lagts, om f\u00f6rhandlingsskyldigheten hade fullgjorts, s\u00e5 ska det enligt vad som s\u00e4gs i f\u00f6rarbetena inverka h\u00f6jande p\u00e5 skadest\u00e5ndet.<\/p>\n\n\n\n<p>Arbetsdomstolen h\u00e4nvisade \u00e4ven till sin tidigare praxis vad g\u00e4llde niv\u00e5n p\u00e5 det allm\u00e4nna skadest\u00e5ndets storlek. I ett tidigare m\u00e5l, d\u00e4r det ans\u00e5gs f\u00f6religga vissa f\u00f6rmildrande omst\u00e4ndigheter och det inte ans\u00e5gs ha blivit klarlagt att ett veto skulle ha varit r\u00e4ttsligt befogat, best\u00e4mdes skadest\u00e5ndet till 60&nbsp;000 kr. I ett senare fall, d\u00e4r domstolen konstaterade att det inte fanns n\u00e5got som talade f\u00f6r att arbetsgivaren medvetet hade velat undandra sig att f\u00f6rhandla och att underl\u00e5tenheten att g\u00f6ra detta synes ha bottnat i ett f\u00f6rbiseende, best\u00e4mdes skadest\u00e5ndet till 50&nbsp;000 kr. I ett \u00e4nnu senare fall, d\u00e4r det konstaterades att det inte hade visats f\u00f6religga f\u00f6ruts\u00e4ttningar f\u00f6r en vetof\u00f6rklaring, fann domstolen \u201dinte sk\u00e4l att d\u00f6ma ut s\u00e4rskilt h\u00f6ga allm\u00e4nna skadest\u00e5nd\u201d, och best\u00e4mde skadest\u00e5nden till 75&nbsp;000 kr avseende vart och ett av de tillf\u00e4llen d\u00e5 f\u00f6rhandlingsskyldigheten hade \u00e5sidosatts. I AD 2015 nr 40, d\u00e4r domstolen i f\u00f6rmildrande riktning beaktade bl.a. den f\u00f6rh\u00e5llandevis l\u00e5nga tid som f\u00f6rflutit fr\u00e5n f\u00f6rhandlingstillf\u00e4llet, utd\u00f6mdes ett belopp om 50&nbsp;000 kr. Arbetsdomstolen h\u00e4nvisade \u00e4ven till ett fall fr\u00e5n 2018 d\u00e4r det d\u00f6mdes ut 35&nbsp;000 kr d\u00e4r Arbetsdomstolen lyfte fram att det inte hade p\u00e5st\u00e5tts att det funnits sk\u00e4l att tro att det f\u00f6relegat f\u00f6ruts\u00e4ttningar f\u00f6r att ut\u00f6va veto, och att skadest\u00e5ndet med h\u00e4nsyn till detta kunde s\u00e4ttas l\u00e5gt.<\/p>\n\n\n\n<p>Efter att ha bed\u00f6mt omst\u00e4ndigheterna i den nu aktuella tvisten fann Arbetsdomstolen att yrkat belopp om 75&nbsp;000 kr var sk\u00e4ligt skadest\u00e5nd. Arbetsdomstolen ans\u00e5g att det saknades anledning att misstro bolagets uppgift om att den f\u00f6rsenade f\u00f6rhandlingen i detta fall berodde p\u00e5 att bolaget hade f\u00f6rv\u00e4xlat tv\u00e5 projekt och att det allts\u00e5 var ett misstag. Detta urs\u00e4ktade emellertid inte bolaget i detta fall, ans\u00e5g Arbetsdomstolen. Enligt Arbetsdomstolen fick konsekvenserna av den uteblivna f\u00f6rhandlingen betraktas som allvarliga. Arbetsdomstolen framh\u00f6ll att f\u00f6rbundet helt hade fr\u00e5ntagits sin m\u00f6jlighet att ut\u00f6va vetor\u00e4tten, och utifr\u00e5n vad som framkommit ans\u00e5gs det visat att f\u00f6rbundet ocks\u00e5 faktiskt skulle ha kommit att anv\u00e4nda sitt veto. Enligt Arbetsdomstolen fanns det inget i utredningen som tydde p\u00e5 att ett veto, om det hade lagts, skulle ha varit oriktigt. Under dessa f\u00f6rh\u00e5llanden ans\u00e5g Arbetsdomstolen allts\u00e5 att det yrkade skadest\u00e5ndet om 75&nbsp;000 kr fick anses sk\u00e4ligt. F\u00f6rbundet tilld\u00f6mdes d\u00e4rf\u00f6r \u00e4ven ers\u00e4ttning f\u00f6r sina r\u00e4tteg\u00e5ngskostnader.<\/p>\n\n\n\n<p><strong><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/2023\/2023-03-15-ad-2023-nr-14\/\">AD 2023 nr 14<\/a><\/strong><\/p>\n\n\n\n<p><strong>Tvisten i m\u00e5let g\u00e4llde huruvida en part varit f\u00f6rhandlingsskyldig enligt 10 \u00a7 MBL.<\/strong><\/p>\n\n\n\n<p>Bakgrunden till tvisten var f\u00f6ljande. En arbetstagare hos en kommun hade avskedats fr\u00e5n sin anst\u00e4llning. Arbetstagaren i fr\u00e5ga var medlem i ett f\u00f6rbund, Privat- och Offentliganst\u00e4lldas f\u00f6rbund (\u201dPOA\u201d), som v\u00e4ckte talan mot arbetsgivaren \u2013 en kommun \u2013 och yrkade bl.a. ogiltigf\u00f6rklaring av avskedandet. Kommunen och POA var inte bundna av kollektivavtal i f\u00f6rh\u00e5llande till varandra. Tvisten i det nu aktuella m\u00e5let r\u00f6rde huruvida Sveriges Kommuner och Regioner (\u201dSKR\u201d), varit skyldig att f\u00f6rhandla med POA enligt 10 \u00a7 andra stycket MBL, med anledning av tvisten mellan POA och kommunen.<\/p>\n\n\n\n<p>POA anf\u00f6rde att SKR, enligt 10 \u00a7 andra stycket MBL, haft en skyldighet att f\u00f6rhandla med POA samt att POA saknar en lokal organisation som hade kunnat f\u00f6rhandla med kommunen. SKR \u00e5 sin sida anf\u00f6rde att det inte funnits n\u00e5gon skyldighet f\u00f6r SKR att f\u00f6rhandla med POA i r\u00e4ttstvisten mellan POA och kommunen.<\/p>\n\n\n\n<p>G\u00e4llande tvisten om avskedet hade POA och kommunen, sedan POA v\u00e4ckt talan, tr\u00e4ffat en f\u00f6rlikning i tvisten.<\/p>\n\n\n\n<p>Arbetsdomstolen konstaterade inledningsvis att den bakomliggande tvisten, fr\u00e5gan om ogiltigf\u00f6rklaring och yrkande om skadest\u00e5nd m.m., var en r\u00e4ttstvist mellan POA och kommunen, samt att de krav som POA framst\u00e4llde f\u00f6r medlemmens r\u00e4kning riktades mot kommunen. Med anledning av dessa krav hade det s\u00e5ledes inte f\u00f6relegat n\u00e5gon r\u00e4ttstvist mellan POA och SKR, framh\u00f6ll Arbetsdomstolen. Vidare konstaterade Arbetsdomstolen att SKR inte hade n\u00e5gon p\u00e5 MBL grundad beh\u00f6righet att f\u00f6retr\u00e4da kommunen i tvisten mellan POA och kommunen. Eftersom parterna inte var bundna av kollektivavtal i f\u00f6rh\u00e5llande till varandra fanns det inte heller n\u00e5gon avtalad f\u00f6rhandlingsordning som kunde grunda en beh\u00f6righet f\u00f6r SKR att f\u00f6retr\u00e4da kommunen i en tvistef\u00f6rhandling. Det f\u00f6rh\u00e5llandet att POA inte hade n\u00e5gon lokal organisation ans\u00e5gs sakna betydelse.<\/p>\n\n\n\n<p>Arbetsdomstolen fann s\u00e5lunda att n\u00e5gon f\u00f6rhandlingsskyldighet inte hade f\u00f6relegat f\u00f6r SKR.
