Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n\n<h3 class=\"wp-block-heading\"><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/2023\/2023-03-01-ad-2023-nr-11\/\">AD 2023 nr 11<\/a><\/h3>\n\n\n\n<p><strong>En butikss\u00e4ljare, GRP, anst\u00e4lldes hos ett bolag i juli 2020 och arbetade halvtid. Den 16 augusti 2021 sa hon upp sig. Fr\u00e5ga om arbetstagarens egen upps\u00e4gning skulle ses som en s\u00e5 kallad \u201dprovocerad upps\u00e4gning\u201d pga. att upps\u00e4gningen var f\u00f6ranledd av ageranden av bolagets f\u00f6retr\u00e4dare i butiken.<\/strong><\/p>\n\n\n\n<p>F\u00f6rbundet, som f\u00f6retr\u00e4dde GRP, anf\u00f6rde sammanfattningsvis f\u00f6ljande. GRP hade romskt ursprung. Det fanns en antiromsk jargong i butiken. GRP:s n\u00e4rmaste chefer i butiken utsatte henne f\u00f6r neds\u00e4ttande och kr\u00e4nkande kommentarer, de var kritiska mot henne inf\u00f6r kunder, de skapade konflikter mellan henne och arbetskamrater och st\u00e4llde henne utanf\u00f6r den sociala gemenskapen p\u00e5 arbetsplatsen. Trots att GRP flertalet g\u00e5nger p\u00e5talade allvarliga brister g\u00e4llande arbetsf\u00f6rh\u00e5llanden som lett till att hon m\u00e5tt d\u00e5ligt hade arbetsgivaren inte vidtagit n\u00e5gra \u00e5tg\u00e4rder. Bolaget hade genom sitt agerande och brist p\u00e5 agerande drivit fram hennes upps\u00e4gning. Hennes upps\u00e4gning skulle d\u00e4rf\u00f6r j\u00e4mst\u00e4llas med en upps\u00e4gning fr\u00e5n arbetsgivarens sida.<\/p>\n\n\n\n<p>Arbetsgivarparterna bestred att GRP:s upps\u00e4gning skulle j\u00e4mst\u00e4llas med en upps\u00e4gning fr\u00e5n arbetsgivarens sida och anf\u00f6rde sammanfattningsvis f\u00f6ljande. GRP:s egna upps\u00e4gning grundade sig i en konflikt som uppstod mellan GRP och en kollega. Bolagets f\u00f6retr\u00e4dare i butiken hade inte agerat p\u00e5 det s\u00e4tt som p\u00e5stods. GRP hade inte heller framf\u00f6rt att hon m\u00e5dde d\u00e5ligt med anledning av arbetsmilj\u00f6n i butiken, att det f\u00f6rel\u00e5g brister i arbetsf\u00f6rh\u00e5llandena, att hon noterat en rasistisk jargong eller att anst\u00e4llda uttryckt sig neds\u00e4ttande om romer. Det hade inte varit m\u00f6jligt f\u00f6r bolaget att inse att bolaget skulle ha framkallat en situation som gjorde det sv\u00e5rt f\u00f6r GRP att forts\u00e4tta anst\u00e4llningen eller vidta n\u00e5gra \u00e5tg\u00e4rder f\u00f6r att komma till r\u00e4tta med de p\u00e5st\u00e5dda missf\u00f6rh\u00e5llandena.<\/p>\n\n\n\n<p>G\u00e4llande tvistens r\u00e4ttsliga utg\u00e5ngspunkter anf\u00f6rde Arbetsdomstolen bl.a. f\u00f6ljande. En upps\u00e4gning fr\u00e5n arbetstagarens sida \u00e4r som utg\u00e5ngspunkt bindande och medf\u00f6r att anst\u00e4llningen upph\u00f6r. Av Arbetsdomstolens praxis framg\u00e5r dock att en upps\u00e4gning fr\u00e5n arbetstagarens sida under s\u00e4rskilda omst\u00e4ndigheter kan vara att betrakta som en upps\u00e4gning fr\u00e5n arbetsgivarens sida, en s\u00e5 kallad provocerad upps\u00e4gning (se AD 2020 nr 23 med h\u00e4nvisningar). I korthet anses s\u00e5 vara fallet om arbetstagarens upps\u00e4gning har f\u00f6ranletts av arbetsgivaren, och om arbetsgivaren d\u00e4rvid handlat i strid med god sed p\u00e5 arbetsmarknaden, eller annars m\u00e5ste anses ha handlat otillb\u00f6rligt. Det kr\u00e4vs inte att arbetsgivaren har syftat till att f\u00f6rm\u00e5 arbetstagaren att l\u00e4mna sin anst\u00e4llning, utan det \u00e4r tillr\u00e4ckligt att arbetsgivaren insett att denne genom sitt handlande har framkallat en sv\u00e5r situation f\u00f6r arbetstagaren och d\u00e4rmed en risk f\u00f6r att hen l\u00e4mnar sin anst\u00e4llning.<\/p>\n\n\n\n<p>Arbetsdomstolen gjorde sammanfattningsvis f\u00f6ljande bed\u00f6mning i det aktuella m\u00e5let.<\/p>\n\n\n\n<p>Att GRP upplevt att det varit en antiromsk jargong p\u00e5 arbetsplatsen fick, enligt Arbetsdomstolen, st\u00f6d av vad bl.a. hennes f\u00f6r\u00e4ldrar, sambo och andra sl\u00e4ktingar ber\u00e4ttat om att hon hade uppgett till dem. Arbetsdomstolen fann inte anledning att betvivla GRP:s uppgifter om att det i butiken, av anst\u00e4llda, f\u00f6rekommit neds\u00e4ttande uttalanden om romer och att anst\u00e4llda ben\u00e4mnt romer som \u201dzigenare\u201d.<\/p>\n\n\n\n<p>Enligt Arbetsdomstolens mening m\u00e5ste det, efter att GRP:s morbror bes\u00f6kte butiken vid \u00e5rsskiftet 2020\/2021, ha st\u00e5tt klart f\u00f6r butiksledningen att GRP hade romskt ursprung. Av vad f\u00f6rbundets f\u00f6rh\u00f6rspersoner ber\u00e4ttat gick det dock inte, enligt Arbetsdomstolens mening, att fastsl\u00e5 att antiromska uttalanden hade f\u00e4llts efter att GRP:s etniska ursprung blivit k\u00e4nt vid \u00e5rsskiftet 2020\/2021.<\/p>\n\n\n\n<p>F\u00f6rbundet hade vidare p\u00e5st\u00e5tt att den bitr\u00e4dande butikschefen, en dag inf\u00f6r kunder, skulle ha sk\u00e4llt ut GRP f\u00f6r att ha arbetat l\u00e5ngsamt, trots att hon k\u00e4nde till att GRP hade skadat sin hand. Arbetsdomstolens slutsats blev dock att f\u00f6rbundet inte lyckades styrka sitt p\u00e5st\u00e5ende d\u00e4rom. Enligt Arbetsdomstolens bed\u00f6mning gick det inte att utesluta att den bitr\u00e4dande butikschefen varit ovetandes om att GRP hade en skadad hand vid tillf\u00e4llet.<\/p>\n\n\n\n<p>Parterna i m\u00e5let var vidare oeniga betr\u00e4ffande huruvida GRP, vid ett medarbetarsamtal i januari 2021, ber\u00e4ttade att hon var missn\u00f6jd med ledarskapet, att ledningen tog st\u00e4llning, pratade illa om arbetskamrater och skapade konflikter mellan dem. Arbetsdomstolen ans\u00e5g att det inte var utrett att GRP, vid detta tillf\u00e4lle, hade uppm\u00e4rksammat butikschefen p\u00e5 de enligt henne d\u00e5liga arbetsf\u00f6rh\u00e5llandena.<\/p>\n\n\n\n<p>F\u00f6rbundet hade vidare gjort g\u00e4llande att butiksledningen utsatt GRP f\u00f6r neds\u00e4ttande och kr\u00e4nkande kommentarer, varit kritiska mot henne inf\u00f6r kunder, skapat konflikter mellan henne och arbetskamrater samt st\u00e4llt henne utanf\u00f6r den sociala gemenskapen p\u00e5 arbetsplatsen. Arbetsdomstolen framh\u00f6ll inledningsvis att GRP och arbetsgivarparternas f\u00f6rh\u00f6rspersoner hade gett helt olika bilder av detta. Enligt Arbetsdomstolens mening var det visat att GRP i vart fall sj\u00e4lv inte varit n\u00f6jd med arbetsf\u00f6rh\u00e5llandena, men utredningen ans\u00e5gs inte ge n\u00e5gon klar bild av orsaken d\u00e4rtill. Enligt Arbetsdomstolen var det inte heller visat att GRP skulle ha uppm\u00e4rksammat butiksledningen eller annan f\u00f6retr\u00e4dare f\u00f6r bolaget p\u00e5 att hon ans\u00e5g sig utsatt f\u00f6r kr\u00e4nkande behandling.<\/p>\n\n\n\n<p>Arbetsdomstolen ans\u00e5g vidare att f\u00f6rbundet inte kunde anses ha visat att sk\u00e4let till att GRP valde att s\u00e4ga upp sig var kr\u00e4nkande behandling fr\u00e5n butiksledningens sida. Det gick inte att dra slutsatsen att butiksledningen, innan GRP:s upps\u00e4gning, agerat p\u00e5 det s\u00e4tt som f\u00f6rbundet hade p\u00e5st\u00e5tt. Enligt Arbetsdomstolen framstod det inte som fr\u00e4mmande att anta att en starkt bidragande orsak till tvistens uppkomst var h\u00e4ndelsef\u00f6rloppet vid ett m\u00f6te som \u00e4gde rum dagen efter att GRP sa upp sig.<\/p>\n\n\n\n<p>Arbetsdomstolens sammanfattande bed\u00f6mning blev att det inte var visat att bolaget f\u00f6re upps\u00e4gningen handlat otillb\u00f6rligt och i strid mot lag och god sed p\u00e5 arbetsmarknaden och d\u00e4rmed f\u00f6ranlett GRP:s upps\u00e4gning.
