Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n\n<h3 class=\"wp-block-heading\"><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/2023\/2023-02-22-ad-2023-nr-8\/\"><strong>AD 2023 nr 0<\/strong>8<\/a><\/h3>\n\n\n\n<p><strong>Fr\u00e5gor om avvisning, Arbetsdomstolens beh\u00f6righet, och h\u00e4nvisning av m\u00e5l fr\u00e5n Arbetsdomstolen till tingsr\u00e4tt. Arbetsdomstolen pr\u00f6vade d\u00e4rvid bl.a. om en talan skulle avvisas pga. att f\u00f6rhandlingskravet enligt 4 kap. 7 \u00a7 arbetstvistlagen (\u201dLRA\u201d) ej var uppfyllt.<\/strong><\/p>\n\n\n\n<p>Flera tvister om skadest\u00e5ndsskyldighet pga. brott mot bl.a. f\u00f6retagshemlighetslagen handlades gemensamt i Arbetsdomstolen efter att de \u00f6verl\u00e4mnats av Skellefte\u00e5 tingsr\u00e4tt till Arbetsdomstolen.<\/p>\n\n\n\n<p>En av tvisterna \u2013 en arbetsgivarorganisations talan mot en facklig organisation och dess medlem \u2013 avvisades emellertid av Arbetsdomstolen, efter inv\u00e4ndning av svarandena. Sk\u00e4let f\u00f6r detta var att Arbetsdomstolen fann att f\u00f6rhandlingskravet enligt 4 kap. 7 \u00a7 LRA inte var uppfyllt. Vid pr\u00f6vningen av huruvida f\u00f6rhandlingskravet var uppfyllt uttalade sig Arbetsdomstolen bl.a. kring den s\u00e5 kallade \u201dk\u00e4nnedomstidpunkten\u201d \u2013 som inneb\u00e4r att en f\u00f6rhandlingsber\u00e4ttigad part ska p\u00e5kalla f\u00f6rhandling inom fyra m\u00e5nader fr\u00e5n det att parten fick k\u00e4nnedom om det f\u00f6rh\u00e5llande som ett r\u00e4ttsanspr\u00e5k h\u00e4nf\u00f6r sig till. Med h\u00e4nvisning till tidigare praxis (AD 2004 nr 8) uttalade Arbetsdomstolen att den \u201dk\u00e4nnedom\u201d som avses g\u00e4ller faktiska omst\u00e4ndigheter \u2013 beslut och \u00e5tg\u00e4rder \u2013 men inte samtliga f\u00f6rh\u00e5llanden som g\u00f6r att det g\u00e5r att bed\u00f6ma om det finns tillr\u00e4cklig grund f\u00f6r ett visst anspr\u00e5k eller om tvist kan s\u00e4gas f\u00f6religga. I det aktuella fallet ans\u00e5g Arbetsdomstolen att bolaget haft tillr\u00e4cklig kunskap om de faktiska f\u00f6rh\u00e5llanden \u2013 dvs. om de omst\u00e4ndigheter som talan grundades p\u00e5 \u2013 senast den 5 januari 2021 n\u00e4r bolaget skickade ett brev till motparten. F\u00f6rhandling skulle d\u00e4rf\u00f6r ha p\u00e5kallats senast den 5 maj 2021.<\/p>\n\n\n\n<p>Arbetsdomstolen avf\u00e4rdade en inv\u00e4ndning fr\u00e5n k\u00e4randen avseende att bolagets k\u00e4nnedom skulle r\u00e4knas fr\u00e5n ett senare datum, n\u00e4mligen d\u00e5 bolaget fick k\u00e4nnedom om den f\u00f6re detta arbetstagarens fackliga medlemskap. Enligt Arbetsdomstolens mening framkom inga omst\u00e4ndigheter som gav st\u00f6d f\u00f6r att man skulle tolka in att kravet p\u00e5 k\u00e4nnedom \u00e4ven avs\u00e5g k\u00e4nnedom om medlemskap i organisation som omfattas av f\u00f6rhandlingsordningens till\u00e4mplighet.<\/p>\n\n\n\n<p>Arbetsdomstolen konstaterade sedermera att redan k\u00e4randens egen inst\u00e4llning om n\u00e4r f\u00f6rhandling p\u00e5kallades innebar att f\u00f6rhandling hade p\u00e5kallats f\u00f6r sent. Det var ostridigt att n\u00e5gon f\u00f6rhandling i sak om bolagets anspr\u00e5k mot den f\u00f6re detta arbetstagaren inte kommit till st\u00e5nd. Med denna bed\u00f6mning fann Arbetsdomstolen att det saknades sk\u00e4l att ta st\u00e4llning till om f\u00f6rhandling skett inom den absoluta fristen om tv\u00e5 \u00e5r. Sammanfattningsvis fann Arbetsdomstolen att bolaget inte hade p\u00e5kallat f\u00f6rhandling i r\u00e4tt tid enligt f\u00f6rhandlingsordningen, och d\u00e4rmed f\u00f6rsuttit sin r\u00e4tt att v\u00e4cka talan i domstol. Denna talan avvisades allts\u00e5 d\u00e4rf\u00f6r av Arbetsdomstolen.<\/p>\n\n\n\n<p>Givet detta fann Arbetsdomstolen att den inte l\u00e4ngre var beh\u00f6rig att pr\u00f6va tvisterna mot de \u00f6vriga svarandena. I det ena fallet pga. att arbetsgivarorganisationen inte f\u00f6rde bolagets talan, och eftersom bolaget inte heller sj\u00e4lv slutit kollektivavtal. Vid detta f\u00f6rh\u00e5llande fann Arbetsdomstolen att den inte heller var beh\u00f6rig att pr\u00f6va bolagets talan mot resterande tv\u00e5 svaranden, eftersom det inte var en arbetstvist.<\/p>\n\n\n\n<p>Fr\u00e5ga uppkom d\u00e4rvid om till vilken tingsr\u00e4tt dessa tvister skulle h\u00e4nvisas. Den \u00f6verl\u00e4mnande tingsr\u00e4tten (Skellefte\u00e5) var beh\u00f6rig domstol eftersom den fackligt anslutne arbetstagaren hade sin hemvist p\u00e5 den orten. Eftersom talan mot den personen avvisades i Arbetsdomstolen (pga. att f\u00f6rhandlingskravet enligt 4 kap. 7 \u00a7 LRA inte ans\u00e5gs uppfyllt) konstaterade Arbetsdomstolen att den \u00f6verl\u00e4mnande tingsr\u00e4tten inte l\u00e4ngre var beh\u00f6rig att pr\u00f6va tvisterna mot de \u00f6vriga svarandena, eftersom dessa hade hemvist och s\u00e4te p\u00e5 en annan ort.
