Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/2022\/2022-12-07-ad-2022-nr-52\/\" target=\"_blank\" rel=\"noopener\"><strong>AD 2022 nr 52<\/strong><\/a><\/h3>\n<p><strong>I m\u00e5leriavtalet finns alternativa kompetenskrav f\u00f6r att en arbetsgivare ska f\u00e5 anst\u00e4lla en m\u00e5lare. Fr\u00e5ga i m\u00e5let bland annat om m\u00e5leriavtalet inneb\u00e4r att det alternativa kravet p\u00e5 fyra \u00e5rs yrkeserfarenhet som m\u00e5lare enbart kan uppfyllas genom m\u00e5leriarbete hos arbetsgivare som d\u00e5 varit bunden av m\u00e5leriavtalet.<\/strong><\/p>\n<p>I m\u00e5leriavtalet \u00a7 2 anges f\u00f6ljande<\/p>\n<p><strong><em>\u00a7 2 Garantil\u00f6n, best\u00e4mmelser vid tidarbete i samband med ackord, l\u00e4gsta individuella till\u00e4gg samt sjuk- och helgl\u00f6n<\/em><\/strong><\/p>\n<p><em>Mom. a) 1. Arbetare, som kan f\u00f6rete utl\u00e4rlingsbetyg eller styrka att hen arbetat som m\u00e5lare minst fyra \u00e5r eller som genom utf\u00f6rande av ett genom kontroll av represen-tanter f\u00f6r de lokala parterna godk\u00e4nt arbetsprov styrkt sin yrkeskompetens skall i samband med ackord erh\u00e5lla garantil\u00f6n enligt f\u00f6ljande l\u00f6netabl\u00e5. <\/em><\/p>\n<p><em>\/&#8230;\/ <\/em><\/p>\n<ol start=\"3\">\n<li><em> Arbetare, som icke uppfyller n\u00e5got av de i f\u00f6rsta stycket stipulerade villkoren, kan endast anst\u00e4llas i enlighet med utbildningsavtalet.<\/em><\/li>\n<\/ol>\n<p>Mellan parterna i m\u00e5let var tvistigt om en arbetsgivare (\u201dbolaget\u201d) brutit mot m\u00e5leriavtalet genom att l\u00e5ta tv\u00e5 arbetstagare utf\u00f6ra m\u00e5leriarbete f\u00f6r bolagets r\u00e4kning. Parterna var oeniga om inneb\u00f6rden av \u00a7 2 Mom a) i kollektivavtalet. Enligt f\u00f6rbundet innebar det alternativa kravet att arbetaren ska ha utf\u00f6rt arbete som m\u00e5lare i minst fyra \u00e5r att m\u00e5leriarbetet m\u00e5ste ha utf\u00f6rts hos enbart f\u00f6retag bundna av m\u00e5leriavtalet, medan arbetsgivarparterna h\u00e4vdade att kravet p\u00e5 minst fyra \u00e5rs yrkeserfarenhet \u00e4ven kunde uppfyllas genom arbete hos arbetsgivare som inte varit bunden av m\u00e5leriavtalet.<\/p>\n<p>Parterna var vidare oeniga om de tv\u00e5 arbetstagarna haft fyra \u00e5rs yrkeserfarenhet som m\u00e5lare eller inte.<\/p>\n<p>F\u00f6rbundet menade att bolaget brutit mot m\u00e5leriavtalet och yrkade allm\u00e4nt skadest\u00e5nd f\u00f6r kollektivavtalsbrott.<\/p>\n<p>Arbetsdomstolen konstaterade inledningsvis att det av f\u00f6rbundet angivna kravet \u2013 att m\u00e5lare bara kan tillgodor\u00e4knas tid d\u00e5 denne utf\u00f6rt m\u00e5leriarbete hos arbetsgivare som d\u00e5 var bunden av m\u00e5leriavtalet \u2013 inte angavs i avtalstexten.<\/p>\n<p>Enligt Arbetsdomstolen fanns det inte n\u00e5gon utredning till st\u00f6d f\u00f6r att den gemensamma partsavsikten varit att best\u00e4mmelsen skulle ha just den inneb\u00f6rd som respektive part i m\u00e5let p\u00e5st\u00e5tt. Arbetsdomstolen fann vidare att det inte, genom utredningen i m\u00e5let, var utrett att det fanns en s\u00e5dan gemensam och av kollektivavtalsparterna k\u00e4nd och erk\u00e4nd avtalstill\u00e4mpning, som kunde ge ledning f\u00f6r bed\u00f6mningen.<\/p>\n<p>D\u00e4rmed \u00e5terstod f\u00f6r Arbetsdomstolen att bed\u00f6ma vilken slutsats som kunde dras i tolkningsfr\u00e5gan av best\u00e4mmelsens ordalydelse, och av systematiken i avtalet. Arbetsdomstolen konstaterade d\u00e4rvid att det inte fanns n\u00e5got uttryckligt krav i avtalstexten p\u00e5 att de fyra \u00e5rens yrkeserfarenhet som m\u00e5lare skulle ha f\u00f6rv\u00e4rvats hos enbart m\u00e5leriavtalsbundet f\u00f6retag. Enligt Arbetsdomstolens mening kr\u00e4vdes d\u00e5 att det fanns andra omst\u00e4ndigheter som med styrka talade f\u00f6r att best\u00e4mmelsen, trots sin ordalydelse, skulle ha en annan inneb\u00f6rd. N\u00e5gra s\u00e5dana omst\u00e4ndigheter ans\u00e5gs emellertid inte ha visats i m\u00e5let.<\/p>\n<p>Arbetsdomstolens slutsats blev s\u00e5lunda att det inte var visat att den omtvistade best\u00e4mmelsen i m\u00e5leriavtalet skulle tolkas s\u00e5 att det alternativa kravet p\u00e5 arbete som m\u00e5lare i minst fyra \u00e5r m\u00e5ste ha utf\u00f6rts enbart hos m\u00e5leriavtalsbunden arbetsgivare. Kravet p\u00e5 minst fyra \u00e5rs yrkeserfarenhet kunde s\u00e5ledes \u00e4ven uppfyllas genom arbete hos arbetsgivare som inte varit bunden av m\u00e5leriavtalet.<\/p>\n<p>Arbetsdomstolen fann vidare att det var visat att de tv\u00e5 arbetstagarna uppfyllde det i m\u00e5leriavtalet uppst\u00e4llda kravet p\u00e5 att ha arbetat som m\u00e5lare i minst fyra \u00e5r. Domstolen fann d\u00e4rvid att det saknades anledning att ifr\u00e5gas\u00e4tta arbetstagarnas egna under sanningsf\u00f6rs\u00e4kran l\u00e4mnade uppgifter d\u00e4rom, samt att deras uppgifter \u00e4ven vann st\u00f6d genom intyg som givits in i m\u00e5let.<\/p>\n<p>Arbetsdomstolens st\u00e4llningstaganden innebar att bolaget inte hade brutit mot m\u00e5leriavtalet. F\u00f6rbundets talan avslogs d\u00e4rf\u00f6r och Arbetsdomstolen f\u00f6rpliktade f\u00f6rbundet att ers\u00e4tta arbetsgivarparterna f\u00f6r deras r\u00e4tteg\u00e5ngskostnader.<\/p>\n<h3><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/2022\/2022-12-07-ad-2022-nr-53\/\" target=\"_blank\" rel=\"noopener\"><strong>AD 2022 nr 53<\/strong><\/a><\/h3>\n<p><strong>Fr\u00e5ga om en intensivv\u00e5rdssjuksk\u00f6terska, som varit f\u00f6r\u00e4ldraledig under i princip hela det \u00e5r som f\u00f6regick l\u00f6nerevisionen 2021, blivit missgynnad i strid med 16 \u00a7 f\u00f6r\u00e4ldraledighetslagen vid l\u00f6nerevisionen 2021.<\/strong><\/p>\n<p>Arbetstagaren JH hade arbetat som sjuksk\u00f6terska hos regionen sedan september 2008. Under perioden 2019-10-02 \u2013 2021-02-28 var JH f\u00f6r\u00e4ldraledig p\u00e5 heltid och under perioden 2021-03-01 \u2013 2021-06-21 var JH f\u00f6r\u00e4ldraledig p\u00e5 halvtid. V\u00e5ren 2021 genomf\u00f6rde regionen en l\u00f6nerevision d\u00e4r JH erh\u00f6ll en l\u00f6ne\u00f6kning med 2,8 procent. Parterna i m\u00e5let var oense om huruvida JH missgynnats av sk\u00e4l som hade samband med hennes f\u00f6r\u00e4ldraledighet vid l\u00f6nerevisionen 2021. Det var d\u00e4rvid tvistigt om JH erh\u00f6ll en s\u00e4mre l\u00f6neutveckling och l\u00e4gre l\u00f6n \u00e4n hon skulle ha haft om hon inte varit f\u00f6r\u00e4ldraledig.<\/p>\n<p>Diskrimineringsombudsmannen (DO) som f\u00f6retr\u00e4dde JH anf\u00f6rde att JH i f\u00f6rsta hand borde ha f\u00e5tt en l\u00f6ne\u00f6kning om 3,7 procent, motsvarande den l\u00f6neh\u00f6jning hon fick \u00e5ret dessf\u00f6rinnan. Under alla f\u00f6rh\u00e5llanden menade DO att JH \u00e5tminstone borde ha f\u00e5tt en l\u00f6ne\u00f6kning om 2,95 procent, vilket motsvarade det genomsnittliga l\u00f6nep\u00e5slaget f\u00f6r intensivv\u00e5rdssjuksk\u00f6terskor 2021. DO yrkade dels att regionen skulle betala JH ers\u00e4ttning f\u00f6r f\u00f6rlust av l\u00f6n, samt ers\u00e4ttning f\u00f6r kr\u00e4nkning med 40\u00a0000 kr.<\/p>\n<p>Arbetsdomstolen inledde med att pr\u00f6va huruvida regionen visat att det inte fanns n\u00e5got samband mellan l\u00f6nes\u00e4ttningen av JH och hennes f\u00f6r\u00e4ldraledighet. Regionen menade d\u00e4rvid att JH blev korrekt bed\u00f6md utifr\u00e5n g\u00e4llande l\u00f6nekriterier och kompetensmodell, och att det saknades samband mellan hennes l\u00f6neutfall och f\u00f6r\u00e4ldraledigheten.<\/p>\n<p>Enligt Arbetsdomstolens mening fanns det inte anledning att ifr\u00e5gas\u00e4tta regionens uppgift om att bed\u00f6mningen 2021 av JH:s prestationer grundades p\u00e5 hur hon hade arbetat tidigare \u00e5r. Enligt domstolen fick det d\u00e4rmed anses utrett att den nya bed\u00f6mningen 2021 och den d\u00e5 nya till\u00e4mpningen av l\u00f6nekriterierna hade sin grund i JH:s prestationer i tiden f\u00f6re f\u00f6r\u00e4ldraledigheten. Arbetsdomstolen godtog d\u00e4rmed inte DO:s p\u00e5st\u00e5ende om att regionen bed\u00f6mt medarbetarnas prestationer i f\u00f6rh\u00e5llande till l\u00f6nekriterierna p\u00e5 ett s\u00e4tt som kr\u00e4vt n\u00e4rvaro p\u00e5 arbetsplatsen under tiden f\u00f6re l\u00f6nerevisionen.<\/p>\n<p>Arbetsdomstolen framh\u00f6ll vidare att regionen uppgett att endast fyra personer, ut\u00f6ver JH, fick ett p\u00e5slag om 3,7 procent eller mer vid 2020 \u00e5rs l\u00f6nerevision, och av dessa fyra personer fick, enligt regionen, tre ett l\u00f6nep\u00e5slag under genomsnittet \u00e5r 2021. Arbetsdomstolen konstaterade d\u00e4rvid att JH s\u00e5ledes behandlades p\u00e5 ett likartat s\u00e4tt som flera av de andra intensivv\u00e5rdssjuksk\u00f6terskorna.<\/p>\n<p>Enligt Arbetsdomstolens mening var det genom utredningen visat att JH 2021 behandlades p\u00e5 samma s\u00e4tt som andra som hade f\u00e5tt ett h\u00f6gt procentuellt p\u00e5slag vid l\u00f6nerevisionen 2020. Regionen ans\u00e5gs ha visat att utfallet f\u00f6r JH:s del 2021 hade sin orsak i att l\u00f6nekriterierna hade till\u00e4mpats p\u00e5 ett s\u00e4tt 2020 som regionen 2021 ans\u00e5g var felaktigt. Det var d\u00e4rmed, enligt Arbetsdomstolen, \u00e4ven visat att det inte fanns n\u00e5got som helst samband mellan utfallet vid l\u00f6nerevisionen 2021. Arbetsdomstolens bed\u00f6mning innebar att JH d\u00e4rmed inte heller hade anledning att f\u00f6rv\u00e4nta sig ett genomsnittligt p\u00e5slag om i vart fall 2,95 procent.<\/p>\n<p>Arbetsdomstolens slutsats blev d\u00e4rmed att regionen inte hade missgynnat JH av sk\u00e4l som hade samband med hennes f\u00f6r\u00e4ldraledighet vid l\u00f6nerevisionen 2021. Arbetsgivaren hade s\u00e5ledes inte brutit mot missgynnandef\u00f6rbudet i 16 \u00a7 f\u00f6r\u00e4ldraledighetslagen.
