Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2022 nr 49<\/strong><\/h3>\n<p>En polis har efter s\u00e4kerhetspr\u00f6vning av Polismyndigheten inte l\u00e4ngre godk\u00e4nts f\u00f6r s\u00e4kerhetsklassat arbete och d\u00e4refter sagts upp av Polismyndigheten. Huvudfr\u00e5gan i m\u00e5let var huruvida det f\u00f6rel\u00e5g saklig grund att s\u00e4ga upp arbetstagaren d\u00e5 arbetsgivaren samtidigt var den myndighet som gjort s\u00e4kerhetspr\u00f6vningen.<\/p>\n<p>Av s\u00e4kerhetsskyddslagen framg\u00e5r bl.a. att s\u00e4kerhetspr\u00f6vningen syftar till att klarl\u00e4gga om en person kan antas vara lojal mot de intressen som skyddas i lagen och i \u00f6vrigt p\u00e5litlig fr\u00e5n s\u00e4kerhetssynpunkt. Ett beslut om att n\u00e5gon inte uppfyller kraven f\u00f6r godk\u00e4nd s\u00e4kerhetspr\u00f6vning kan inte \u00f6verklagas.<\/p>\n<p>Fr\u00e5gan om en statlig myndighets m\u00f6jlighet att skilja en arbetstagare fr\u00e5n anst\u00e4llningen med anledning av samma myndighets s\u00e4kerhetsbeslut har tidigare varit f\u00f6rem\u00e5l f\u00f6r Arbetsdomstolens pr\u00f6vning, AD 2019 nr 39, AD 2021 nr 63 och AD 2022 nr 3. Av avg\u00f6randena framg\u00e5r att n\u00e4r det \u00e4r anst\u00e4llningsmyndigheten som fattat beslut om att arbetstagaren inte l\u00e4ngre \u00e4r godk\u00e4nd f\u00f6r s\u00e4kerhetsklassad anst\u00e4llning och arbetsgivaren med anledning d\u00e4rav skiljt arbetstagaren fr\u00e5n anst\u00e4llningen, utg\u00f6r inte s\u00e4kerhets\u00adbeslutet i sig sk\u00e4l f\u00f6r att skilja arbetstagaren fr\u00e5n anst\u00e4llningen utan en pr\u00f6vning i sak ska g\u00f6ras enligt anst\u00e4llningsskyddslagen. Det ska d\u00e5 g\u00f6ras en pr\u00f6vning av om de faktiska omst\u00e4ndigheter som \u00e5beropats och styrkts inneb\u00e4r att det fanns laga sk\u00e4l f\u00f6r avskedandet eller saklig grund f\u00f6r upps\u00e4gningen.<\/p>\n<p>Arbetsdomstolen har i domarna fr\u00e5n 2019 -2022 \u00e4ven framh\u00e5llit att en pr\u00f6vning i sak av upps\u00e4gningen eller avskedandet \u00e4r en f\u00f6ruts\u00e4ttning f\u00f6r att kravet p\u00e5 domstolspr\u00f6v\u00adning enligt artikel 6.1 i Europakonventionen ska vara uppfyllt. Enligt artikel 6.1 i Europakonventionen tillf\u00f6rs\u00e4kras varje medborgare r\u00e4tten till en r\u00e4ttvis r\u00e4tteg\u00e5ng och att inf\u00f6r en oavh\u00e4ngig och opartisk domstol f\u00e5 sina civila r\u00e4ttigheter och skyldigheter pr\u00f6vade. Europakonventionen st\u00e4ller krav inte bara p\u00e5 en formell tillg\u00e5ng till domstols\u00adpr\u00f6vning utan \u00e4ven p\u00e5 att denna innefattar en reell och effektiv pr\u00f6vning av tvistefr\u00e5gan. Europadomstolen har i sin praxis fastslagit att \u00e4ven tvister om offentliga tj\u00e4nstem\u00e4ns anst\u00e4llning och anst\u00e4llningsvillkor, s\u00e5som poliser, som utg\u00e5ngspunkt utg\u00f6r en tvist om civila r\u00e4ttigheter och skyldigheter, varf\u00f6r artikel 6.1 \u00e4r till\u00e4mplig i s\u00e5dana situationer.<\/p>\n<p>I det nu aktuella m\u00e5let, AD 2022 nr 49, kom AD fram till att arbetsgivaren inte styrkt de p\u00e5st\u00e5enden som utgjorde grunden f\u00f6r s\u00e4kerhetsbeslutet varf\u00f6r upps\u00e4gningen ogiltigf\u00f6rklarades.<\/p>\n<p><strong>R\u00e4ttsl\u00e4get utanf\u00f6r det statliga omr\u00e5det<\/strong><\/p>\n<p>Utanf\u00f6r det statliga omr\u00e5det h\u00e4nder det inte att arbetsgivaren samtidigt \u00e4r den som gjort sj\u00e4lva s\u00e4kerhetspr\u00f6vningen. Om en anst\u00e4llning har kommit att st\u00e5 i strid med f\u00f6rfattning p\u00e5 ett definitivt s\u00e4tt, har det ansetts att arbetsgivaren kan skilja arbetstagaren fr\u00e5n anst\u00e4llningen utan att iaktta best\u00e4mmelserna i LAS, i vart fall om arbetstagaren inte alls f\u00e5r anv\u00e4ndas i den verksamhet arbetsgivaren bedriver (AD 1979 nr 90, AD 2000 nr 17 och AD 2016 nr 9). Det har d\u00e5 varit fr\u00e5ga om beslut fattade av n\u00e5gon annan \u00e4n arbetsgivaren i fr\u00e5ga om arbetstillst\u00e5nd, s\u00e4kerhetspr\u00f6vning eller godk\u00e4nnande av l\u00e4nsstyrelse av personal hos bevakningsf\u00f6retag.<\/p>\n<p>I AD 2000 nr 17 pr\u00f6vade Arbetsdomstolen om upps\u00e4gningen av en anst\u00e4lld hos ett bolag som bedrev restaurangverksamhet p\u00e5 en flygplats varit sakligt grundad. Upps\u00e4gningen hade skett med anledning av att Luftfartsverket, efter en pr\u00f6vning enligt s\u00e4kerhetsskyddslagen, fattat beslut om att den anst\u00e4llde inte kunde godk\u00e4nnas f\u00f6r arbete inom det s\u00e4kerhetsskyddade omr\u00e5de som flygplatsen utgjorde. Luftfartsverket hade funnit att arbetstagaren var ol\u00e4mplig fr\u00e5n s\u00e4kerhetssynpunkt. Arbetsdomstolen f\u00e4ste avg\u00f6rande vikt vid att bolaget inte hade n\u00e5got annat alternativ \u00e4n att r\u00e4tta sig efter Luftfartsverkets beslut. Arbetsdomstolen uttalade att \u00e4ven om domstolens pr\u00f6vning skulle resultera i att den anst\u00e4llde inte ans\u00e5gs utg\u00f6ra en s\u00e4kerhetsrisk skulle Luftfatsverkets beslut, riktat mot bolaget, kvarst\u00e5 vilket bolaget inte skulle vara ber\u00e4ttigat att bortse ifr\u00e5n. Eftersom Luftfartsverkets beslut innebar att arbetstagaren inte hade r\u00e4tt att vistas p\u00e5 arbetsplatsen ans\u00e5gs beslutet utg\u00f6ra ett s\u00e5dant r\u00e4ttsligt hinder som arbetsgivaren kan \u00e5beropa f\u00f6r att befria sig fr\u00e5n anst\u00e4llningsavtalet.<\/p>\n<p>En till\u00e4mpning av artikel 6.1 i Europakonventionen \u00e4ven p\u00e5 den privata arbetsmarknaden skulle ha lett till ett omv\u00e4nt resultat i r\u00e4ttsfallet AD 2000 nr 17. Den anst\u00e4llde som av Luftfartsverket bed\u00f6mdes ol\u00e4mplig ur s\u00e4kerhetssynpunkt fick inte en reell och effektiv pr\u00f6vning av tvistefr\u00e5gan utan AD konstaterade bara att myndighets\u00adbeslutet var ett r\u00e4ttsligt hinder som arbetsgivaren kunde \u00e5beropa f\u00f6r att befria sig fr\u00e5n anst\u00e4llningsavtalet.<\/p>\n<p>R\u00e4ttsl\u00e4get vad g\u00e4ller icke \u00f6verklagningsbara beslut enligt s\u00e4kerhetsskyddslagen p\u00e5 den privata delen av arbetsmarknaden f\u00e5r anses oklart.<\/p>\n<p><a href=\"https:\/\/www.arbetsdomstolen.se\/sv\/meddelade-domar\/\" target=\"_blank\" rel=\"noopener noreferrer\">L\u00e4s mer om domarna p\u00e5 Arbetsdomstolens hemsida.<\/a>\n","protected":false},"excerpt":{"rendered":"<p>H\u00e4r publicerar vi snabba, korta kommentarer av de viktigaste domarna under veckan i Arbetsdomstolen.
