I detta Arbetsgivarnytt informerar vi bland annat om vad som g\u00e4ller f\u00f6r avslutande av anst\u00e4llning vid hel sjukers\u00e4ttning och om F\u00f6rs\u00e4kringskassans f\u00f6rv\u00e4ntade utbyte av sjukpenning till sjukers\u00e4ttning f\u00f6r \u00e4ldre f\u00f6rs\u00e4krade. Lag\u00e4ndringarna tr\u00e4der i kraft den 1 september 2022. (Prop 2021\/22:220.)<\/p>\n<p><strong>Sjukers\u00e4ttning till \u00e4ldre i f\u00f6rv\u00e4rvsarbetande \u00e5lder<\/strong><\/p>\n<p>F\u00f6r f\u00f6rs\u00e4krad som har som mest fem \u00e5r kvar till den tidpunkt d\u00e5 sjukers\u00e4ttningen (tidigare f\u00f6rtidspension) som l\u00e4ngst kan utges \u2013 f\u00f6r n\u00e4rvarande 65 \u00e5r \u2013 ska bed\u00f6mningen av arbetsf\u00f6rm\u00e5gan f\u00f6r r\u00e4tt till sjukers\u00e4ttning begr\u00e4nsas. Det inneb\u00e4r att vid pr\u00f6vning av r\u00e4tt till sjukers\u00e4ttning ska bortses fr\u00e5n arbetsf\u00f6rm\u00e5ga som den f\u00f6rs\u00e4krade har i arbeten som \u00e4r normalt f\u00f6rekommande p\u00e5 arbetsmarknaden. Detta g\u00e4ller f\u00f6r f\u00f6rs\u00e4krad som uppn\u00e5tt viss \u00e5lder, f\u00f6r n\u00e4rvarande 60 \u00e5r. I st\u00e4llet ska den f\u00f6rs\u00e4krades arbetsf\u00f6rm\u00e5ga endast bed\u00f6mas i f\u00f6rh\u00e5llande till arbete som han eller hon har erfarenhet av de senaste femton \u00e5ren. Denna regel\u00e4ndring inneb\u00e4r att l\u00e4gre rehabiliterings- och omst\u00e4llningskrav st\u00e4lls p\u00e5 \u00e4ldre (60 \u00e5r) vid bed\u00f6mning av r\u00e4tten till sjukers\u00e4ttning.<\/p>\n<p>Sjukers\u00e4ttning utifr\u00e5n de nya mer gener\u00f6sa villkoren kan beviljas efter ans\u00f6kan fr\u00e5n den \u201d\u00e4ldre\u201d f\u00f6rs\u00e4krade, eller utan s\u00e5dan ans\u00f6kan d\u00e5 F\u00f6rs\u00e4kringskassan beslutar om utbyte av sjukpenning till sjukers\u00e4ttning.<\/p>\n<p><strong>Avslutad anst\u00e4llning vid beslut om sjukers\u00e4ttning<\/strong><\/p>\n<p>S\u00e5 snart arbetsgivaren f\u00e5tt k\u00e4nnedom om beslut om hel sjukers\u00e4ttning kan arbetsgivaren enligt 4 b lagen om anst\u00e4llningsskydd (LAS) meddela arbetstagaren skriftligen att anst\u00e4llningen kommer att avslutas. Reglerna om krav p\u00e5 saklig grund f\u00f6r upps\u00e4gning g\u00e4ller inte i denna situation.<\/p>\n<p><strong>Arbetsgivare med sjukskrivna anst\u00e4llda som fyllt 60 \u00e5r<\/strong><\/p>\n<p>Med dessa lag\u00e4ndringar f\u00f6rv\u00e4ntas F\u00f6rs\u00e4kringskassan genomf\u00f6ra utbyte av sjukpenning till sjukers\u00e4ttning f\u00f6r \u00e4ldre f\u00f6rs\u00e4krade. Det finns d\u00e4rf\u00f6r anledning f\u00f6r arbetsgivare att kontrollera om sjukers\u00e4ttning beviljats f\u00f6r sjukskrivna anst\u00e4llda som fyllt 60 \u00e5r. Detta kan exempelvis g\u00f6ras genom att arbetsgivaren av arbetstagaren beg\u00e4r en kopia p\u00e5 beslut om och utbetalning av ers\u00e4ttning fr\u00e5n F\u00f6rs\u00e4kringskassan.
