Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2022 nr 35<\/strong><\/h3>\n<p>M\u00e5let g\u00e4llde en expeditionsvakt vid hovr\u00e4tten som blivit uppsagd efter att Polismyndigheten interimistiskt st\u00e4ngt av honom f\u00f6r tj\u00e4nstg\u00f6ring som ordningsvakt. Med anledning av avst\u00e4ngningen fick han enligt lag inte utf\u00f6ra samtliga sina arbetsuppgifter varvid arbetsgivaren valde att s\u00e4ga upp honom p\u00e5 grund av personliga sk\u00e4l. Fr\u00e5ga i m\u00e5let var om arbetsgivaren f\u00f6ljt den sk tv\u00e5m\u00e5nadersregeln och om upps\u00e4gningen var sakligt grundad.<\/p>\n<p>Enligt 7 \u00a7 anst\u00e4llningsskyddslagen f\u00e5r en upps\u00e4gning inte grundas p\u00e5 omst\u00e4ndigheter som arbetsgivaren har k\u00e4nt till i mer \u00e4n tv\u00e5 m\u00e5nader innan underr\u00e4ttelse om upps\u00e4gning l\u00e4mnades. Regeln hindrar dock inte att en arbetsgivare st\u00f6djer sig p\u00e5 en omst\u00e4ndighet som denne k\u00e4nt till mer \u00e4n tv\u00e5 m\u00e5nader men som varit av mer fortl\u00f6pande karakt\u00e4r, dvs ett best\u00e5ende tillst\u00e5nd. Ett interimistiskt beslut av en myndighet som g\u00f6r att arbetstagaren inte f\u00e5r utf\u00f6ra alla eller n\u00e5gra arbetsuppgifter och d\u00e4rmed f\u00f6ljande tillf\u00e4lliga arbetsof\u00f6rm\u00e5ga, fick enligt Arbetsdomstolen, i regel anses vara ett fortl\u00f6pande f\u00f6rh\u00e5llande. En motsatt bed\u00f6mning skulle tvinga en arbetsgivare att agera snabbt mot en arbetstagare som bara tillf\u00e4lligt \u00e4r arbetsof\u00f6rm\u00f6gen. Arbetsdomstolen f\u00f6rtydligade att det sagda endast g\u00e4llde beslut som annan myndighet fattat \u00e4n den myndighet som beslutat att avsluta anst\u00e4llningen. I det f\u00f6revarande m\u00e5let ans\u00e5g Arbetsdomstolen att Polismyndighetens interimistiska beslut som ledde till arbetstagarens arbetsof\u00f6rm\u00e5ga utgjorde ett s\u00e5dant fortl\u00f6pande tillst\u00e5nd som inte tr\u00e4ffades av tv\u00e5m\u00e5nadersregeln. Att arbetsgivaren berett arbetstagaren vissa andra arbetsuppgifter efter avst\u00e4ngningen kunde inte enligt Arbetsdomstolen ha givit arbetstagaren fog f\u00f6r att anse att arbetsgivaren avst\u00e5tt fr\u00e5n att \u00e5beropa beslutet och den f\u00f6ljande arbetsof\u00f6rm\u00e5gan som sj\u00e4lvst\u00e4ndig upps\u00e4gningsgrund.<\/p>\n<p>I m\u00e5let var vidare tvistigt om expeditionsvakten hade kunnat omplaceras till en sju m\u00e5nader l\u00e5ng tidsbegr\u00e4nsad anst\u00e4llning som domstolshandl\u00e4ggare. Enligt arbetsgivaren saknade arbetstagaren tillr\u00e4ckliga kvalifikationer f\u00f6r tj\u00e4nsten d\u00e5 det uppst\u00e4lldes krav p\u00e5 tidigare arbete som domstolshandl\u00e4ggare i hovr\u00e4tten. Arbetsdomstolen ifr\u00e5gasatte inte att arbetet var f\u00f6rh\u00e5llandevis komplext och kr\u00e4vde en l\u00e5ng uppl\u00e4rningstid. Mot bakgrund av att anst\u00e4llningen var tidsbegr\u00e4nsad och syftade till att arbeta av balanser var kravet p\u00e5 tidigare erfarenhet inte obefogat. \u00c4ven om arbetstagaren hade erfarenhet av vissa enklare administrativa arbetsuppgifter fann Arbetsdomstolen att det inte var m\u00f6jligt f\u00f6r honom att, inom rimlig tid i f\u00f6rh\u00e5llande till l\u00e4ngden p\u00e5 den lediga anst\u00e4llningen, l\u00e4ra sig att arbeta sj\u00e4lvst\u00e4ndigt som domstolshandl\u00e4ggare.<\/p>\n<p>G\u00e4llande arbetstagarsidans inv\u00e4ndning om att arbetsgivaren bort ha omf\u00f6rdelat arbetsuppgifterna s\u00e5 att arbetstagaren kunnat beh\u00e5lla sin anst\u00e4llning, konstaterade Arbetsdomstolen f\u00f6ljande. Om ett externt beslut som \u00e4r slutligt och inte tidsbegr\u00e4nsat g\u00f6r att arbetstagaren inte \u00e4r beh\u00f6rig att utf\u00f6ra en del av sina arbetsuppgifter, m\u00e5ste anst\u00e4llningsmyndigheten n\u00e4r det \u00e4r m\u00f6jligt och sk\u00e4ligt erbjuda arbetstagaren annat arbete hos sig innan det finns saklig grund f\u00f6r upps\u00e4gning p\u00e5 grund av beslutet. \u00c4r det inte m\u00f6jligt eller sk\u00e4ligt att erbjuda arbetstagaren annat arbete, eller avb\u00f6jer arbetstagaren ett sk\u00e4ligt omplaceringserbjudande, finns det saklig grund f\u00f6r upps\u00e4gning p\u00e5 grund av beslutet och avsaknaden av omplaceringsm\u00f6jligheter. N\u00e5gra nya permanenta befattningar beh\u00f6ver inte inr\u00e4ttas. \u00c4r det fr\u00e5ga om att omf\u00f6rdela arbetsuppgifter m\u00e5ste beaktas bl.a. de nackdelar, besv\u00e4r och kostnader en omf\u00f6rdelning av arbetsuppgifter kan antas medf\u00f6ra f\u00f6r verksamheten, arbetsgivaren och arbetskamraterna. N\u00e4r det externa beslutet inte \u00e4r slutligt ska det s\u00e4rskilt beaktas under hur l\u00e5ng tid arbetstagaren kan antas vara f\u00f6rhindrad att utf\u00f6ra sina arbetsuppgifter.<\/p>\n<p>Av utredningen framgick att domstolen hade fem expeditionsvakter som arbetade enligt ett roterande schema varvid tv\u00e5 ansvarade f\u00f6r s\u00e4kerhetskontrollen, tv\u00e5 f\u00f6r informationsdisken och en utf\u00f6rde \u00f6vriga sysslor. F\u00f6r arbetet vid s\u00e4kerhetskrontollen och informationsdisken kr\u00e4vdes f\u00f6rordnande som ordningsvakt. Efter avst\u00e4ngningen omf\u00f6rdelade domstolen vakternas arbetsuppgifter s\u00e5 att den avst\u00e4ngda arbetstagaren st\u00e4ndigt fick utf\u00f6ra \u00f6vriga sysslor. D\u00e4rut\u00f6ver fick han under viss tid \u00e4ven andra arbetsuppgifter inom andra omr\u00e5den vid domstolen. Tidvis hade domstolen hyrt in ordningsvakter till en mycket h\u00f6g kostnad. Arbetsdomstolen fann att arbetstagaren m\u00e5ste ha f\u00f6rst\u00e5tt att hans ordningsvaktsf\u00f6rordnande hade haft avg\u00f6rande betydelse f\u00f6r att han anst\u00e4lldes. Vidare visade utredningen p\u00e5 att det var av vikt f\u00f6r verksamheten att samtliga expeditionsvakter hade s\u00e5dant f\u00f6rordnande och att \u00f6vriga vakter inte r\u00e4ckte till f\u00f6r att utf\u00f6ra s\u00e5dana sysslor, \u00e4ven om arbetstagaren tagit \u00f6ver mycket av \u00f6vriga sysslor. Sammanfattningsvis fann Arbetsdomstolen att arbetstagarens avst\u00e4ngning medf\u00f6rt betydande ol\u00e4genheter f\u00f6r arbetsgivarens m\u00f6jlighet att planera sin verksamhet och sin ekonomi. Avst\u00e4ngningen medf\u00f6rde \u00e4ven att \u00f6vriga vakter fick mindre variation i arbetet. De negativa konsekvenserna var s\u00e5dana som en arbetsgivare inte ska beh\u00f6va t\u00e5la under n\u00e5gon l\u00e4ngre tid. Vid upps\u00e4gningen hade arbetstagaren inte kunnat utf\u00f6ra de aktuella arbetsuppgifterna sedan ca fem m\u00e5nader och det fanns anledning att anta att han inte skulle f\u00e5 tj\u00e4nstg\u00f6ra som ordningsvakt f\u00f6rr\u00e4n tidigast efter ytterligare drygt ett \u00e5r. Arbetsgivarens intresse att kunna planera sin verksamhet och begr\u00e4nsa sin kostnad f\u00f6r extra personal ans\u00e5gs v\u00e4ga tyngre \u00e4n arbetstagarens intresse att ha kvar anst\u00e4llningen.
