Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2022 nr 34<\/strong><\/h3>\n<p>En arbetstagare med sjukdomen multipel skleros (MS) arbetade som administrat\u00f6r p\u00e5 Polismyndighetens bedr\u00e4gerisektion. Efter femton \u00e5rs anst\u00e4llning f\u00f6rv\u00e4rrades hennes tillst\u00e5nd efter ett skov \u00e5r 2017. Hon blev helt sjukskriven och \u00e5tergick sedan i arbete p\u00e5 deltid i olika omfattning och perioder. \u00c5r 2020 blev hon uppsagd fr\u00e5n sin anst\u00e4llning p\u00e5 grund av att hon enligt arbetsgivaren inte hade n\u00e5gon arbetsf\u00f6rm\u00e5ga av betydelse f\u00f6r anst\u00e4llningen. Fr\u00e5ga i m\u00e5let var om upps\u00e4gningen var sakligt grundad och stod i strid med diskrimineringslagen.<\/p>\n<p>Parterna i m\u00e5let var \u00f6verens om att sjukdomen utgjorde en funktionsneds\u00e4ttning i diskrimineringslagens mening.<\/p>\n<p>N\u00e5gon direkt diskriminering var det inte fr\u00e5ga om enligt Arbetsdomstolen, sedan arbetstagaren inte utan \u00e5tg\u00e4rder f\u00f6r tillg\u00e4nglighet befunnit sig i en j\u00e4mf\u00f6rbar situation med en person utan motsvarande funktionsneds\u00e4ttning. Vid pr\u00f6vningen av fr\u00e5gan om diskriminering genom bristande tillg\u00e4nglighet och om det funnits saklig grund f\u00f6r att arbetstagaren varaktigt inte kunde utf\u00f6ra arbete av betydelse f\u00f6r arbetsgivaren, beaktade Arbetsdomstolen f\u00f6ljande.<\/p>\n<p>Under en period hade arbetstagaren beretts plats p\u00e5 r\u00e4ttsavdelningen d\u00e4r hon pr\u00f6vat flera olika anpassade arbetsuppgifter. Polismyndigheten gjorde sedan en arbetsf\u00f6rm\u00e5gebed\u00f6mning som arbetstagaren och dess fackliga representant motsatt sig. Utredningen inneh\u00f6ll intervjuer, l\u00e4karintyg och underlag f\u00f6r omplacering. Underlaget visade p\u00e5 arbetstagarens begr\u00e4nsningar i arbetsf\u00f6rm\u00e5gan, t.ex. bristande simultankapacitet, sv\u00e5righeter att st\u00e5 och g\u00e5, infektionsk\u00e4nslighet samt ljud- och stressk\u00e4nslighet. Vidare framgick att arbetstagarens behov av arbetsanpassningar bestod av t.ex. stressfri milj\u00f6 utan f\u00f6r mycket ljud- och ljusintryck, m\u00f6jlighet att utf\u00f6ra en arbetsuppgift i taget i anpassat arbetstempo, korta arbetspass och att hon kunde begr\u00e4nsa sina kontakter med andra. Av arbetsgivarens omplaceringsutredningar framgick att samtliga lediga funktioner som funnits under de olika utredningstidpunkterna inte gick att anpassa utifr\u00e5n arbetstagarens arbetsf\u00f6rm\u00e5ga.<\/p>\n<p>G\u00e4llande arbetet som administrat\u00f6r p\u00e5 bedr\u00e4gerisektionen framgick av utredningen att arbetsuppgiften filmgranskning f\u00f6rutsatte simultankapacitet, vilket arbetstagaren hade sv\u00e5righeter med. Det fanns inte heller n\u00e5gra m\u00f6jligheter att, s\u00e5som f\u00f6rbundet f\u00f6reslagit, sk\u00f6ta arbetet fr\u00e5n en egen personlig dator i ett avskilt rum. Mot bakgrund av att arbetstagaren inte kunde g\u00e5 l\u00e4ngre str\u00e4ckor, st\u00e5 l\u00e4ngre stunder och hade nedsatt finmotorik bed\u00f6mdes posthantering inte som en l\u00e4mplig arbetsuppgift. En permanent omf\u00f6rdelning av dessa uppgifter var enligt Arbetsdomstolen inte sk\u00e4ligt, eftersom det hade inneburit att arbetstagaren befriades fr\u00e5n merparten av de arbetsuppgifter som ingick i en administrat\u00f6rs normala arbete p\u00e5 bedr\u00e4gerisektionen. Vid en samlad bed\u00f6mning fann Arbetsdomstolen s\u00e5ledes att Polismyndigheten fullgjort sina skyldigheter i fr\u00e5ga om rehabilitering, sk\u00e4lig anpassning och sk\u00e4liga \u00e5tg\u00e4rder f\u00f6r tillg\u00e4nglighet.<\/p>\n<p>Arbetstagaren ans\u00e5gs s\u00e5ledes inte ha blivit utsatt f\u00f6r diskriminering i form av bristande tillg\u00e4nglighet. Utredningen visade \u00e4ven att arbetstagaren, trots de \u00e5tg\u00e4rder arbetsgivaren vidtagit f\u00f6r att underl\u00e4tta f\u00f6r henne i arbetet, varaktigt inte l\u00e4ngre kunde utf\u00f6ra n\u00e5got arbete av n\u00e5gon betydelse f\u00f6r Polismyndigheten.
