De nya reglerna inneb\u00e4r bland annat krav p\u00e5 anst\u00e4llningsavtal vid ans\u00f6kan om arbetstillst\u00e5nd f\u00f6r utl\u00e4ndska medborgare fr\u00e5n l\u00e4nder utanf\u00f6r EU\/\/EES och Schweiz.\u00a0\u00c4ndringarna syftar till att motverka utnyttjande av arbetskraftsinvandrare samt till att attrahera och beh\u00e5lla internationell kompetens och motverka s\u00e5 kallade \u201dkompetensutvisningar\u201d. Nedan sammanfattar vi de viktigaste f\u00f6r\u00e4ndringarna.<\/p>\n<p><strong>Krav p\u00e5 anst\u00e4llningsavtal och att ge information vid \u00e4ndrade villkor<\/strong><\/p>\n<p>Vid ans\u00f6kan om arbetstillst\u00e5nd har det hittills funnits krav p\u00e5 att arbetsgivaren ska l\u00e4mna ett erbjudande om anst\u00e4llning (anst\u00e4llningserbjudande) i samband med ans\u00f6kan. De nya reglerna inneb\u00e4r, ut\u00f6ver anst\u00e4llningserbjudandet fr\u00e5n arbetsgivaren, nu \u00e4ven krav p\u00e5 anst\u00e4llningsavtal. Detta inneb\u00e4r att till samtliga ans\u00f6kningar om arbetstillst\u00e5nd fr\u00e5n och med den 1 juni 2022 ska bifogas ett undertecknat anst\u00e4llningsavtal. Anst\u00e4llningsavtalet ska vara undertecknat av b\u00e5de aktuell arbetsgivare och s\u00f6kanden. Migrationsverket accepterar inte anst\u00e4llningsavtal som \u00e4r signerade digitalt av parterna eftersom myndigheten saknar verktyg f\u00f6r att hantera digitalt signerade dokument.<\/p>\n<p>S\u00f6kande som har sin ordinarie anst\u00e4llning utomlands men kommer att vara utstationerad i Sverige ska bifoga dokument som visar vilka anst\u00e4llningsvillkor som ska g\u00e4lla under den tid som han eller hon arbetar i Sverige. \u00c4ven dessa dokument ska vara undertecknade av b\u00e5de arbetsgivaren och s\u00f6kanden.<\/p>\n<p>Det kommer att finnas m\u00f6jlighet f\u00f6r Migrationsverket att \u00e5l\u00e4gga arbetsgivare en skyldighet att anm\u00e4la om anst\u00e4llningsvillkoren \u00e4ndras och blir mindre f\u00f6rm\u00e5nliga. Ett av syftena med den nya regeln \u00e4r att komma \u00e5t problemet med utl\u00e4ndsk arbetskraft som g\u00e5r med p\u00e5 f\u00f6rs\u00e4mrade villkor f\u00f6r att f\u00e5 stanna i Sverige. Migrationsverket kan ocks\u00e5 f\u00f6rel\u00e4gga arbetsgivaren vid vite att l\u00e4mna skriftlig uppgift till myndigheten om de villkor som g\u00e4ller f\u00f6r utl\u00e4nningens anst\u00e4llning.<\/p>\n<p><strong>Tilltr\u00e4desdatum i anst\u00e4llningsavtal<\/strong><\/p>\n<p>F\u00f6r f\u00f6retag som anv\u00e4nder sig av Almegas tj\u00e4nst f\u00f6r snabbhantering av arbetstillst\u00e5nd har Migrationsverket tidigare utlovat en handl\u00e4ggningstid p\u00e5 10 respektive 20 arbetsdagar. Migrationsverket har nu meddelat att de f\u00f6r n\u00e4rvarande inte kan h\u00e5lla de utlovade handl\u00e4ggningstiderna. Detta inneb\u00e4r att kompletta ans\u00f6kningar som Almega skickat in till Migrationsverket nu har en handl\u00e4ggningstid p\u00e5 runt tre m\u00e5nader. Vi r\u00e5der d\u00e4rf\u00f6r v\u00e5ra underf\u00f6retag, vid en ans\u00f6kan om arbetstillst\u00e5nd, att skjuta fram tilltr\u00e4desdatumet f\u00f6r anst\u00e4llningen med 3-4 m\u00e5nader f\u00f6r att undvika att beh\u00f6va komplettera med nytt anst\u00e4llningsavtal.<\/p>\n<p>Har arbetstillst\u00e5nd inte beviljats p\u00e5 den tillt\u00e4nka tilltr\u00e4desdagen kan parterna komma \u00f6verens om att skjuta fram tidpunkten f\u00f6r tilltr\u00e4de samt l\u00e4mna in en komplettering om detta till Migrationsverket. Om n\u00e5gon av parterna i anst\u00e4llningsavtalet inte vill \u00e4ndra tilltr\u00e4desdagen och arbetstillst\u00e5nd inte beviljats p\u00e5 tilltr\u00e4desdagen kan anst\u00e4llningsavtalet h\u00e4vas.<\/p>\n<p><strong>\u00c4ndring i sammanlagda tiden f\u00f6r arbetstillst\u00e5nd<\/strong><\/p>\n<p>Enligt tidigare regler fanns en begr\u00e4nsning i hur l\u00e5ng den sammanlagda tillst\u00e5ndstiden fick vara f\u00f6r arbetstillst\u00e5nd. Begr\u00e4nsningen innebar att den sammanlagda tillst\u00e5ndstiden fick vara h\u00f6gst fyra \u00e5r, eller vid s\u00e4rskilda sk\u00e4l h\u00f6gst sex \u00e5r inom en sju\u00e5rsperiod. Denna begr\u00e4nsning tas nu bort.<\/p>\n<p>F\u00f6r\u00e4ndringen inneb\u00e4r en ny hantering av ans\u00f6kan f\u00f6r permanent uppeh\u00e5llstillst\u00e5nd. S\u00f6kande som uppfyller kraven enligt 5 kap. 5 \u00a7 utl\u00e4nningslagen och vill bos\u00e4tta sig i Sverige kan ans\u00f6ka om permanent uppeh\u00e5llstillst\u00e5nd. F\u00f6r att Migrationsverket ska pr\u00f6va fr\u00e5gan \u00e4r det upp till s\u00f6kanden sj\u00e4lv att uttryckligen ans\u00f6ka om permanent uppeh\u00e5llstillst\u00e5nd. Som angetts ovan inneb\u00e4r de nya reglerna att den tidigare g\u00e4llande begr\u00e4nsningen av sammanlagd tillst\u00e5ndstid tagits bort, vilket ger s\u00f6kanden m\u00f6jlighet att sj\u00e4lv v\u00e4lja om han eller hon vill ha ett tidsbegr\u00e4nsat arbetstillst\u00e5nd, utan krav p\u00e5 s\u00e4rskilda sk\u00e4l. Det inneb\u00e4r s\u00e5ledes att det inte kommer finnas n\u00e5gon gr\u00e4ns f\u00f6r hur m\u00e5nga tidsbegr\u00e4nsade arbetstillst\u00e5nd som kan utf\u00e4rdas f\u00f6r en s\u00f6kande.<\/p>\n<p><strong>Motverka kompetensutvisningar vid ringa avvikelser och fel<\/strong><\/p>\n<p>De nya reglerna inneb\u00e4r att ett tidsbegr\u00e4nsat uppeh\u00e5llstillst\u00e5nd f\u00f6r arbete inte beh\u00f6ver \u00e5terkallas p\u00e5 grund av mindre felaktigheter. Bed\u00f6mer Migrationsverket att det r\u00f6r sig om ett ringa fall av avvikelse under tillst\u00e5ndstiden eller om en \u00e5terkallelse med h\u00e4nsyn till omst\u00e4ndigheterna inte framst\u00e5r som sk\u00e4lig beh\u00f6ver tillst\u00e5ndet inte \u00e5terkallas. En bed\u00f6mning av vad som \u00e4r att anse som ringa fall av avvikelse g\u00f6rs i varje enskilt fall men kan vara till exempel avsaknad av f\u00f6rs\u00e4kring eller att arbetstagaren f\u00e5tt l\u00e4gre l\u00f6n under en kortare period.<\/p>\n<p><strong>Sammanfattning av \u00e4ndringarna:<\/strong><\/p>\n<ul>\n<li>Ett anst\u00e4llningsavtal ska kr\u00e4vas f\u00f6r att arbetstillst\u00e5nd ska kunna beviljas.<\/li>\n<li>Ett tidsbegr\u00e4nsat uppeh\u00e5llstillst\u00e5nd f\u00f6r arbete beh\u00f6ver inte \u00e5terkallas av Migrationsverket vid ringa fall av avvikelse eller om en \u00e5terkallelse med h\u00e4nsyn till omst\u00e4ndigheterna inte framst\u00e5r som sk\u00e4lig.<\/li>\n<li>Arbetsgivare kan \u00e5l\u00e4ggas en skyldighet att anm\u00e4la till Migrationsverket om anst\u00e4llningsvillkoren \u00e4ndras och blir mindre f\u00f6rm\u00e5nliga.<\/li>\n<li>Arbetsgivare f\u00e5r f\u00f6rel\u00e4ggas vid vite att l\u00e4mna skriftlig uppgift till Migrationsverket om de villkor som g\u00e4ller f\u00f6r utl\u00e4nningens anst\u00e4llning.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.regeringen.se\/regeringens-politik\/migration-och-asyl\/arbetskraftsinvandring-och-kompetensforsorjning\/\" target=\"_blank\" rel=\"noopener\">L\u00e4s mer om \u00e4ndringarna<\/a><\/p>\n<p><a href=\"https:\/\/www.almega.se\/arbetstillstand\" target=\"_blank\" rel=\"noopener\">Almegas tj\u00e4nst f\u00f6r snabbhantering av arbetstillst\u00e5nd<\/a>\n","protected":false},"excerpt":{"rendered":"<p>Nya regler g\u00e4ller i utl\u00e4nningslagen fr\u00e5n och med den 1 juni 2022 vilket p\u00e5verkar hanteringen av arbetstillst\u00e5nd.
