Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2022 nr 30<\/strong><\/h3>\n<p>Arbetstagarsidan yrkade allm\u00e4nt skadest\u00e5nd om en miljon kronor och gjorde g\u00e4llande att arbetsgivarorganisationen M\u00e5lerif\u00f6retagen vidtagit en otill\u00e5ten strids\u00e5tg\u00e4rd.<\/p>\n<p>Mellan parterna g\u00e4llde kollektivavtal. Under l\u00f6pande avtalsperiod d\u00e5 fredsplikt r\u00e5dde l\u00e4mnade M\u00e5lerif\u00f6retagen in en anm\u00e4lan till Konkurrensverket om konkurrensbegr\u00e4nsande effekter i kollektivavtalet. M\u00e5lerif\u00f6retagen beg\u00e4rde att myndigheten skulle \u00e5l\u00e4gga arbetsgivarorganisationens medlemmar att inte till\u00e4mpa en viss reglering i kollektivavtalet. Enligt M\u00e5lerif\u00f6retagen innebar den aktuella best\u00e4mmelsen ett anst\u00e4llningsf\u00f6rbud mot att ha outbildade arbetstagare.<\/p>\n<p>Arbetsdomstolen redogjorde inledningsvis vad som kan betecknas som en strids\u00e5tg\u00e4rd. I princip varje handling eller underl\u00e5tenhet som kan inverka p\u00e5 motparten kan vara en strids\u00e5tg\u00e4rd. Avg\u00f6rande \u00e4r i vilket syfte \u00e5tg\u00e4rden vidtagits. Om \u00e5tg\u00e4rden vidtagits f\u00f6r att \u00e5stadkomma \u00e4ndring i g\u00e4llande kollektivavtal \u00e4r det fr\u00e5ga om en strids\u00e5tg\u00e4rd. Av domstolens praxis framg\u00e5r att den \u00e5tg\u00e4rd som part i god tro vidtagit genom att ha ut\u00f6vat en befogenhet som tillkommer parten enligt lag eller avtal utg\u00f6r en strids\u00e5tg\u00e4rd om \u00e5tg\u00e4rden vidtagits i n\u00e5got annat syfte \u00e4n det som \u00e4r \u00e4ndam\u00e5let med befogenheten.<\/p>\n<p>Arbetsdomstolen fann att M\u00e5lerif\u00f6retagen vidtagit en \u00e5tg\u00e4rd som i och f\u00f6r sig kan vara en strids\u00e5tg\u00e4rd, d\u00e5 ett bifall till dess beg\u00e4ran hos Konkurrensverket skulle ha haft en inverkan p\u00e5 f\u00f6rbundet i fr\u00e5ga om inneh\u00e5llet i kollektivavtalet. Fr\u00e5gan i m\u00e5let var om M\u00e5lerif\u00f6retagen med sin anm\u00e4lan till Konkurrensverket hade syftat till att ut\u00f6va p\u00e5tryckning p\u00e5 f\u00f6rbundet. Det var ostridigt i m\u00e5let att bakgrunden till anm\u00e4lan var att f\u00f6rbundet sagt upp det servicearbetaravtal som g\u00e4llt mellan parterna.<\/p>\n<p>Arbetstagarsidan gjorde g\u00e4llande att anm\u00e4lan gjorts mot b\u00e4ttre vetande eller i ond tro i syfte att ut\u00f6va p\u00e5tryckning p\u00e5 f\u00f6rbundet att g\u00e5 med p\u00e5 att ta bort kravet p\u00e5 yrkeskompetens f\u00f6r enklare m\u00e5leriarbeten genom att p\u00e5 nytt teckna ett servicearbetaravtal. \u00c5tg\u00e4rden var enligt f\u00f6rbundet olovlig d\u00e5 den dels inte beslutats om i beh\u00f6rig ordning, dels d\u00e5 syftet varit att \u00e5stadkomma \u00e4ndring i kollektivavtalet.\u00a0Arbetsgivarsidan gjorde \u00e5 sin sida g\u00e4llande att anm\u00e4lan syftade till att klarg\u00f6ra om m\u00e5lerif\u00f6retag sinsemellan fick till\u00e4mpa best\u00e4mmelsen om anst\u00e4llningsf\u00f6rbud eller om det utgjorde en otill\u00e5ten konkurrensbegr\u00e4nsning.<\/p>\n<p>Enligt Arbetsdomstolen var M\u00e5lerif\u00f6retagens prim\u00e4ra syfte att f\u00e5 utrett om kollektivavtalet inneb\u00e4r en konkurrensbegr\u00e4nsning. Det m\u00e5ste dock ha st\u00e5tt klart f\u00f6r M\u00e5lerif\u00f6retagen att anm\u00e4lan \u00e4ven kunde f\u00e5 bieffekten att den kunde utg\u00f6ra en p\u00e5tryckning p\u00e5 f\u00f6rbundet i avtalsfr\u00e5gan. En strids\u00e5tg\u00e4rd kunde enligt Arbetsdomstolen dock anses f\u00f6religga endast om \u00e5tg\u00e4rden vidtagits prim\u00e4rt och i direkt syfte att \u00e5stadkomma en p\u00e5tryckning p\u00e5 motparten. Utredningen gav inte tillr\u00e4ckligt st\u00f6d f\u00f6r att anta att anm\u00e4lan hade s\u00e5dant prim\u00e4rt och direkt syfte.
