Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2022 nr 28<\/strong><\/h3>\n<p>M\u00e5let g\u00e4llde fr\u00e5ga om en statlig myndighet hade l\u00e4mnat en provanst\u00e4lld arbetstagare ett skriftligt besked om att han skiljdes fr\u00e5n anst\u00e4llningen p\u00e5 det s\u00e4tt som kr\u00e4vs enligt 8 \u00a7 lagen om offentlig anst\u00e4llning (LOA).<\/p>\n<p>Arbetstagaren hade tidigare varit anst\u00e4lld som vikarie hos Polismyndigheten och sedan tr\u00e4ffat avtal om sex m\u00e5naders provanst\u00e4llning. Dagen f\u00f6re tilltr\u00e4det fick arbetstagaren muntligt besked fr\u00e5n sin chef om att provanst\u00e4llningen skulle avbrytas eller aldrig tilltr\u00e4das d\u00e5 arbetstagaren underk\u00e4nts vid en f\u00f6rnyad s\u00e4kerhetspr\u00f6vning. P\u00e5 provanst\u00e4llningens tilltr\u00e4desdag \u00f6verl\u00e4mnades en skriftlig handling som signerades av arbetstagaren och \u00e5tertogs i original av arbetsgivaren utan att n\u00e5gon kopia \u00f6verl\u00e4mnades. Handlingen inneh\u00f6ll en underr\u00e4ttelse om att provanst\u00e4llningen \u201davses upph\u00f6ra\u201d och att arbetstagaren hade r\u00e4tt till \u00f6verl\u00e4ggning om det \u201dtillt\u00e4nkta beskedet\u201d. N\u00e5got annat skriftligt meddelande om avbrytande av provanst\u00e4llning l\u00e4mnades inte. I m\u00e5let var ostridigt att arbetstagaren ins\u00e5g att Polismyndigheten genom f\u00f6rfarandet ville avbryta den avtalade provanst\u00e4llningen. Dagen efter m\u00f6tet hade han anm\u00e4lt sig som arbetss\u00f6kande hos Arbetsf\u00f6rmedlingen. Sex m\u00e5nader senare p\u00e5kallade f\u00f6rbundet f\u00f6rhandling och menade att arbetstagaren ans\u00e5g sig anst\u00e4lld \u00e4ven efter m\u00f6tet.<\/p>\n<p>Enligt 8 \u00a7 LOA ska ett besked fr\u00e5n arbetsgivaren om skiljande fr\u00e5n en provanst\u00e4llning vara skriftligt f\u00f6r att vara giltigt. Arbetstagarsidan yrkade att domstolen skulle fastst\u00e4lla att arbetstagarens anst\u00e4llning hos Polismyndigheten bestod. Arbetsgivarparternas inv\u00e4ndning om att talan var preskriberad avslogs. F\u00f6rbundet hade n\u00e4mligen inte gjort g\u00e4llande att anst\u00e4llningsavtalet tidsbegr\u00e4nsats i strid med LAS eller att arbetsgivaren brutit mot LAS \u00f6ver huvud taget, varvid preskriptionsbest\u00e4mmelsen i 40 \u00a7 andra stycket inte var direkt till\u00e4mplig. Enligt Arbetsdomstolens praxis ska analog till\u00e4mpning av preskriptionsregler ske med stor restriktivitet. F\u00f6ruts\u00e4ttningar f\u00f6r analog till\u00e4mpning var inte vid handen i detta fall.<\/p>\n<p>Av utredningen fann Arbetsdomstolen att Polismyndigheten ansett att den \u00f6verl\u00e4mnade handlingen innebar att arbetstagarens anst\u00e4llning skulle upph\u00f6ra omedelbart och arbetstagaren hade f\u00f6rst\u00e5tt detta. H\u00e4rigenom hade Polismyndigheten enligt Arbetsdomstolen, trots formuleringarna i handlingen, l\u00e4mnat ett skriftligt besked om att skilja arbetstagaren fr\u00e5n provanst\u00e4llningen p\u00e5 det s\u00e4tt som kr\u00e4vs enligt 8 \u00a7LOA. Provanst\u00e4llningen hade s\u00e5ledes avbrutits p\u00e5 tilltr\u00e4desdagen.<\/p>\n<p><strong>AD 2022 29<\/strong><\/p>\n<p>Fr\u00e5ga i m\u00e5let var om fyra brandm\u00e4n i beredskap var att betrakta som deltidsanst\u00e4llda och om arbetsgivaren brutit mot 25 a \u00a7 LAS n\u00e4r dessa brandm\u00e4n inte erbjudits heltidsanst\u00e4llningar n\u00e4r nya brandm\u00e4n anst\u00e4lldes. Arbetstagarna hade anm\u00e4lt att de ville ha h\u00f6gre syssels\u00e4ttningsgrad. Det var ostridigt i m\u00e5let att de hade tillr\u00e4ckliga kvalifikationer f\u00f6r heltidstj\u00e4nsterna.<\/p>\n<p>Arbetsdomstolen konstaterade inledningsvis att det av f\u00f6rfattningskommentaren till lagbest\u00e4mmelsen framg\u00e5r att fr\u00e5gan om vad som \u00e4r en anst\u00e4llning p\u00e5 deltid i det enskilda fallet f\u00e5r avg\u00f6ras genom en j\u00e4mf\u00f6relse med vad som g\u00e4ller enligt till\u00e4mpligt kollektivavtal eller annars \u00e4r brukligt inom branschen. Av utredningen framgick att det inom r\u00e4ddningstj\u00e4nsten fanns heltidsbrandm\u00e4n och brandm\u00e4n i beredskap som omfattades av tv\u00e5 olika kollektivavtal. Fram tills \u00e5r 2004 hade beredskapsbrandm\u00e4nnen ben\u00e4mnts deltidsbrandm\u00e4n i kollektivavtalet. Vidare framgick att beredskapsbrandm\u00e4nnen, till skillnad fr\u00e5n \u00f6vriga brandm\u00e4n, inte bemannade brandstationerna regelbundet. De hade sin huvudsakliga anst\u00e4llning hos en annan arbetsgivare. N\u00e4r de hade beredskap hade de tillst\u00e5nd av sin ordinarie arbetsgivaren att omedelbart l\u00e4mna sitt arbete i h\u00e4ndelse av larm.<\/p>\n<p>Enligt Arbetsdomstolen hade kollektivavtalet f\u00f6r beredskapsbrandm\u00e4nnen till syfte att reglera villkoren f\u00f6r brandm\u00e4n som hade beredskapstj\u00e4nstg\u00f6ring som en bisyssla. Dessa brandm\u00e4n arbetade s\u00e5ledes typiskt sett inte heltid. N\u00e5gon syssels\u00e4ttningsgrad fanns inte angiven i kollektivavtalet utan anst\u00e4llningen var avsedd som ett extra arbete och inte en deltidsanst\u00e4llning som det begreppet normalt anv\u00e4nds. Beredskapsbrandm\u00e4nnen arbetade i genomsnitt mellan tio och 17 timmar per m\u00e5nad. I j\u00e4mf\u00f6relse med heltidsbrandm\u00e4nnen ans\u00e5g Arbetsdomstolen att beredskapsbrandm\u00e4nnen fick anses vara anst\u00e4llda p\u00e5 deltid. De omfattades s\u00e5ledes av 25 a \u00a7 LAS. Arbetsgivarens behov av heltidsbrandm\u00e4n ans\u00e5gs kunna tillgodoses genom att de fyra arbetstagarna som anm\u00e4lt \u00f6nskem\u00e5l om h\u00f6gre syssels\u00e4ttningsgrad anst\u00e4lldes som heltidsbrandm\u00e4n.
