Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2022 nr 26<\/strong><\/h3>\n<p>Ett bolag hade ans\u00f6kt och beviljats f\u00f6retagsrekonstruktion varefter en anst\u00e4lld blev uppsagd pga arbetsbrist. Fr\u00e5ga i m\u00e5let g\u00e4llde om arbetstagarens fordran p\u00e5 bl a l\u00f6n och semesterers\u00e4ttning omfattades av ackordet eller inte.<\/p>\n<p>Bolaget ans\u00f6kte och beviljades f\u00f6retagsrekonstruktion den 24 januari 2020 (den sk kritiska tidpunkten). Arbetstagaren blev uppsagd den 21 februari och arbetsbefriad fr o m den 1 mars. En stor del av upps\u00e4gningsl\u00f6nen kom att t\u00e4ckas av l\u00f6negarantin, dock inte l\u00f6n f\u00f6r den senare delen av upps\u00e4gningstiden motsvarande ca 1,5 m\u00e5nad. Bolaget betalade, med till\u00e4mpning av ett fastst\u00e4llt offentligt ackord, viss ers\u00e4ttning till arbetstagaren f\u00f6r den sistn\u00e4mnda perioden. Arbetstagaren yrkade ers\u00e4ttning f\u00f6r resterande l\u00f6n och semesterf\u00f6rm\u00e5ner under den senare delen av upps\u00e4gningstiden som bolaget inte redan ersatt, ers\u00e4ttning f\u00f6r fem sparade semesterdagar som intj\u00e4nats f\u00f6re den 1 april 2018 och slutligen ers\u00e4ttning f\u00f6r kompensationstid intj\u00e4nad f\u00f6re den 25 oktober 2019. Den huvudsakliga tvistefr\u00e5gan i m\u00e5let var om fordringarna uppkommit f\u00f6re eller efter den sk kritiska tidpunkten.<\/p>\n<p>Enligt lagen om f\u00f6retagsrekonstruktion ska fordringar som uppkommit f\u00f6re en ans\u00f6kan om f\u00f6retagsrekonstruktion omfattas av ackordet och ska d\u00e4rmed s\u00e4ttas ned p\u00e5 s\u00e4tt som anges i det antagna ackordet. L\u00f6negaranti betalas inte f\u00f6r l\u00f6nefordringar som bel\u00f6per p\u00e5 tiden efter en m\u00e5nad efter beslutet om f\u00f6retagsrekonstruktion. I normalfallet inneb\u00e4r detta att arbetstagaren under den f\u00f6rsta m\u00e5naden efter beslutet om f\u00f6retagsrekonstruktion inte kan inneh\u00e5lla sin prestation. Efter att en m\u00e5nad f\u00f6rflutit fr\u00e5n den kritiska tidpunkten \u00e4r arbetstagaren inte skyldig att prestera enligt avtalet annat \u00e4n mot fullt vederlag. Om arbetsgivaren d\u00e5 tillgodogjort sig arbetstagarens prestation, omfattas l\u00f6nefordran inte av ackordet.<\/p>\n<p>Arbetsdomstolen konstaterade att arbetsgivaren och f\u00f6rbundet hade f\u00f6rhandlat arbetstagarens arbetsbristupps\u00e4gning efter den kritiska tidpunkten. Arbetstagaren kom att arbeta i tiden efter det att en m\u00e5nad f\u00f6rflutit fr\u00e5n ans\u00f6kan om f\u00f6retagsrekonstruktion. Hans l\u00f6neanspr\u00e5k f\u00f6r den tiden skulle inte ha omfattats av f\u00f6rm\u00e5nsr\u00e4tt, om bolaget i st\u00e4llet hade f\u00f6rsatts i konkurs, och han hade d\u00e4rf\u00f6r f\u00f6r denna tid inte haft r\u00e4tt till l\u00f6negaranti. Arbetstagaren var d\u00e4rf\u00f6r i tiden efter den 24 februari 2020 inte skyldig att forts\u00e4tta att prestera enligt avtalet utan att f\u00e5 fullt betalt av arbetsgivaren. Enligt Arbetsdomstolen fick s\u00e5ledes arbetstagaren anspr\u00e5k p\u00e5 l\u00f6n och semesterers\u00e4ttning f\u00f6r tiden efter den 24 februari 2020 bed\u00f6mas p\u00e5 samma s\u00e4tt som om ett nytt avtal hade tr\u00e4ffats efter den kritiska tidpunkten. F\u00f6rbundets talan i den delen bif\u00f6lls s\u00e5ledes.<\/p>\n<p>F\u00f6rbundets talan avseende intj\u00e4nad kompensationstid och fem sparade semesterdagar avslogs emellertid d\u00e5 fordringarna ans\u00e5gs uppkomna f\u00f6re den kritiska tidpunkten. F\u00f6rbundet hade inte styrkt att rekonstrukt\u00f6ren eller bolagets agerande efter den kritiska tidpunkten innebar att avtal tr\u00e4ffats om att arbetstagaren skulle f\u00e5 n\u00e4mnda ers\u00e4ttning.<\/p>\n<p>Arbetsgivarparterna hade vid en eventuell bed\u00f6mning till arbetstagarsidans f\u00f6rdel vitsordat kollektivavtalsbrott. Det gjordes dock g\u00e4llande att ett skadest\u00e5nd i f\u00f6rsta hand skulle j\u00e4mkas till noll mot bakgrund av att bolaget hade agerat i enlighet med instruktioner fr\u00e5n den av tingsr\u00e4tten utsedde rekonstrukt\u00f6ren. Arbetsdomstolen satte ned och best\u00e4mde skadest\u00e5nden till 20\u00a0000 kr till arbetstagaren och 50\u00a0000 kr till f\u00f6rbundet.
