Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2022 nr 23<\/strong><\/h3>\n<p>Fr\u00e5ga i m\u00e5let var om ett kollektivavtal som ett hemlarmbolag tecknat med Svenska Elektrikerf\u00f6rbundet (f\u00f6rbundet) var till\u00e4mpligt p\u00e5 en grupp arbetstagare som vid kundbes\u00f6k installerade och s\u00e5lde larm. Bolaget var \u00e4ven bundet av ett kollektivavtal f\u00f6r tj\u00e4nstem\u00e4n med Unionen (tj\u00e4nstemannaavtalet). Arbetsgivarsidan gjorde g\u00e4llande att de aktuella arbetstagarna hade tj\u00e4nstemannayrken, medan f\u00f6rbundet \u00e5 sin sida gjorde g\u00e4llande att arbetet omfattades av larm- och s\u00e4kerhetsteknikavtalet. Redan vid avtalets tecknande hade parterna olika uppfattning i fr\u00e5gan om avtalet var till\u00e4mpligt p\u00e5 de aktuella arbetstagarna.<\/p>\n<p>Enligt Arbetsdomstolens praxis finns vissa allm\u00e4nna riktlinjer f\u00f6r hur gr\u00e4nsen mellan arbetar- respektive tj\u00e4nstemannaavtal ska dras. Parterna i arbetar- respektive tj\u00e4nstemannaavtal anses som utg\u00e5ngspunkt vara ense om att det inte finns n\u00e5gon \u00f6verlappning mellan avtalen, dvs det presumeras att avtalen inte \u00e4r konkurrerande. Avg\u00f6rande f\u00f6r bed\u00f6mningen \u00e4r arbetstagarnas arbetsuppgifter. Arbetstagarens fackliga tillh\u00f6righet \u00e4r inte direkt avg\u00f6rande, men om en viss grupp arbetstagare traditionellt tillh\u00f6rt en viss arbetstagarorganisation kan det belysa vilka syns\u00e4tt som traditionellt g\u00e4llt i branschen eller p\u00e5 arbetsplatsen. Om det omtvistade arbetet har utvecklats eller h\u00e4mtats fr\u00e5n arbete som h\u00f6r under det ena avtalet, exempelvis ett arbetaravtal, f\u00f6r\u00e4ndras inte avtalstillh\u00f6righeten \u00e4ven om tj\u00e4nstemannabetonade arbetsuppgifter tillf\u00f6rs, s\u00e5vida inte de nytillkomna arbetsuppgifterna \u00e4r helt dominerande. Om arbetsuppgifterna inte kan s\u00e4gas ha utvecklats eller h\u00e4mtats fr\u00e5n en befattning under det ena avtalet st\u00e4lls fr\u00e5gan om arbetsuppgifterna huvudsakligen \u00e4r arbetar- eller tj\u00e4nstemannabetonade.<\/p>\n<p>Parterna i m\u00e5let var \u00f6verens om att det inte fanns n\u00e5gon \u00f6verlappning mellan de b\u00e5da kollektivavtalen. Arbetsdomstolen konstaterade att arbetstagarnas arbetsuppgifterna inte hade utvecklats eller h\u00e4mtats fr\u00e5n en befattning som h\u00f6rde under det ena avtalet. Fr\u00e5ga blev s\u00e5ledes om arbetsuppgifterna huvudsakligen var arbetar- eller tj\u00e4nstemannabetonade.<\/p>\n<p>I m\u00e5let var ostridigt att det inom branschen fanns arbetstagare som installerade larm vars arbetsuppgifter omfattades av f\u00f6rbundets kollektivavtal. Parterna var vidare \u00f6verens om att sj\u00e4lva monteringen av larm var en arbetsuppgift som f\u00f6ll under det avtalet. Bed\u00f6mningen av \u00f6vriga arbetsuppgifter var parterna dock oense om.<\/p>\n<p>Av utredningen framgick att parterna hade i allt v\u00e4sentligt en samst\u00e4mmig bild g\u00e4llande vilka arbetsuppgifter arbetstagarna hade, hur de utf\u00f6rdes och hur l\u00e5ng tid de olika momenten tog. Deras uppfattningar om vilka arbetsuppgifter som skulle h\u00e4nf\u00f6ras till det ena eller andra avtalet och vad som kunde s\u00e4gas vara det centrala inneh\u00e5llet i arbetet skilde sig dock \u00e5t.<\/p>\n<p>G\u00e4llande s\u00e4kerhetskonsultation som var ett av arbetstagarnas arbetsuppgifter, fann Arbetsdomstolen att den del som handlade om planering, exempelvis placering av best\u00e4llda larmkomponenter, utgjorde typiska arbetaruppgifter. F\u00f6rs\u00e4ljningsmomentet i s\u00e4kerhetskonsultationen befanns dock ta st\u00f6rst tid i anspr\u00e5k. Arbetsdomstolen uttalade att f\u00f6rs\u00e4ljning brukar traditionellt betraktas som tj\u00e4nstemannaarbete, varf\u00f6r s\u00e4kerhetskonsultation som arbetsmoment fick betraktas som en tj\u00e4nstemannauppgift. Arbetstagarna uppr\u00e4ttade \u00e4ven offerter, skrev avtal och utbildade kunderna i anv\u00e4ndning av bl a en app. Dessa arbetsuppgifter fick enligt Arbetsdomstolen huvudsakligen anses vara tj\u00e4nstemannabetonade.<\/p>\n<p>Arbetsdomstolen fann att den samlade utredningen pekade p\u00e5 att en st\u00f6rre andel av arbetstiden \u00e4gnades \u00e5t tj\u00e4nstemannabetonade arbetsuppgifter s\u00e5som s\u00e4kerhetskonsultation, avtalsskrivande och utbildning snarare \u00e4n arbetarbetonade arbetsuppgifter som montering och installation. Av betydelse f\u00f6r bed\u00f6mningen var \u00e4ven vad som kunde s\u00e4gas vara det huvudsakliga syftet med kundbes\u00f6ken. \u00a0Av utredningen framgick att larmprodukterna likv\u00e4l kunde installeras av kunden sj\u00e4lv, men att bolaget valt den aff\u00e4rsmodellen att arbetstagarna installerade larmen f\u00f6r att f\u00e5 en direktkontakt med kunderna och d\u00e4rigenom \u00f6ka m\u00f6jligheten till f\u00f6rs\u00e4ljning. Det huvudsakliga syftet med kundbes\u00f6ken befanns vara f\u00f6rs\u00e4ljning. Arbetsdomstolens slutsats blev s\u00e5ledes att arbetstagarnas arbetsuppgifter huvudsakligen var tj\u00e4nstemannabetonade och att arbetet s\u00e5ledes inte omfattades av f\u00f6rbundets avtal.<\/p>\n<p><strong>AD 2022 24<\/strong><\/p>\n<p>Fr\u00e5ga i m\u00e5let var om en poliskommissarie hade haft en otill\u00e5ten f\u00f6rtroendeskadlig bisyssla sedan han haft uppdrag som ledamot av fullm\u00e4ktige i ett \u00f6msesidigt f\u00f6rs\u00e4kringsbolag.<\/p>\n<p>Arbetsdomstolen redogjorde f\u00f6r sin praxis av vilken framg\u00e5r att det avg\u00f6rande f\u00f6r fr\u00e5gan om en bisyssla \u00e4r f\u00f6rtroendeskadlig \u00e4r om allm\u00e4nhetens f\u00f6rtroende f\u00f6r att opartiskhet iakttas i myndighetens verksamhet riskerar att rubbas.<\/p>\n<p>Poliskommissariens huvuduppdrag var bl a att ut\u00f6va operativ ledning och styrning av den yttre verksamheten Han f\u00f6rdelade arbetsuppgifter, styrde personella resurser och tog \u00f6ver handl\u00e4ggning av enskilda \u00e4renden vid behov. Han medverkade inte i brottsutredningar i praktiken.<\/p>\n<p>Poliskommissarien var utsedd till fullm\u00e4ktige och hade en r\u00f6st i beslut r\u00f6rande fr\u00e5gor om att utse styrelse, ansvarsfrihet f\u00f6r styrelseledam\u00f6terna och verkst\u00e4llande direkt\u00f6r, om \u00e5rsredovisning m.m.<\/p>\n<p>Den fr\u00e4msta ber\u00f6ringspunkt mellan verksamheterna som Polismyndigheten pekade p\u00e5 var att f\u00f6rs\u00e4kringsbolaget regelbundet gjorde polisanm\u00e4lningar om misst\u00e4nka brott mot bolaget, fr\u00e4mst f\u00f6rs\u00e4kringsbedr\u00e4gerier. \u00c4ven brott som f\u00f6rs\u00e4kringstagare hos bolaget drabbats av utreds av Polismyndigheten. Arbetsdomstolen fann att brottsutredningar i regel inte har betydelse f\u00f6r r\u00e4tten till f\u00f6rs\u00e4kringsers\u00e4ttning, eftersom ers\u00e4ttning kan beviljas \u00e4ven om det inte \u00e4r utrett vem som gjort sig skyldig till brottet. F\u00f6rs\u00e4kringbolaget kunde enligt Arbetsdomstolen anses ha ett intresse av att g\u00e4rningsmannen identifieras s\u00e5 att bolaget kunde rikta regresskrav mot denne. F\u00f6rs\u00e4kringsbolaget och f\u00f6rs\u00e4kringstagarna kunde dock inte mer allm\u00e4nt anses ha motst\u00e5ende intressen i polisens utredning av brott mot f\u00f6rs\u00e4kringstagare. Det kunde dock inte uteslutas att s\u00e5dana situationer kunde f\u00f6rekomma.<\/p>\n<p>Av utredningen framgick att f\u00f6rs\u00e4kringsbolaget var skyldigt att arbeta aktivt mot exempelvis penningtv\u00e4tt och f\u00f6rs\u00e4kringsbedr\u00e4gerier, vilket f\u00f6rutsatte kontakter med Polismyndigheten. \u00c4ven om bolaget och den f\u00f6rs\u00e4kringstagare som utreds f\u00f6r brott i dessa situationer har motst\u00e5ende intressen i fr\u00e5ga om brottsutredningen, fann Arbetsdomstolen inte annat utrett \u00e4n att antalet brottsutredningar d\u00e4r bolaget hade ett s\u00e5dant s\u00e4rskilt intresse av utg\u00e5ngen var helt marginellt i f\u00f6rh\u00e5llande till det totala antal brottsutredningar som den aktuella polisregionen hanterade.<\/p>\n<p>I sitt uppdrag som fullm\u00e4ktige hade inte poliskommissarien n\u00e5gon inflytande \u00f6ver enskilda skade\u00e4renden. Han fick ett arvode per m\u00f6te men hade i \u00f6vrigt inget ekonomiskt intresse av bolagets resultat \u00e4n det som alla f\u00f6rs\u00e4kringstagare hade. P\u00e5 bolagets hemsida framgick att han var fullm\u00e4ktige och polis. Enligt Arbetsdomstolen kunde detta dock inte anses ge uttryck f\u00f6r att myndigheten gick i god f\u00f6r verksamheten. Sammantaget fann Arbetsdomstolen att de risker f\u00f6r f\u00f6rtroendeskada som bisysslan skulle kunnat inneb\u00e4ra framstod som s\u00e5 ringa att de var f\u00f6rsvarliga.
