Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2022 nr 20<\/strong><\/h3>\n<p>Arbetsgivaren i m\u00e5let hade f\u00f6rlagt tre arbetstagares arbetstid p\u00e5 s\u00e5 s\u00e4tt att de under tv\u00e5veckorsperioder arbetat ena veckan 45 timmar per helgfri vecka och andra veckan 35 timmar per helgfri vecka. Fr\u00e5ga i m\u00e5let var om arbetsgivaren d\u00e4rigenom brutit mot kollektivavtalet som angav att den ordinarie arbetstiden skulle utg\u00f6ra i genomsnitt 40 timmar per helgfri vecka. Vidare om arbetstagarna hade r\u00e4tt till \u00f6vertidsers\u00e4ttning de veckor de arbetat mer \u00e4n 40 timmar.<\/p>\n<p>Av kollektivavtalet framgick inom vilka klockslag ordinarie arbetstid fick f\u00f6rl\u00e4ggas under olika dagar, det sk \u201df\u00f6nstret\u201d. N\u00e5gon avtalad ber\u00e4kningsperiod framgick dock inte. Arbetstagarsidan gjorde g\u00e4llande att detta innebar att n\u00e5gon genomsnittsber\u00e4kning d\u00e4rmed inte var till\u00e5ten, medan arbetsgivarparterna var av meningen att arbetsgivaren med st\u00f6d av arbetsledningsr\u00e4tten kunde best\u00e4mma arbetstidsf\u00f6rl\u00e4ggningen inom de tidsramar som angavs i \u201df\u00f6nstret\u201d.<\/p>\n<p>Enligt Arbetsdomstolen gav inte utredningen st\u00f6d f\u00f6r n\u00e5gon slutsats i fr\u00e5ga om en gemensam partsavsikt. Inte heller avtalshistoriken l\u00e4mnade svar p\u00e5 tolkningen av best\u00e4mmelsen. F\u00f6rbundet \u00e5beropade till st\u00f6d f\u00f6r sin talan tv\u00e5 andra kollektivavtal tr\u00e4ffade med samma arbetsgivarorganisation. Enligt Arbetsdomstolen gick det inte av dessa avtalsregleringar dra slutsatsen att parterna till det i m\u00e5let aktuella kollektivavtalet var \u00f6verens om att en r\u00e4tt till utj\u00e4mning av den ordinarie arbetstiden mellan veckor f\u00f6rutsatte s\u00e4rskilda best\u00e4mmelser d\u00e4rom. Avtalstexten gav enligt Arbetsdomstolen st\u00f6d f\u00f6r b\u00e5da parters st\u00e5ndpunkt. Vid senare tids avtalsf\u00f6rhandlingar var det klarlagt att arbetsgivarsidan framst\u00e4llt krav p\u00e5 ut\u00f6kad flexibilitet, bland annat en uttrycklig skrivning om att genomsnittsber\u00e4kningen skulle kunna g\u00f6ras under ett \u00e5r. Enligt Arbetsdomstolen gav det visst st\u00f6d f\u00f6r att arbetsgivarorganisationen uppfattat att best\u00e4mmelsen inte medgav n\u00e5gon utj\u00e4mning av arbetstiden mellan veckor, men att det inte heller var orimligt att kravet i avtalsf\u00f6rhandlingarna endast handlat om att skapa tydlighet i vad som g\u00e4llde.<\/p>\n<p>Sammantaget fann Arbetsdomstolen att varken partsavsikten, avtalshistoriken, senare avtalsf\u00f6rhandlingar, andra avtalsomr\u00e5den, avtalstexten eller den faktiska till\u00e4mpningen gav n\u00e5got klart st\u00f6d f\u00f6r n\u00e5gon sidas st\u00e5ndpunkt. Enligt Arbetsdomstolen fick dock orden \u201di genomsnitt\u201d anses ha en inneb\u00f6rd och att ordalydelsen d\u00e4rmed fick f\u00f6rst\u00e5s som s\u00e5 att arbetstiden fick genomsnittsber\u00e4knas av arbetsgivaren. I avsaknad av reglering om ber\u00e4kningsperioden i kollektivavtalet tog Arbetsdomstolen ledning av arbetstidslagen. Enligt lagen f\u00e5r arbetstiden, om det beh\u00f6vs med h\u00e4nsyn till arbetets natur eller arbetsf\u00f6rh\u00e5llandena i \u00f6vrigt, uppg\u00e5 till h\u00f6st 40 timmar i veckan i genomsnitt under en fyraveckorsperiod. Den kortast m\u00f6jliga ber\u00e4kningsperioden vid veckoarbetstid konstaterades vara tv\u00e5 veckor. Bolaget hade till\u00e4mpat en ber\u00e4kningsperiod om tv\u00e5 veckor. Arbetsdomstolen gjorde bed\u00f6mningen att avtalet fick tolkas som s\u00e5 att i vart fall en ber\u00e4kningsperiod om tv\u00e5 veckor var till\u00e5ten, \u00e5tminstone om arbetstiden uppgick till 40 timmar i genomsnitt under den period som den i kollektivavtalet f\u00f6reskrivna tj\u00e4nstg\u00f6ringslistan omfattade. F\u00f6rl\u00e4ggningen av arbetstiden hade s\u00e5ledes inte skett i strid med kollektivavtalet och arbetstagaren hade d\u00e4rmed inte heller arbetat \u00f6vertid.
