Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2022 nr 15<\/strong><\/h3>\n<p>Samhall avskedade en anst\u00e4lld som p\u00e5 grund av sin funktionsneds\u00e4ttning blivit anvisad arbete hos dem. Sk\u00e4let till avskedet var att arbetstagaren agerat ol\u00e4mpligt mot kvinnliga kollegor. Lagen om anst\u00e4llningsskydd, LAS var inte till\u00e4mplig p\u00e5 anvisade inom Samhall. I kollektivavtalet fanns regler som p\u00e5minde om reglerna i LAS bl a ang\u00e5ende m\u00f6jligheten att f\u00f6ra ogiltighetstalan.<\/p>\n<p>Industrifacket Metall gjorde g\u00e4llande att avskedandet inte ens r\u00e4ckte till en giltig upps\u00e4gning och att allm\u00e4nt skadest\u00e5nd skulle utg\u00e5 till den enskilde med st\u00f6d av kollektivavtalet. Samhall bestred yrkandena och framf\u00f6rde att de har nolltolerans n\u00e4r det g\u00e4ller hot och v\u00e5ld p\u00e5 arbetsplatsen. Det m\u00e5ste varit uppenbart f\u00f6r arbetstagaren att hans n\u00e4rmanden var ov\u00e4lkomna och att det hot han riktade mot en av arbetstagarna v\u00e4ckte allvarlig fruktan f\u00f6r egen och annans s\u00e4kerhet. Samhall bestred att kollektivavtalet gav enskild r\u00e4tt till allm\u00e4nt skadest\u00e5nd. R\u00e4tten i kollektivavtalet medf\u00f6rde endast en r\u00e4tt att st\u00e5 kvar i anst\u00e4llningen under tvistetiden \u00a0i likhet med reglerna i LAS om ogiltighetsf\u00f6rklaring.<\/p>\n<p>Arbetsdomstolen kom fram till att arbetstagarens agerandet inte varit acceptabelt och inte ska beh\u00f6va t\u00e5las i ett anst\u00e4llningsf\u00f6rh\u00e5llande. Mot bakgrund av Samhalls uppdrag ans\u00e5g Arbetsdomstolen att det kan st\u00e4llas st\u00f6rre krav p\u00e5 bolaget \u00e4n p\u00e5 andra arbetsgivare n\u00e4r det g\u00e4ller att vidta \u00e5tg\u00e4rder f\u00f6r att komma till r\u00e4tta med brister i anvisade arbetstagares ageranden som har samband med deras funktionsneds\u00e4ttning. I detta fall var arbetstagaren bl a d\u00f6v och hade teckenspr\u00e5k som f\u00f6rsta spr\u00e5k. Han hade stora sv\u00e5righeter att f\u00f6rst\u00e5 och uttrycka sig samt f\u00f6rst\u00e5 inneb\u00f6rden av och val\u00f6ren hos ord. Domstolen fann vidare att den avskedade arbetstagarens agerande haft s\u00e5dant samband med hans funktionshinder att Samhall borde ha f\u00f6rs\u00f6kt komma till r\u00e4tta med problemet genom tillr\u00e4ttavisningar eller andra \u00e5tg\u00e4rder, i st\u00e4llet f\u00f6r att direkt skilja honom fr\u00e5n anst\u00e4llningen. Enligt Arbetsdomstolens mening har det allts\u00e5 inte funnits sk\u00e4l f\u00f6r upps\u00e4gning. Avskedandet av arbetstagaren ska d\u00e4rmed f\u00f6rklaras ogiltigt och Samhall ska f\u00f6rpliktas betala l\u00f6n fr\u00e5n den 9 juni 2021 till och med dagen f\u00f6r huvudf\u00f6rhandling. Ordf\u00f6rande och en ledamot till i domstolen var skiljaktiga och ans\u00e5g att laga sk\u00e4l f\u00f6r avsked f\u00f6rel\u00e5g.\u00a0 Arbetstagaren hade inte r\u00e4tt till allm\u00e4nt skadest\u00e5nd f\u00f6r felaktigt skiljande. Det var enligt domstolen tydligt att kollektivavtalet inte gav en s\u00e5dan f\u00f6rpliktelse.<\/p>\n<p><strong>AD 2022 16<\/strong><\/p>\n<p>Ett hamnbolag hade schemalagt vissa arbetstagare enligt ett schema om fyra veckor, varvid de i vecka 1 arbetat m\u00e5ndag \u2013 s\u00f6ndag i 72 timmar, varit lediga vecka 2 och sedan arbetat dagtid m\u00e5ndag \u2013 fredag i 40 timmar \u00f6vriga tv\u00e5 veckor. Hamnarbetarf\u00f6rbundet gjorde g\u00e4llande att det kr\u00e4vdes ett lokalt kollektivavtal f\u00f6r att uppr\u00e4tta s\u00e5dant arbetstidsschema och att arbetstagarna hade arbetat \u00f6vertid och d\u00e4rmed hade r\u00e4tt till \u00f6vertidsers\u00e4ttning. Det till\u00e4mpliga kollektivavtalet var tecknat mellan arbetsgivarsidan och ett annat fackf\u00f6rbund, Transportarbetaref\u00f6rbundet (Transport). Arbetsgivarsidan gjorde i f\u00f6rsta hand g\u00e4llande att kollektivavtalet endast f\u00f6reskrev att \u00f6verl\u00e4ggning med Transport skulle f\u00f6reg\u00e5 f\u00f6rl\u00e4ggning av arbetstiden p\u00e5 det s\u00e4tt som skett. I andra hand menade arbetsgivarsidan att det kr\u00e4vdes en \u00f6verenskommelse, men att det inte kr\u00e4vdes en \u00f6verenskommelse i kollektivavtalsform.<\/p>\n<p>Transport hade yttrat sig om dess uppfattning om tolkningen av kollektivavtalet och anf\u00f6rt att arbetstidsf\u00f6rl\u00e4ggning p\u00e5 det s\u00e4tt arbetsgivaren beslutat om f\u00f6rutsatte en lokal \u00f6verenskommelse, men att det inte beh\u00f6vde ha kollektivavtalsform. Arbetsdomstolen fann av den anledningen att kollektivavtalet inte kunde anses ha den inneb\u00f6rd som Hamnarbetarf\u00f6rbundet gjort g\u00e4llande. Arbetsdomstolen konstaterade att kollektivavtalsparterna visserligen var oense i fr\u00e5gan om det r\u00e4ckte med \u00f6verl\u00e4ggning eller om det kr\u00e4vdes en lokal \u00f6verenskommelse som inte var ett kollektivavtal. Sedan arbetsgivaren och Transport lokalt var \u00f6verens om det aktuella arbetstidsschemat fann Arbetsdomstolen att den inte beh\u00f6vde ta st\u00e4llning till den fr\u00e5gan inom ramen f\u00f6r den aktuella tvisten. Att arbetsgivaren eventuellt kan ha brutit mot kollektivavtalets veckoviloregel saknade enligt Arbetsdomstolen betydelse f\u00f6r f\u00f6rbundets talan om \u00f6vertidsers\u00e4ttning och ers\u00e4ttning f\u00f6r uteblivna raster. Arbetstagarna hade s\u00e5ledes inte arbetat \u00f6vertid och n\u00e5gon skyldighet att betala \u00f6vertidsers\u00e4ttning f\u00f6rel\u00e5g d\u00e4rf\u00f6r inte.<\/p>\n<p><strong>AD 2022 17<\/strong><\/p>\n<p>En arbetstagare hade genom en lagakraftvunnen dom vunnit bifall i sitt yrkande om ogiltigf\u00f6rklaring av en upps\u00e4gning. Arbetsgivaren hade f\u00f6rklarat att bolaget inte hade f\u00f6r avsikt att r\u00e4tta sig efter domen. Parterna var s\u00e5ledes \u00f6verens om att anst\u00e4llningsf\u00f6rh\u00e5llandet var uppl\u00f6st och att arbetstagaren hade r\u00e4tt till ett skadest\u00e5nd motsvarande 16 m\u00e5nadsl\u00f6ner enligt 39 \u00a7 LAS. Fr\u00e5ga i m\u00e5let var om den m\u00e5natliga skifters\u00e4ttning som arbetstagaren hade haft r\u00e4tt till enligt anst\u00e4llningsavtalet skulle ing\u00e5 vid ber\u00e4kningen av m\u00e5nadsl\u00f6nen.<\/p>\n<p>Arbetsdomstolen redogjorde f\u00f6r bl a sin egen praxis av vilken framg\u00e5r att uttrycket m\u00e5nadsl\u00f6n syftar p\u00e5 den direkta kontanters\u00e4ttningen och innefattar inte andra anst\u00e4llningsf\u00f6rm\u00e5ner. Det \u00e4r den avtalade normala l\u00f6nen vid tidpunkten f\u00f6r anst\u00e4llningens upph\u00f6rande som avses, till skillnad fr\u00e5n den faktiskt betalade l\u00f6nen. V\u00e4rdet av en tj\u00e4nstebilsf\u00f6rm\u00e5n och semesterers\u00e4ttning ska enligt praxis inte r\u00e4knas med i m\u00e5nadsl\u00f6nen.<\/p>\n<p>I nu aktuellt m\u00e5l var parterna \u00f6verens om att arbetstagaren, n\u00e4r anst\u00e4llningen upph\u00f6rde, arbetade skift och fick skifters\u00e4ttning med samma belopp varje m\u00e5nad ut\u00f6ver grundl\u00f6nen. Att l\u00f6nen var uppdelad i tv\u00e5 framgick av anst\u00e4llningsavtalet och l\u00f6nespecifikationerna. Enligt avtalet var skifters\u00e4ttningen villkorad av att arbetstagaren arbetade enligt ett skiftschema. Det angavs uttryckligen att n\u00e5gon r\u00e4tt till s\u00e5dan ers\u00e4ttning inte f\u00f6rel\u00e5g om han skulle f\u00f6rflyttas till arbete som inte utf\u00f6rdes i skift. Vidare framgick av avtalet att ytterligare ers\u00e4ttning f\u00f6r bl a \u00f6vertid inte utgick utan hade beaktats vid best\u00e4mmandet av l\u00f6neniv\u00e5n.<\/p>\n<p>Arbetsdomstolen gjorde bed\u00f6mningen att skifters\u00e4ttningen utgjorde ett till\u00e4gg till grundl\u00f6nen och inte ett ytterligare m\u00e5nadsl\u00f6nebelopp. Sk\u00e4len var framf\u00f6rallt att arbetsgivaren hade valt att schablonisera skifters\u00e4ttningen genom att best\u00e4mma den till ett fast m\u00e5nadsbelopp. Arbetsdomstolen delade s\u00e5ledes inte tingsr\u00e4ttens bed\u00f6mning att det var sv\u00e5rt att s\u00e4rskilja skiftkomponenten fr\u00e5n anst\u00e4llningen och l\u00f6nen i \u00f6vrigt. Den sammanfattande bed\u00f6mningen var s\u00e5ledes att med m\u00e5nadsl\u00f6n avses den vid tidpunkten f\u00f6r anst\u00e4llningens upph\u00f6rande avtalade \u00e5rsl\u00f6nen, som utbetalats m\u00e5natligen, utan n\u00e5got p\u00e5slag f\u00f6r andra l\u00f6nedelar.
