Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2022 nr 12<\/strong><\/h3>\n<p>Arbetsgivaren i m\u00e5let, Sveriges Hamnar, var bundet av tv\u00e5 konkurrerande kollektivavtal. Fr\u00e5ga var om bolaget var skadest\u00e5ndsskyldigt gentemot Svenska Hamnarbetarf\u00f6rbundet som ing\u00e5tt det senare tecknade kollektivavtalet, d\u00e5 bolaget inte hade f\u00f6ljt en avtalsbest\u00e4mmelse som var likalydande i de b\u00e5da kollektivavtalen.<\/p>\n<p>Den aktuella kollektivavtalsbest\u00e4mmelsen angav att arbetstagarna skulle p\u00e5 f\u00f6rhand informeras om l\u00e4ngden och f\u00f6rl\u00e4ggningen av raster s\u00e5 noga som omst\u00e4ndigheterna medgav. I m\u00e5let var ostridigt att bolaget inte hade informerat arbetstagarna, d\u00e4ribland f\u00f6rbundets medlemmar, om f\u00f6rl\u00e4ggningen av raster i enlighet med best\u00e4mmelsen.<\/p>\n<p>Arbetsdomstolen redogjorde f\u00f6r sin praxis av vilken bl a framg\u00e5r att det i valet mellan tv\u00e5 konkurrerande avtal som huvudregel \u00e4r det f\u00f6rst tecknade kollektivavtalet som har f\u00f6retr\u00e4de. Det f\u00f6ljer vidare av r\u00e4ttspraxis att ett kollektivavtal normalt inneb\u00e4r att en arbetsgivare gentemot kollektivavtalsmotparten \u00e4r skyldig att till\u00e4mpa avtalet \u00e4ven p\u00e5 utanf\u00f6rst\u00e5ende arbetstagare. En arbetsgivare kan s\u00e5ledes normalt inte till\u00e4mpa andra villkor \u00e4n de som finns i det f\u00f6rst tr\u00e4ffade kollektivavtalet p\u00e5 medlemmar i den andra arbetstagarorganisationen, utan att bryta mot det f\u00f6rst tr\u00e4ffade kollektivavtalet. Ett delvis annat syns\u00e4tt g\u00e4ller andra best\u00e4mmelser i ett kollektivavtal \u00e4n s\u00e5dana som g\u00e4ller anst\u00e4llningsvillkor, dvs s\u00e5dana som inte direkt ang\u00e5r f\u00f6rh\u00e5llandet mellan arbetsgivare och arbetstagare eller best\u00e4mmelser som g\u00e4ller endast mellan avtalsparterna. F\u00f6r s\u00e5dana villkor har domstolen uttalat att arbetsgivaren inte beh\u00f6ver till\u00e4mpa det andra avtalet om arbetsgivaren inte kan g\u00f6ra det utan att bryta mot det f\u00f6rsta avtalet. F\u00f6r att en arbetsgivare ska vara skyldig att till\u00e4mpa villkoren i det sist tr\u00e4ffade kollektivavtalet kr\u00e4vs att kollektivavtalen kan till\u00e4mpas samtidigt. Det kan n\u00e4mligen t\u00e4nkas situationer d\u00e4r en till\u00e4mpning av b\u00e5da avtalen, utan att vara direkt of\u00f6renliga, likv\u00e4l medf\u00f6r s\u00e5 betydande ol\u00e4genheter av fr\u00e4mst praktisk natur att det inte kan kr\u00e4vas att de ska till\u00e4mpas parallellt. Om den arbetstagarorganisation som tr\u00e4ffat det senare kollektivavtalet k\u00e4nde till det tidigare tr\u00e4ffade kollektivavtalet, kan den organisationen inte f\u00e5 allm\u00e4nt skadest\u00e5nd f\u00f6r att arbetsgivaren i enlighet med de principer som redogjorts f\u00f6r inte till\u00e4mpat det senare kollektivavtalet. Om tv\u00e5 avtal har samma inneh\u00e5ll eller annars \u00e4r p\u00e5 f\u00f6rhand omsorgsfullt samordnade till varandra, f\u00f6religger inte n\u00e5got fall av konkurrerande kollektivavtal<\/p>\n<p>F\u00f6r att uppfylla den skyldighet som f\u00f6ljde av den i m\u00e5let aktuella kollektivavtalsbest\u00e4mmelsen, var arbetsgivaren inte beroende av arbetstagarna eller arbetstagarorganisationen. Det fick enligt Arbetsdomstolen antas att bolaget skulle bryta mot det f\u00f6rst tecknade kollektivavtalet om det inte informerade arbetstagare som var medlemmar i Hamnarbetarf\u00f6rbundet, som tecknat det senast tr\u00e4ffade kollektivavtalet. De tv\u00e5 kollektivavtalen var enligt Arbetsdomstolen samordnade p\u00e5 det s\u00e4ttet att avtalet med Hamnarbetarf\u00f6rbundet inte innebar n\u00e5gon skyldighet f\u00f6r bolaget att agera p\u00e5 n\u00e5got annat s\u00e4tt \u00e4n vad bolaget var skyldigt att g\u00f6ra enligt det f\u00f6rst tecknade kollektivavtalet. Avtalen fick i denna del s\u00e4gas vara samordnade och inte konkurrerande. Ett s\u00e5dant skadest\u00e5ndsansvar i f\u00f6rh\u00e5llande till ber\u00f6rda medlemmar i b\u00e5da organisationerna kunde inte, enligt Arbetsdomstolen, anses v\u00e4sentligen f\u00f6rsv\u00e5ra f\u00f6r arbetsgivaren p\u00e5 n\u00e5got s\u00e4tt. Arbetsgivarsidan inv\u00e4nde att best\u00e4mmelserna inte var likalydande d\u00e5 det ena avtalet till\u00e4t avvikelser genom lokala \u00f6verenskommelser. D\u00e5 en eventuell m\u00f6jlighet att tr\u00e4ffa lokala \u00f6verenskommelser inte ans\u00e5gs inverka p\u00e5 skyldigheten att informera arbetstagarna om f\u00f6rl\u00e4ggningen av raster, och d\u00e5 n\u00e5gon lokal \u00f6verenskommelse inte heller fanns, saknade arbetsgivarsidans inv\u00e4ndning betydelse f\u00f6r pr\u00f6vningen av m\u00e5let.
