Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2022 nr 09<\/strong><\/h3>\n<p>M\u00e5let g\u00e4llde tolkning av ett kollektivavtal f\u00f6r distribution av direktreklam. Enligt kollektivavtalet framgick att g\u00e4ngse l\u00f6n f\u00f6r behovsanst\u00e4lld personal var prestationsl\u00f6n baserad p\u00e5 de timl\u00f6ner som g\u00e4llde f\u00f6r tillsvidareanst\u00e4lld distribut\u00f6r. I en anm\u00e4rkning till kollektivavtalet, i m\u00e5let ben\u00e4mnd garantil\u00f6neregeln, framgick f\u00f6ljande. \u201dBlir utfallet av prestationsl\u00f6nen l\u00e4gre \u00e4n timl\u00f6nen f\u00f6r en normalprestation ska l\u00f6n motsvarande timl\u00f6n utg\u00e5. Vid oenighet avseende tids\u00e5tg\u00e5ngen ska gemensam tidm\u00e4tning ske\u201d.<\/p>\n<p>I m\u00e5let var parterna oeniga om vad en normalprestation enligt anm\u00e4rkningen avs\u00e5g och om tids\u00e5tg\u00e5ngen f\u00f6r transport mellan distribut\u00f6rens bostad\/utl\u00e4mningsst\u00e4llet och utdelningsdistriktet utgjorde ett s\u00e5dant arbetsmoment som tidm\u00e4tning enligt anm\u00e4rkningen skulle omfatta.<\/p>\n<p>G\u00e4llande fr\u00e5gan om vad en normalprestation enligt kollektivavtalet avs\u00e5g, gjorde arbetstagarsidan g\u00e4llande att det avs\u00e5g den tid som gick \u00e5t f\u00f6r den enskilde distribut\u00f6ren att utf\u00f6ra distributionsarbetets samtliga arbetsmoment i ett normalt arbetstempo. Arbetsgivarparterna menade att ber\u00e4kningen skulle ske utifr\u00e5n tids\u00e5tg\u00e5ngen f\u00f6r en normalpresterande arbetstagare.<\/p>\n<p>Arbetsdomstolen fann att utredningen inte visade p\u00e5 att det funnits n\u00e5gon gemensam partsavsikt p\u00e5 s\u00e4tt som f\u00f6rbundet gjort g\u00e4llande. Kollektivavtalets ordalydelse och struktur gav inte heller ledning f\u00f6r hur begreppet normalprestation skulle tolkas. Att f\u00f6rbundet klargjort sin uppfattning genom en annons i lokalpressen och arbetsgivarpartens eventuella underl\u00e5tenhet att anm\u00e4rka mot informationen saknade betydelse f\u00f6r tolkningsfr\u00e5gan.<\/p>\n<p>Prestationsl\u00f6nesystemet innebar att f\u00f6rtj\u00e4nsten per tidsenhet med prestationsl\u00f6n blev h\u00f6gre, ju snabbare arbetstagaren utf\u00f6rde arbetet. Arbetsdomstolen konstaterade att om det med normalprestation skulle avses den tid som \u00e5tgick f\u00f6r den klagande distribut\u00f6ren att utf\u00f6ra distributionsarbetet i dennes normala tempo, skulle f\u00f6rtj\u00e4nsten i st\u00e4llet bli h\u00f6gre ju l\u00e4ngre tid det tog f\u00f6r arbetstagaren att utf\u00f6ra arbetet. S\u00e5 l\u00e4nge arbetet skedde i ett f\u00f6r honom eller henne normalt arbetstempo, skulle n\u00e4mligen distribut\u00f6ren f\u00e5 timl\u00f6n f\u00f6r den tid som gick \u00e5t. Detta kunde enligt Arbetsdomstolen inte vara en \u00e4ndam\u00e5lsenlig tolkning och det talade med styrka f\u00f6r arbetsgivarsidans uppfattning om inneb\u00f6rden av avtalet. Slutsatsen blev att syftet med prestationsl\u00f6nen tydligt talade f\u00f6r arbetsgivarsidans st\u00e5ndpunkt. Arbetstagarsidans fastst\u00e4llelseyrkande avslogs s\u00e5ledes i den delen.<\/p>\n<p>I fr\u00e5gan om tidm\u00e4tning fann Arbetsdomstolen inte utrett att det funnits en gemensam partsavsikt om att distribut\u00f6rens resor till och fr\u00e5n bostaden\/utl\u00e4mningsst\u00e4llet och utdelningsdistrikten skulle anses utg\u00f6ra ett arbetsmoment och inkluderas vid ber\u00e4kning av tids\u00e5tg\u00e5ng enligt kollektivavtalet. Arbetsdomstolen konstaterade att f\u00f6rbundets tolkning skulle inneb\u00e4ra att avst\u00e5ndet mellan bostadsadressen\/utl\u00e4mningsst\u00e4llet och utdelningsdistriktet skulle f\u00e5 en avg\u00f6rande betydelse f\u00f6r arbetstagarens totala ers\u00e4ttning. Ers\u00e4ttningens storlek skulle ocks\u00e5 bli beroende av vilken av m\u00f6jliga adresser som arbetsgivaren valde. Enligt kollektivavtalet hade arbetstagaren m\u00f6jlighet att tacka nej till ett erbjudande om utdelning i ett visst distrikt om han eller hon ans\u00e5g att det l\u00e5g f\u00f6r l\u00e5ngt bort. Enligt Arbetsdomstolen talade dessa omst\u00e4ndigheter emot f\u00f6rbundets tolkning. Slutsatsen blev att regleringens uppbyggnad i sig talade f\u00f6r arbetsgivarparternas uppfattning om inneb\u00f6rden av avtalet, dvs att den tid det tar f\u00f6r arbetstagaren att ta sig till och fr\u00e5n distributionsdistriktet inte utgjorde ett arbetsmoment som skulle ing\u00e5 i tidm\u00e4tningen.
