Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2022 nr 07<\/strong><\/h3>\n<p>Tvisten r\u00f6rde en informat\u00f6r hos ett pastorat vars tillsvidareanst\u00e4llning p\u00e5 halvtid drogs in vid en omorganisation. Arbetstagaren erbj\u00f6ds tre olika tidsbegr\u00e4nsade anst\u00e4llningar som han avb\u00f6jde varp\u00e5 han sades upp p\u00e5 grund av arbetsbrist. Fr\u00e5ga i m\u00e5let var om omplaceringserbjudandena var osk\u00e4liga och om pastoratet brutit mot turordningsreglerna d\u00e5 arbetstagaren inte erbj\u00f6ds en heltidstj\u00e4nst som informat\u00f6r\/administrat\u00f6r.<\/p>\n<p>De tre tidsbegr\u00e4nsade anst\u00e4llningarna arbetstagaren erbj\u00f6ds innebar att han skulle beh\u00e5lla sin l\u00f6n och \u00f6vriga anst\u00e4llningsvillkor. Det f\u00f6rsta erbjudandet, ett sjukvikariat, kunde arbetstagaren vid tidpunkten f\u00f6r erbjudandet, inte f\u00f6rv\u00e4nta sig l\u00f6pa ens l\u00e4ngre \u00e4n den egna upps\u00e4gningstiden om sex m\u00e5nader. Enligt Arbetsdomstolen kunde det d\u00e4rmed inte anses vara ett sk\u00e4ligt omplaceringserbjudande, \u00e4ven om sjukskrivningen senare faktiskt kom att f\u00f6rl\u00e4ngas.<\/p>\n<p>\u00d6vriga tv\u00e5 omplaceringserbjudandena r\u00f6rde ett f\u00f6r\u00e4ldravikariat planerat till ett \u00e5r samt en s\u00e4songsanst\u00e4llning p\u00e5 heltid som skulle ha varat drygt tv\u00e5 m\u00e5nader l\u00e4ngre \u00e4n arbetstagarens upps\u00e4gningstid.<\/p>\n<p>Arbetsdomstolen konstaterade att omplaceringsskyldigheten prim\u00e4rt syftar till att skydda en fortsatt anst\u00e4llning som s\u00e5dan. Om arbetsgivaren inte ska ha n\u00e5gra tillsvidareanst\u00e4llda kvar utan bara tidsbegr\u00e4nsat anst\u00e4llda, \u00e4r arbetsgivaren skyldig att erbjuda tillsvidareanst\u00e4llda de tidsbegr\u00e4nsade anst\u00e4llningarna, och dessa erbjudanden \u00e4r d\u00e5 sk\u00e4liga eftersom det inte finns n\u00e5got annat alternativ. Arbetsdomstolen fr\u00e5gade sig om en tillsvidareanst\u00e4lld arbetstagare, som drabbats av arbetsbrist, ska beh\u00f6va acceptera omplacering till en ledig kort tidsbegr\u00e4nsad anst\u00e4llning, n\u00e4r det inom en t\u00e4nkt turordningskrets finns arbetstagare med kortare anst\u00e4llningstid som har tillsvidareanst\u00e4llningar som den arbetsbristdrabbade har tillr\u00e4ckliga kvalifikationer f\u00f6r. Huvudregeln enligt LAS \u00e4r att ett anst\u00e4llningsavtal ska g\u00e4lla tills vidare och Arbetsdomstolen resonerade att en tidsbegr\u00e4nsad anst\u00e4llning typiskt sett ses som en os\u00e4krare anst\u00e4llning. Domstolen menade att syftet med anst\u00e4llningsskyddet m\u00e5ste i f\u00f6rsta hand vara, om m\u00f6jligt, att skydda en anst\u00e4llning i form av en tillsvidareanst\u00e4llning. Om en arbetsbristdrabbad arbetstagare med en tillsvidareanst\u00e4llning skulle beh\u00f6va acceptera en omplacering till en kort tidsbegr\u00e4nsad anst\u00e4llning, n\u00e4r det finns andra alternativ, f\u00f6rlorar arbetstagaren sin tillsvidareanst\u00e4llning och det skydd den ger. I en s\u00e5dan situation \u00e4r det enbart turordningsreglerna som kan leda till fortsatt tillsvidareanst\u00e4llning f\u00f6r arbetstagaren.<\/p>\n<p>Mot bakgrund av att s\u00e4songsanst\u00e4llningen enbart skulle p\u00e5g\u00e5 ett par m\u00e5nader ut\u00f6ver upps\u00e4gningstiden, och att f\u00f6r\u00e4ldravikariatet fick anses f\u00f6renat med flera os\u00e4kerhetsmoment s\u00e5vitt avs\u00e5g anst\u00e4llningstidens l\u00e4ngd, var inte heller dessa omplaceringserbjudanden sk\u00e4liga enligt Arbetsdomstolen, under f\u00f6ruts\u00e4ttning att arbetstagaren efter omplacering enligt turordningsreglerna, hade kunnat beredas fortsatt arbete.<\/p>\n<p>Arbetsdomstolen \u00f6vergick s\u00e5ledes till att pr\u00f6va om den \u00f6vertaliga arbetstagaren hade tillr\u00e4ckliga kvalifikationer f\u00f6r rollen som informat\u00f6r\/administrat\u00f6r p\u00e5 heltid. Av utredningen fann Arbetsdomstolen att arbetsgivarparterna inte bevisat att den \u00f6vertaliga arbetstagaren saknade tillr\u00e4ckliga kvalifikationer f\u00f6r rollen. Slutsatsen blev s\u00e5ledes att pastoratet brutit mot turordningsreglerna.<\/p>\n<p>I fr\u00e5ga om det ekonomiska skadest\u00e5ndet gjorde arbetsgivarsidan g\u00e4llande att arbetstagaren inte st\u00e5tt till arbetsmarknadens f\u00f6rfogande d\u00e5 han inte hade varit anm\u00e4ld till Arbetsf\u00f6rmedlingen sedan han p\u00e5b\u00f6rjat en utbildning till undersk\u00f6terska. Eftersom studierna p\u00e5b\u00f6rjats efter planering i samr\u00e5d med Arbetsf\u00f6rmedlingen, fann Arbetsdomstolen ingen anledning att ifr\u00e5gas\u00e4tta arbetstagarens p\u00e5st\u00e5ende om att han trodde att han var fortsatt inskriven p\u00e5 Arbetsf\u00f6rmedlingen. Arbetsdomstolen godtog \u00e4ven arbetstagarens inv\u00e4ndning om att han p\u00e5b\u00f6rjade studierna f\u00f6r att klara sin f\u00f6rs\u00f6rjning genom studiestartsst\u00f6d och att den var avsedd att f\u00f6rb\u00e4ttra hans m\u00f6jligheter att \u00e5ter komma i arbete. Arbetstagaren tillerk\u00e4ndes d\u00e4rf\u00f6r ekonomiskt skadest\u00e5nd \u00e4ven f\u00f6r tid d\u00e5 han inte var inskriven p\u00e5 Arbetsf\u00f6rmedlingen, med avr\u00e4kning f\u00f6r det studiestartsst\u00f6d han f\u00e5tt. D\u00e4rut\u00f6ver tillerk\u00e4ndes han allm\u00e4nt skadest\u00e5nd f\u00f6r brott mot turordningsreglerna.
