Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2021 nr 67<\/strong><\/h3>\n<p>Fr\u00e5ga om ett avskedande av en lagerarbetare (TK) varit lagligen grundat, eller om det i vart fall funnits saklig grund f\u00f6r upps\u00e4gning.<\/p>\n<p>Arbetsgivarparterna gjorde g\u00e4llande att TK, vid fyra tillf\u00e4llen under 2020, hade medverkat n\u00e4r en kollega (SM), p\u00e5 arbetsplatsen, dels tog strypgrepp p\u00e5 en kvinnlig kollega (MT), samt h\u00f6ll fast och tryckte ned henne. Arbetsgivarparterna gjorde vidare g\u00e4llande att TK hade f\u00f6rsv\u00e5rat arbetsgivarens utredning av den sista h\u00e4ndelsen, genom att ha farit med osanning n\u00e4r bolaget fr\u00e5gade honom om h\u00e4ndelsen fyra dagar senare.<\/p>\n<p>Arbetstagarsidan gjorde g\u00e4llande att TK inte hade medverkat till v\u00e5ld eller trakasserier mot den kvinnliga kollegan p\u00e5 n\u00e5got s\u00e4tt, samt att han inte heller avsiktligen hade f\u00f6rsv\u00e5rat arbetsgivarens utredning av den sista h\u00e4ndelsen. Arbetstagarsidan gjorde g\u00e4llande att TK hade avskedats utan att det ens fanns saklig grund f\u00f6r upps\u00e4gning, och yrkade d\u00e4rf\u00f6r att avskedandet skulle ogiltigf\u00f6rklaras.<\/p>\n<p>Avseende de tre f\u00f6rsta h\u00e4ndelserna gjorde Arbetsdomstolen f\u00f6ljande bed\u00f6mning. Arbetsdomstolen konstaterade inledningsvis att ord stod mot ord i fr\u00e5gan om det f\u00f6rekom trakasserier genom bl.a. grepp runt halsen, och att det inte fanns n\u00e5gon st\u00f6dbevisning. Enligt Arbetsdomstolens mening var det inte bevisat att TK, med ord eller handling, hade fr\u00e4mjat det som arbetsgivaren p\u00e5stod vid n\u00e5gon av de tre f\u00f6rsta h\u00e4ndelserna.<\/p>\n<p>Avseende den fj\u00e4rde och sista h\u00e4ndelsen, som intr\u00e4ffade den 1 oktober 2020, gjorde Arbetsdomstolen f\u00f6ljande bed\u00f6mning.<\/p>\n<p>Enligt Arbetsdomstolen var det ostridigt eller i vart fall utrett att SM, p\u00e5 arbetsplatsen den 1 oktober, hade tagit strypgrepp p\u00e5 MT samt att han tryckte ned och h\u00f6ll fast henne. Enligt Arbetsdomstolen var det vidare ostridigt eller i vart fall utrett att detta skedde mot MTs vilja, och att TK, som befann sig i arbete i n\u00e4rheten, varken ingrep mot eller slog larm om f\u00f6rfarandet.<\/p>\n<p>Arbetsdomstolen framh\u00f6ll sedan att arbetsgivarparterna inte hade p\u00e5st\u00e5tt att TK sj\u00e4lv trakasserat eller ut\u00f6vat v\u00e5ld mot MT, utan p\u00e5st\u00e5tt att han medverkat n\u00e4r SM gjorde det. Arbetsdomstolen framh\u00f6ll att arbetsgivarparterna menade att TK fr\u00e4mjat SMs agerande genom att han:<\/p>\n<ul>\n<li>Gemensamt och i samf\u00f6rst\u00e5nd med SM och en annan kollega samlats kring MT,<\/li>\n<li>H\u00e5llit utkik efter f\u00f6rbipasserande,<\/li>\n<li>St\u00e4ngt av utrymmet d\u00e4r SM och MT befann sig s\u00e5 att MT inte kunde ta sig fr\u00e5n platsen, och<\/li>\n<li>Med en gest visat SM hur ett strypgrepp ska tas.<\/li>\n<\/ul>\n<p>Arbetsdomstolen framh\u00f6ll vidare att arbetsgivarparterna hade lagt TK till last att han varken ingrep mot eller slog larm om SMs handgripligheter mot MT medan dessa p\u00e5gick.<\/p>\n<p>Arbetsdomstolen uttalade sedan bl.a. f\u00f6ljande om de r\u00e4ttsliga utg\u00e5ngspunkterna.<\/p>\n<p>Att en arbetstagare p\u00e5 arbetsplatsen utan samtycke ut\u00f6var v\u00e5ld mot en kollega utg\u00f6r normalt ett allvarligt \u00e5sidos\u00e4ttande av arbetstagarens skyldigheter i anst\u00e4llningen, och dessutom ett brott. Detsamma g\u00e4ller normalt den som med r\u00e5d eller d\u00e5d fr\u00e4mjar g\u00e4rningen. Arbetsdomstolen framh\u00f6ll att arbetsgivaren har bevisb\u00f6rdan f\u00f6r det som l\u00e4ggs arbetstagaren till last.<\/p>\n<p>Arbetsdomstolen anf\u00f6rde vidare att det i svensk r\u00e4tt, utom i fr\u00e5ga om vissa s\u00e4rskilt allvarliga brott, inte finns n\u00e5gon allm\u00e4n skyldighet att f\u00f6rs\u00f6ka avv\u00e4rja p\u00e5g\u00e5ende misst\u00e4nkta brottsliga handlingar genom att t ex ingripa fysiskt eller sl\u00e5 larm. Enligt Arbetsdomstolen kan dock en arbetstagare, t ex p\u00e5 grund av sina arbetsuppgifter, ha en skyldighet gentemot arbetsgivaren att f\u00f6rs\u00f6ka avv\u00e4rja olika f\u00f6rh\u00e5llanden. S\u00e5 kan \u00e4ven vara fallet om arbetsgivaren s\u00e4rskilt instruerat arbetstagare i allm\u00e4nhet att f\u00f6rs\u00f6ka avv\u00e4rja vissa p\u00e5g\u00e5ende oegentligheter p\u00e5 arbetsplatsen. Av arbetsmilj\u00f6lagen (3 kap. 4 \u00a7) f\u00f6ljer vidare att en arbetstagare \u00e4r skyldig att medverka i arbetsmilj\u00f6arbetet, samt att arbetstagaren \u00e4r skyldig att underr\u00e4tta arbetsgivaren eller skyddsombud snarast om arbetstagaren finner att arbetet inneb\u00e4r omedelbar och allvarlig fara f\u00f6r liv eller h\u00e4lsa.<\/p>\n<p>Arbetsdomstolen angav sedan att det, varken av den allm\u00e4nna lojalitetsplikten i ett anst\u00e4llningsf\u00f6rh\u00e5llande eller av arbetstagarens allm\u00e4nna skyldigheter enligt arbetsmilj\u00f6lagen, kan anses f\u00f6lja en skyldighet att f\u00f6rs\u00f6ka avv\u00e4rja s\u00e5dana p\u00e5g\u00e5ende handgripligheter mellan arbetskamrater som inte uppenbart kan leda till allvarlig skada p\u00e5 person eller egendom.<\/p>\n<p>Arbetsdomstolen redovisade sedan vad som framkommit genom utredningen i m\u00e5let. Arbetsdomstolen hade bl.a. tagit del av en film \u2013 som var drygt tv\u00e5 minuter l\u00e5ng och saknade ljud \u2013 fr\u00e5n en \u00f6vervakningskamera som visade h\u00e4ndelsef\u00f6rloppet den 1 oktober. Arbetsdomstolen redogjorde \u00e4ven f\u00f6r vad som framkommit genom vittnenas uppgifter i m\u00e5let.<\/p>\n<p>Mot denna bakgrund gjorde Arbetsdomstolen sammanfattningsvis bed\u00f6mningen att det inte var bevisat att TK, p\u00e5 p\u00e5st\u00e5tt s\u00e4tt, hade fr\u00e4mjat SMs handgripligheter mot MT.<\/p>\n<p>Enligt Arbetsdomstolen hade lagerarbetaren TK s\u00e5vitt framkommit inte n\u00e5got s\u00e4rskilt ansvar f\u00f6r ordningen mellan arbetskamraterna, och det framgick inte heller av bolagets ordningsregler eller arbetsmilj\u00f6policy att en arbetstagare var skyldig att f\u00f6rs\u00f6ka avv\u00e4rja p\u00e5g\u00e5ende handgripligheter mellan arbetstagare. Enligt Arbetsdomstolen kunde det som skedde mellan SM och MT inte uppenbart antas leda till allvarlig skada p\u00e5 person eller egendom. D\u00e4rmed ans\u00e5g Arbetsdomstolen att TK inte varit skyldig att f\u00f6rs\u00f6ka avv\u00e4rja handgripligheterna mot MT, ens om han hade f\u00f6rst\u00e5tt att dessa var ov\u00e4lkomna. Att handgripligheterna enligt Arbetsdomstolens bed\u00f6mning \u201dtvekl\u00f6st i och f\u00f6r sig var ol\u00e4mpliga p\u00e5 en arbetsplats\u201d \u00e4ndrade inte bed\u00f6mningen.<\/p>\n<p>Arbetsdomstolen ans\u00e5g s\u00e5ledes att det inte var visat att TK br\u00f6t mot sina skyldigheter i anst\u00e4llningen den 1 oktober 2020.<\/p>\n<p>Avseende arbetsgivarparternas p\u00e5st\u00e5ende om att TK for med osanning under bolagets utredning av h\u00e4ndelsen den 1 oktober 2020 uttalade Arbetsdomstolen bl.a. att den allm\u00e4nna lojalitetsplikten i ett anst\u00e4llningsf\u00f6rh\u00e5llande inneb\u00e4r att en arbetstagare, p\u00e5 direkta fr\u00e5gor fr\u00e5n arbetsgivaren, normalt har att sanningsenligt redog\u00f6ra f\u00f6r sina iakttagelser p\u00e5 arbetsplatsen under arbetstid som har betydelse f\u00f6r t ex arbetsmilj\u00f6n. Mot TKs uppgifter ans\u00e5g Arbetsdomstolen dock det inte bevisat att TK for med osanning vid samtalet eller att han annars f\u00f6rsv\u00e5rade bolagets utredning om h\u00e4ndelsen den 1 oktober.<\/p>\n<p>Arbetsdomstolens slutsatser innebar att det inte ans\u00e5gs bevisat att TK brutit mot sina skyldigheter i anst\u00e4llningen, och bolaget hade d\u00e4rmed inte haft grund f\u00f6r att skilja honom fr\u00e5n anst\u00e4llningen.
