Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2021 nr 64<\/strong><\/h3>\n<p>Tvisten r\u00f6rde en kollektivavtalsbest\u00e4mmelse som g\u00e4llde f\u00f6r arbetsgivaren SJ, om att arbetstagare skulle ha r\u00e4tt till en viloperiod om minst elva timmar mellan varje arbetsperiod. Fr\u00e5ga i m\u00e5let var om SJ brutit mot best\u00e4mmelsen genom att en t\u00e5gv\u00e4rd till f\u00f6ljd av f\u00f6rseningar f\u00e5tt en kortare viloperiod \u00e4n s\u00e5.<\/p>\n<p>Arbetsdomstolen gick inledningsvis igenom historiken bakom dygnsviloreglerna i arbetstidslagen och inf\u00f6randet av EU:s arbetstidsdirektiv. Vidare redogjorde domstolen f\u00f6r vad utredningen i m\u00e5let visade om n\u00e4r kollektivavtalsbest\u00e4mmelsen kom till och vilka \u00e4ndringar som gjorts i den under \u00e5rens lopp.<\/p>\n<p>Arbetsdomstolen konstaterade att det av 13 \u00a7 f\u00f6rsta stycket arbetstidslagen f\u00f6ljer att arbetsgivaren \u00e4r skyldig att s\u00e4kerst\u00e4lla att alla arbetstagare f\u00e5r minst elva timmars sammanh\u00e4ngande ledighet under varje period om tjugofyra timmar (dygnsvila). Best\u00e4mmelsen avser allts\u00e5 att arbetstagarna faktiskt ska f\u00e5 den f\u00f6reskrivna dygnsvilan, och \u00e4r inte begr\u00e4nsad till hur arbetsgivaren ska agera vid t.ex. schemal\u00e4ggning.<\/p>\n<p>Arbetsgivarparterna gjorde i m\u00e5let g\u00e4llande f\u00f6ljande. Kollektivavtalsbest\u00e4mmelsen reglerar enbart bolagets skyldigheter vid schemal\u00e4ggning. Kollektivavtalsbest\u00e4mmelsen tr\u00e4dde inte i st\u00e4llet f\u00f6r 13 \u00a7 f\u00f6rsta stycket arbetstidslagen avseende vare sig skyldigheten att tillse att alla arbetstagare f\u00e5r minst elva timmars sammanh\u00e4ngande dygnsvila, eller m\u00f6jligheten att tillf\u00e4lligtvis avvika fr\u00e5n regeln vid of\u00f6rutsedda h\u00e4ndelser, under f\u00f6ruts\u00e4ttning att arbetstagaren ges motsvarande kompensationsledighet. Bolaget var s\u00e5ledes skyldigt att dels f\u00f6lja regeln om viloperiod vid schemal\u00e4ggning i kollektivavtalet, dels regeln om dygnsvila i arbetstidslagen.<\/p>\n<p>Arbetstagarsidan gjorde \u00e5 sin sida g\u00e4llande att kollektivavtalsbest\u00e4mmelsen inte var begr\u00e4nsad till arbetsgivarens skyldigheten vid schemal\u00e4ggning, utan reglerade \u00e4ven arbetstagarnas r\u00e4tt till viloperiod mellan arbetsperioder. Enligt arbetstagarsidan ersatte best\u00e4mmelsen 13 \u00a7 f\u00f6rsta stycket arbetstidslagen.<\/p>\n<p>Utredningen gav enligt Arbetsdomstolen inte st\u00f6d f\u00f6r att det f\u00f6relegat n\u00e5gon gemensam uppfattning om inneb\u00f6rden av best\u00e4mmelsen vid avtalets tecknande. Enligt Arbetsdomstolen gav avtalsbest\u00e4mmelsens allm\u00e4nna uppbyggnad ett klart f\u00f6rsteg f\u00f6r arbetsgivarsidans uppfattning. I inledningen till best\u00e4mmelsen angavs att \u201dnedanst\u00e5ende punkter\u201d g\u00e4ller vid uppr\u00e4ttande av fast lista eller vid beordring till ordinarie tj\u00e4nstg\u00f6ring. Med lista avs\u00e5gs enligt avtalet ett schema. Arbetsgivarsidans uppfattning om \u201dbeordring till ordinarie tj\u00e4nstg\u00f6ring\u201d godtogs av Arbetsdomstolen, n\u00e4mligen att det syftade till arbetstagare som inte tj\u00e4nstgjorde enligt fast lista som ist\u00e4llet fick en prelimin\u00e4r plan f\u00f6r tj\u00e4nstg\u00f6ringen f\u00f6r s\u00e5 l\u00e5ng tidsperiod som m\u00f6jligt.<\/p>\n<p>Det faktum att det saknades skrivning i kollektivavtalet om att den aktuella best\u00e4mmelsen utgjorde en avvikelse fr\u00e5n arbetstidslagen talade enligt Arbetsdomstolen emot att den var avsedd att ers\u00e4tta 13 \u00a7 f\u00f6rsta stycket arbetstidslagen. Att kollektivavtalet anv\u00e4nde begreppet \u201dviloperiod\u201d till skillnad fr\u00e5n lagens \u201ddygnsvila\u201d utgjorde ytterligare en omst\u00e4ndighet som talade f\u00f6r arbetsgivarsidans tolkning.<\/p>\n<p>Arbetsdomstolen delade inte arbetstagarsidan uppfattning om att arbetstidslagens ordning med fasta 24-timmarsperioder inte gick att f\u00f6lja samtidigt som man f\u00f6ljde kollektivavtalets ordning med viloperioder mellan arbetsperioder. D\u00e4remot kunde detta inneb\u00e4ra p\u00e5tagliga begr\u00e4nsningar i arbetsgivarens handlingsutrymme i fr\u00e5ga om arbetstidsf\u00f6rl\u00e4ggning. Att arbetsgivaren i vissa situationer hade beordrat anst\u00e4llda till kortare viloperioder p\u00e5verkade inte bed\u00f6mningen av avtalets inneb\u00f6rd enligt Arbetsdomstolen.<\/p>\n<p>Sammanfattningsvis fann Arbetsdomstolen att kollektivavtalsbest\u00e4mmelsen endast reglerade arbetsgivarens skyldigheter vid schemal\u00e4ggning och ersatte inte 13 \u00a7 f\u00f6rsta stycket arbetstidslagen. Arbetsgivaren hade s\u00e5ledes inte brutit mot best\u00e4mmelsen n\u00e4r bolaget underl\u00e4t att tillse att arbetstagaren fick elva timmar viloperiod mellan arbetspassen viss dag. Arbetstagarsidans talan avslogs f\u00f6ljaktligen.
