Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<h3><strong>AD 2021 nr 63<\/strong><\/h3>\n<p>M\u00e5let g\u00e4llde en s\u00e4kerhetssamordnare vid Migrationsverket vars befattning var placerad i s\u00e4kerhetsklass 2 enligt s\u00e4kerhetsskyddslagen. Efter en f\u00f6rnyad s\u00e4kerhetspr\u00f6vning beslutade Migrationsverket att arbetstagarens inplacering i s\u00e4kerhetsklass skulle upph\u00f6ra varigenom han enligt f\u00f6rfattning inte l\u00e4ngre var beh\u00f6rig som s\u00e4kerhetssamordnare. Arbetstagaren erbj\u00f6ds omplacering till migrationshandl\u00e4ggare vilket han avb\u00f6jde, varefter han sades upp av personliga sk\u00e4l. I m\u00e5let var tvistigt om upps\u00e4gningen var sakligt grundad och om Migrationsverket agerat i strid med tv\u00e5m\u00e5nadersregeln i anst\u00e4llningsskyddslagen (LAS).<\/p>\n<p>Arbetsdomstolen redogjorde inledningsvis f\u00f6r sin praxis, av vilken det framg\u00e5r att en arbetsgivare kan skilja en arbetstagare fr\u00e5n anst\u00e4llningen utan att iaktta LAS regler, om anst\u00e4llningen kommit att st\u00e5 i strid med f\u00f6rfattning p\u00e5 ett definitivt s\u00e4tt och arbetstagaren inte alls f\u00e5r anv\u00e4ndas i den verksamhet som arbetsgivaren bedriver. Det har d\u00e5 handlat om beslut fattade av n\u00e5gon annan \u00e4n arbetsgivaren om bl a arbetstillst\u00e5nd och s\u00e4kerhetspr\u00f6vning. N\u00e4r det \u00e5 andra sidan \u00e4r fr\u00e5ga om s\u00e4kerhetspr\u00f6vning och en bed\u00f6mning har gjorts av den statliga anst\u00e4llningsmyndigheten sj\u00e4lv, och det beslutet har lett till att en anst\u00e4llning kommit att st\u00e5 i strid med f\u00f6rfattning, s\u00e5 ska en pr\u00f6vning i sak enligt LAS g\u00f6ras. F\u00f6r den som inte l\u00e4ngre uppfyller kraven f\u00f6r godk\u00e4nd s\u00e4kerhetspr\u00f6vning i dessa fall, kan det finnas m\u00f6jlighet f\u00f6r anst\u00e4llningsmyndigheten att erbjuda annat arbete som inte \u00e4r s\u00e5 s\u00e4kerhetsk\u00e4nsligt. Av Europadomstolens praxis f\u00f6ljer att en domstol har att, om arbetstagaren beg\u00e4r det, granska de omst\u00e4ndigheter som gjort att anst\u00e4llningen avslutats s\u00e5vida inte s\u00e4kerhetspr\u00f6vningsbeslutet kan \u00f6verpr\u00f6vas p\u00e5 ett s\u00e4tt som uppfyller kraven p\u00e5 en r\u00e4ttvis r\u00e4tteg\u00e5ng enligt Europakonventionen.<\/p>\n<p>Arbetsdomstolen fann att Migrationsverket, f\u00f6rutom att visa att s\u00e4kerhetssamordnaren hade avb\u00f6jt ett sk\u00e4ligt omplaceringserbjudande, \u00e4ven hade att visa omst\u00e4ndigheter som gjorde att det kunde antas att arbetstagaren inte var lojal mot de intressen som skyddas i s\u00e4kerhetsskyddslagen eller i \u00f6vrigt inte var p\u00e5litlig fr\u00e5n s\u00e4kerhetssynpunkt. Av f\u00f6rarbetena till s\u00e4kerhetsskyddslagen framg\u00e5r att upplevt missn\u00f6je med sin arbetssituation kan vara ett s\u00e5dant f\u00f6rh\u00e5llande som kan p\u00e5verka risk och mottaglighet f\u00f6r utpressning och d\u00e4rmed s\u00e5rbarheten i s\u00e4kerhetsh\u00e4nseende.<\/p>\n<p>G\u00e4llande tv\u00e5m\u00e5nadersregeln konstaterade Arbetsdomstolen att den omst\u00e4ndigheten att arbetstagaren avb\u00f6jt ett erbjudande om annat arbete \u00e4r en f\u00f6ruts\u00e4ttning f\u00f6r att det ska finnas saklig grund f\u00f6r upps\u00e4gning. N\u00e4r anst\u00e4llningsmyndigheten l\u00e4mnade ett seri\u00f6st erbjudande om annat arbete och s\u00e5ledes inte avs\u00e5g vidta n\u00e5gon upps\u00e4gning, var det enligt Arbetsdomstolen tillr\u00e4ckligt f\u00f6r att uppfylla tv\u00e5m\u00e5nadersregeln att Migrationsverket underr\u00e4ttade arbetstagaren om tillt\u00e4nkt upps\u00e4gning senast tv\u00e5 m\u00e5nader efter det att arbetstagaren avb\u00f6jde erbjudandet. I och med detta fick \u00e4ven tidigare k\u00e4nda omst\u00e4ndigheter som s\u00e4kerhetspr\u00f6vningen grundade sig p\u00e5 beaktas.<\/p>\n<p>Arbetsdomstolen \u00f6vergick till att pr\u00f6va fr\u00e5gan om det kunde antas att s\u00e4kerhetssamordnaren inte var p\u00e5litlig ur s\u00e4kerhetssynpunkt. Den f\u00f6rnyade s\u00e4kerhetspr\u00f6vningen baserades p\u00e5 uppgifter fr\u00e5n fem personer, bland annat chefer och kollegor p\u00e5 Migrationsverket, samt en s\u00e4kerhetspr\u00f6vningsintervju med arbetstagaren sj\u00e4lv. Uppgifterna hade dokumenterats skriftligt och \u00e5beropades som bevisning i m\u00e5let.<\/p>\n<p>Av arbetstagarsidans muntliga bevisning framkom inget som gjorde att det kunde antas att s\u00e4kerhetssamordnare inte var p\u00e5litlig fr\u00e5n s\u00e4kerhetssynpunkt, snarast tv\u00e4rtom. De flesta som l\u00e4mnat uppgifter inf\u00f6r den f\u00f6rnyade s\u00e4kerhetspr\u00f6vningen h\u00f6rdes inte i m\u00e5let. Ett av arbetsgivarsidans \u00e5beropade vittnen ber\u00e4ttade om ett m\u00f6te d\u00e5 arbetstagaren varit raljerande och cynisk i f\u00f6rh\u00e5llande till myndighetsledningen. Arbetstagaren uppgav i sitt f\u00f6rh\u00f6r att de kritiska uppgifterna om honom i det skriftliga underlaget till s\u00e4kerhetspr\u00f6vningen samt i den muntliga bevisningen i stora delar var oriktiga.<\/p>\n<p>Arbetsdomstolen fann att det inte framkommit sk\u00e4l att ifr\u00e5gas\u00e4tta att uppgiftsl\u00e4mnarnas ber\u00e4ttelser dokumenterats korrekt i underlaget f\u00f6r s\u00e4kerhetspr\u00f6vningen. Av underlaget framgick att s\u00e4kerhetssamordnaren vid flera olika tillf\u00e4llen inf\u00f6r andra hade uttryckt missn\u00f6je med Migrationsverkets s\u00e4kerhetsverksamhet och, p\u00e5 ett delvis anm\u00e4rkningsv\u00e4rt s\u00e4tt, \u00e4ven med de som ansvarade f\u00f6r den.<\/p>\n<p>Att uppgiftsl\u00e4mnarna, som inte h\u00f6rts i m\u00e5let, sagt det som dokumenterats kunde dock inte, mot arbetstagarens best\u00e4mda f\u00f6rnekande under sanningsf\u00f6rs\u00e4kran, anses ha s\u00e5dan bevisverkan att det var visat att arbetstagaren sagt det som dokumenterats. G\u00e4llande viss muntlig bevisning fann Arbetsdomstolen att ord stod mot ord, och att det vid avsaknad av st\u00f6dbevisning som rimligen borde varit m\u00f6jlig att f\u00e5 fram, inte fanns anledning att tro mer p\u00e5 den ena eller den andra. Sammanfattningsvis fann Arbetsdomstolen inte visat att s\u00e4kerhetssamordnaren inte var lojal mot de intressen som skyddas i s\u00e4kerhetsskyddslagen eller i \u00f6vrigt inte var p\u00e5litlig fr\u00e5n s\u00e4kerhetssynpunkt. Det innebar att det, trots att arbetstagaren avb\u00f6jt ett omplaceringserbjudande, inte fanns saklig grund f\u00f6r upps\u00e4gning. Upps\u00e4gningen ogiltigf\u00f6rklarades och det allm\u00e4nna skadest\u00e5ndet best\u00e4mdes till, enligt Arbetsdomstolen sk\u00e4liga, 75\u00a0000 kr.<\/p>\n<p>Avslutningsvis konstaterade Arbetsdomstolen att Migrationsverkets underlag till s\u00e4kerhetspr\u00f6vningen hade en rimlig omfattning och hade tagits fram p\u00e5 ett godtagbart s\u00e4tt. P\u00e5 s\u00e5 vis hade Migrationsverket befogad anledning att dra slutsatsen att s\u00e4kerhetssamordnaren inte l\u00e4ngre uppfyllde kraven enligt s\u00e4kerhetsskyddslagen och att han beh\u00f6vde omplaceras. Genom domen klargjorde Arbetsdomstolen hur bevisfr\u00e5gorna i aktuell situation ska bed\u00f6mas.
