Sakliga sk\u00e4l f\u00f6r upps\u00e4gning<\/h2>\n\n\n\n<p>I lagtexten om upps\u00e4gning ers\u00e4tts begreppet \u201dsaklig grund\u201d med \u201dsakliga sk\u00e4l\u201d. Det \u00e4r den st\u00f6rsta f\u00f6r\u00e4ndringen vad g\u00e4ller personliga sk\u00e4l som skett p\u00e5 omr\u00e5det sedan 1970-talet och syftet \u00e4r att g\u00f6ra det mer f\u00f6ruts\u00e4gbart vad som ska r\u00e4knas som sakligt sk\u00e4l n\u00e4r en arbetsgivare s\u00e4ger upp en anst\u00e4lld.<\/p>\n\n\n\n<p>\u2013 Det h\u00e4r inneb\u00e4r en stor f\u00f6r\u00e4ndring kring fr\u00e5gan om personliga sk\u00e4l. Vid en tvist ska domstolen inte l\u00e4ngre beakta fr\u00e5gor som till exempel vad medarbetaren har f\u00f6r intresse av att ha kvar anst\u00e4llningen och en omplacering ska inte beh\u00f6va ske mer \u00e4n en g\u00e5ng som huvudregel. Ist\u00e4llet blir det mer fokus p\u00e5 brottet mot anst\u00e4llningsavtalet \u00e4n den anst\u00e4lldas personliga omst\u00e4ndigheter. Turordningsundantag f\u00f6r alla f\u00f6retag<\/h2>\n\n\n\n<p>Med de nya reglerna kommer alla f\u00f6retag att kunna undanta tre medarbetare som har s\u00e4rskild betydelse f\u00f6r den fortsatta verksamheten fr\u00e5n turordningsreglerna.<\/p>\n\n\n\n<p>\u2013 Och f\u00f6retag med huvudavtal kommer att ha fler m\u00f6jligheter att g\u00f6ra undantag fr\u00e5n turordningsreglerna. Anst\u00e4llningen upph\u00f6r vid tvister om ogiltigf\u00f6rklaring<\/h2>\n\n\n\n<p>Till skillnad fr\u00e5n dagens regler kommer anst\u00e4llningen inte att best\u00e5 under tvistetiden om en medarbetare bestrider upps\u00e4gningen. Ist\u00e4llet f\u00e5r medarbetaren ans\u00f6ka om a-kassa och st\u00e5 till arbetsmarknadens f\u00f6rfogande.<\/p>\n\n\n\n<p>\u2013 Det h\u00e4r \u00e4r en viktig f\u00f6r\u00e4ndring, f\u00f6r som reglerna har sett ut tidigare har det varit kostnadsdrivande p\u00e5 ett s\u00e4tt som inte minst p\u00e5verkat mindre f\u00f6retag kraftigt. De f\u00f6retag som g\u00f6r r\u00e4tt vid upps\u00e4gning ska inte l\u00e4ngre beh\u00f6va betala \u00e5rsl\u00f6ner f\u00f6r att f\u00e5 saken pr\u00f6vad. Det inneb\u00e4r bland annat att anst\u00e4llningen snabbare g\u00e5r \u00f6vertill tillsvidareanst\u00e4llning, f\u00f6r den som varit visstidsanst\u00e4lld 12 m\u00e5nader under en fem\u00e5rsperiod, ist\u00e4llet f\u00f6r tidigare 24 m\u00e5nader.<\/p>\n\n\n\n<p>\u2013 Den h\u00e4r f\u00f6r\u00e4ndringen g\u00e4ller dock inte f\u00f6r merparten av Almegas medlemsf\u00f6retag. M\u00f6jligheterna till hyvling begr\u00e4nsas<\/h2>\n\n\n\n<p>N\u00e4r arbetsgivare omorganiserar en driftsenhet och enbart erbjuder l\u00e4gre syssels\u00e4ttningsgrad ska dessa l\u00e4mnas enligt en s\u00e4rskild turordning bland de som har samma arbetsuppgifter p\u00e5 driftsenheten, enligt det nya f\u00f6rslaget.<\/p>\n\n\n\n<p>\u2013 Och den som tackar ja till erbjudandet har en omst\u00e4llningsperiod motsvarande upps\u00e4gningstid, som l\u00e4ngst tre m\u00e5nader. Inhyrd bemanningspersonal ska erbjudas tillsvidareanst\u00e4llning<\/h2>\n\n\n\n<p>Anst\u00e4llda hos bemanningsf\u00f6retag som, i minst 24 m\u00e5nader under en period om 36 m\u00e5nader, varit placerad p\u00e5 samma driftsenhet hos ett kundf\u00f6retag ska erbjudas tillsvidareanst\u00e4llning hos kundf\u00f6retaget.<\/p>\n\n\n\n<p>\u2013&nbsp;Den erbjudna tj\u00e4nstens anst\u00e4llningsvillkor beh\u00f6ver inte vara p\u00e5 viss niv\u00e5 och n\u00e5gon anst\u00e4llningstid tas inte med om erbjudandet accepteras. Om erbjudandet inte antas kan uthyrningen forts\u00e4tta och n\u00e5gon ny 24-m\u00e5nadersperiod b\u00f6rjar inte l\u00f6pa p\u00e5 samma kundf\u00f6retag. Som alternativ till erbjudande om anst\u00e4llning kan kundf\u00f6retaget erbjuda en ers\u00e4ttning motsvarande tv\u00e5
